Por Resolución 126/2015 (B.O. 18/3/2015), se creó el “Programa de Estímulo al Pequeño Productor de Granos”, dirigido a ciertos productores de granos, quienes podrán resultar beneficiarios de dicho programa en caso de cumplir con los requisitos establecidos en el art. 2 de la citada resolución.
Conforme se expresa en los considerandos de la norma en comentario, esta medida se enmarca en «las políticas del Estado destinadas a promover el crecimiento económico y el desarrollo, incentivando la inversión productiva y la demanda.» Asimismo, se indica que «usualmente, los pequeños productores tienen mayores costos, menor acceso a financiamiento y cuentan con menor poder de negociación frente al sector industrial, comercializador y exportador» …teniendo en cuenta la situación descripta, en consonancia con las decisiones políticas llevadas a cabo por el Gobierno desde el 2003, en miras a impulsar la distribución equitativa del ingreso y promover el desarrollo de las economías regionales, resulta necesaria la creación de un programa de estímulo dirigido a los pequeños productores de granos, que tiene por objetivo principal mejorar los ingresos económicos de aquellos productores que hubieren obtenido hasta un total acumulado de SETECIENTAS TONELADAS (700 t) de trigo, soja, maíz y girasol en el territorio de la REPÚBLICA ARGENTINA, en la campaña agrícola 2013/2014.»
En tal sentido se resolvió:
(ACLARACIÓN: LOS ARTÍCULOS 1, 3 Y 5 DE LA RESOLUCIÓN 126/2015 FUERON SUSTITUIDOS POR LOS TEXTOS DISPUESTOS MEDIANTE RESOLUCIÓN 175/2015 -B.O. 30/3/2015-).
Artículo 1° — Créase en el ámbito de la SECRETARÍA DE COMERCIO del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS el “Programa de Estímulo al Pequeño Productor de Granos”, destinado a otorgar compensaciones económicas a aquellos pequeños productores que hubieren obtenido hasta un total acumulado de SETECIENTAS TONELADAS (700 t) de trigo y/o soja y/o maíz y/o girasol en el territorio de la REPÚBLICA ARGENTINA, en la campaña 2013/2014.
Art. 2° — Podrán ser beneficiarios del Programa aprobado por el Artículo 1°, las personas físicas o jurídicas que hubieren producido trigo y/o soja y/o maíz y/o girasol en el territorio de la REPÚBLICA ARGENTINA, y que cumplan con los siguientes requisitos: a) Haber producido por un volumen de hasta SETECIENTAS TONELADAS (700 t) acumuladas en la cosecha 2013/2014, tomando como base de cálculo lo producido en forma individual por la persona física o jurídica que solicitare el beneficio, independientemente de la cantidad de establecimientos rurales que explote, sean propios o de terceros. b) Encontrarse inscripto en la nómina de productores de la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS, entidad autárquica en el ámbito del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS, según la Resolución General N° 2.750 de fecha 18 de enero de 2010 de ese Organismo Recaudador. c) Encontrarse debidamente inscripto de conformidad con lo establecido en el Artículo 9° de la presente medida.
Art. 3° — El “Programa de Estímulo al Pequeño Productor de Granos” será de aplicación para el período comprendido entre los meses de “enero de 2015” a “diciembre de 2015”, inclusive, pudiendo ser prorrogado.
Art. 4° — A los efectos del cálculo de la compensación que corresponda a cada pequeño productor, se determinan SIETE (7) estratos conforme las cantidades producidas de los granos mencionadas en el Artículo 2° y según se consigna en el ANEXO I que forma parte integrante del presente acto. Para la determinación de los estratos mencionados, para cada productor, sólo se tomará en cuenta la producción de los cultivos de soja, trigo, maíz y girasol de la campaña 2013/2014, según la información que se hubiere brindado oportunamente a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS.
Art. 5° — El monto total en pesos a percibir por cada beneficiario del Programa quedará determinado por la multiplicación de su producción por el monto por tonelada estipulado en el ANEXO I de la presente, según su clasificación por estrato.
Art. 6° — El monto estipulado en el artículo precedente será pagado mensualmente, de acuerdo al porcentaje establecido para cada mes del Programa en el ANEXO II, que forma parte integrante de la presente medida. Dicho porcentual podrá incrementarse o disminuirse de acuerdo a lo estipulado en el Artículo 7°.
Art. 7° — Mensualmente la SECRETARÍA DE COMERCIO efectuará una estimación de la liquidación total de divisas esperada de los complejos de soja, trigo, maíz y girasol. En la primera estimación, adicionalmente, se calcularán, las sumas correspondientes a los meses no cancelados del programa. La SECRETARÍA DE COMERCIO contrastará el monto estimado con las sumas efectivamente liquidadas, de acuerdo a la información que produzca el BANCO CENTRAL DE LA REPÚBLICA ARGENTINA. En el supuesto en que la liquidación efectiva difiera de aquella que fuera estimada por la SECRETARÍA DE COMERCIO, el pago mensual a los productores será proporcional a esa diferencia; en ningún caso el monto total pagado al beneficiario durante la vigencia del Programa será superior al establecido en el Artículo 5°.
Art. 8° — Para el caso en que el mecanismo establecido en el Artículo 7° genere pagos acumulados menores al monto correspondiente a cada beneficiario de conformidad al Artículo 5°, se compensará el saldo pendiente en el cálculo del pago de diciembre de 2015, hasta arribar al monto total a percibir.
Art. 9° — Los interesados en participar del Programa deberán inscribirse a través de la página web oficial de esta repartición ministerial y completar la información que a tales efectos se determine oportunamente, con carácter de declaración jurada.
Art. 10. — La SECRETARÍA DE COMERCIO aprobará mensualmente los pagos correspondientes a los beneficiarios, los que serán efectuados a través de transferencia bancaria en forma mensual, a mes vencido. Por única vez, el primer pago incluirá los beneficios correspondientes a los meses no cancelados, desde el comienzo del Programa.
Art. 11. — Facúltase a la SECRETARÍA DE COMERCIO para dictar las normas reglamentarias y a suscribir los convenios que resulten necesarios para la implementación y ejecución del Programa.
Art. 12. — Los gastos que demande la financiación del presente Programa de Estímulo al Pequeño Productor de Granos serán solventados con fondos del Tesoro Nacional, quedando limitados a un monto máximo total de PESOS DOS MIL QUINIENTOS MILLONES ($ 2.500.000.000).
Art. 13. — La presente medida tiene vigencia a partir de su publicación en el Boletín Oficial.
