Mediante la Resolución 615/2015 del Ministerio de Economía y Finanzas Públicas (B.O. 27/7/2015) se dispuso la creación del «Programa de Estímulo al Pequeño Productor de Granos – Fase 2.0», destinado a otorgar compensaciones económicas a aquellos pequeños productores que hubieren obtenido hasta un total acumulado de mil toneladas (1.000 t) de trigo y/o soja y/o maíz y/o girasol en el territorio de nuestro país, en la Campaña 2013/2014.
La norma indica que a fin de arribar a tal cantidad, los cálculos deberán ser efectuados «según la estimación diferencial y el tope de producción previstos en el artículo 2° de la presente resolución.»
Este programa será de aplicación para el período comprendido entre los meses de julio a diciembre de 2015, inclusive, pudiendo ser prorrogado
Los interesados deben encontrarse inscriptos en la nómina de productores de la AFIP, según la Resolución General 2.750. En los casos en que ya estuvieran incluidos como beneficiarios del «Programa de Estímulo al Pequeño Productor de Granos» instituido por la Resolución 126/2015 del Ministerio de Economía y Finanzas Públicas y su modificatoria, serán automáticamente incluidos al «Programa Fase 2.0» a partir del mes de julio de 2015 y empezarán a percibir a partir de dicho mes únicamente los beneficios contemplados por esta resolución.
Parte dispositiva de la norma
EL MINISTRO
DE ECONOMÍA Y FINANZAS PÚBLICAS
RESUELVE:
Artículo 1° — Créase en el ámbito de la SECRETARÍA DE COMERCIO del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS el «Programa de Estímulo al Pequeño Productor de Granos – Fase 2.0» (en adelante «Programa Fase 2.0») destinado a otorgar compensaciones económicas a aquellos pequeños productores que hubieren obtenido hasta un total acumulado de MIL TONELADAS (1.000 t) de trigo y/o soja y/o maíz y/o girasol en el territorio de la REPÚBLICA ARGENTINA, en la Campaña 2013/2014, según la estimación diferencial y el tope de producción previstos en el Artículo 2° de la presente resolución.
Art. 2° — Determínase una estimación diferencial para el cómputo de las toneladas de trigo y/o maíz y/o girasol a fin de definir los estratos del Anexo II de la presente resolución, de la cual resulta que UNA TONELADA (1 t) declarada por los productores equivaldrá a QUINIENTOS KILOGRAMOS (500 kg).
En el caso de la producción de soja, se estimará que UNA TONELADA (1 t) equivale a UNA TONELADA (1 t).
Los beneficiarios del Programa dispuesto por la presente resolución no podrán superar en ningún caso la cantidad de MIL SEISCIENTAS TONELADAS (1.600 t) de producción efectivamente acumuladas y declaradas ante la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS, entidad autárquica actuante en el ámbito del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS, en la Campaña 2013/2014.
Art. 3° — Se tomará como base de cálculo lo producido en forma individual por la persona física o jurídica que solicitare el beneficio, independientemente de la cantidad de establecimientos que explote, sean propios o de terceros.
Art. 4° — Los interesados deberán:
a) Encontrarse inscriptos en la nómina de productores de la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS, según la Resolución General N° 2.750 de fecha 18 de enero de 2010 de ese Organismo Recaudador.
b) Completar la información, conforme el Modelo de Declaración Jurada que como Anexo I forma parte integrante de la presente medida, a través del dominio de internet www.mecon.gob.ar/secretarias/comercio/comercio-interior, antes del 30 de octubre de 2015, con excepción de los casos contemplados en el Artículo 5° de la presente medida.
Art. 5° — Aquellos beneficiarios del «Programa de Estímulo al Pequeño Productor de Granos» instituido por la Resolución N° 126 de fecha 16 de marzo de 2015 del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS y su modificatoria, serán automáticamente incluidos al «Programa Fase 2.0» a partir del mes de julio de 2015 y empezarán a percibir a partir de dicho mes únicamente los beneficios contemplados por esta resolución sin necesidad de efectuar ningún trámite adicional.
Art. 6° — El «Programa Fase 2.0» será de aplicación para el período comprendido entre los meses de julio a diciembre de 2015, inclusive, pudiendo ser prorrogado.
Art. 7° — A los efectos del cálculo de la compensación que corresponda a cada pequeño productor, se determinan SIETE (7) estratos conforme las cantidades producidas de los granos mencionadas en el Artículo 2° y según se consigna en el Anexo II que forma parte integrante de la presente resolución.
Para la determinación de los estratos mencionados, para cada productor, se tomará en cuenta la producción de los cultivos de soja, trigo, maíz y girasol de la Campaña 2013/2014, según la información que se hubiere brindado oportunamente a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS.
Art. 8° — El monto total en Pesos a percibir por cada beneficiario del «Programa Fase 2.0» quedará determinado por la multiplicación de su producción por el monto por tonelada estipulado en el Anexo II de la presente medida, según su clasificación por estrato.
Art. 9° — El monto estipulado en el artículo precedente será pagado mensualmente, de acuerdo al porcentaje de liquidación establecido para cada mes del «Programa Fase 2.0» en el Anexo III, que forma parte integrante de la presente medida. Dicho porcentual podrá disminuirse de acuerdo a lo estipulado en el Artículo 10 de la presente resolución.
Art. 10. — La SECRETARÍA DE COMERCIO efectuará mensualmente una estimación de la liquidación total de divisas esperada de los complejos de soja, trigo, maíz y girasol.
La SECRETARÍA DE COMERCIO contrastará el monto estimado con las sumas efectivamente liquidadas, de acuerdo a la información que produzca el BANCO CENTRAL DE LA REPÚBLICA ARGENTINA.
En el supuesto en que la liquidación efectiva fuera menor a la estimada por la SECRETARÍA DE COMERCIO, el pago mensual a los productores disminuirá en forma proporcional a esa diferencia, sin perjuicio de la compensación prevista por el artículo siguiente.
Art. 11. — Para el caso en que el mecanismo establecido en el Artículo 10 genere pagos acumulados menores al monto correspondiente a cada beneficiario de conformidad con lo dispuesto por el Artículo 8°, se compensará el saldo pendiente en el cálculo del pago correspondiente a diciembre de 2015, hasta arribar al monto total a percibir.
Art. 12. — La SUBSECRETARÍA DE COMERCIO INTERIOR de la SECRETARÍA DE COMERCIO del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS procederá a efectuar los cálculos del beneficio para cada productor de granos en base a la información suministrada por la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS en relación a la Resolución General N° 2.750/10 de ese Organismo Recaudador y a la analizada y cotejada adicionalmente por esa Subsecretaría.
Dicha información contemplará lo declarado por los productores a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS por la Cosecha 2013/2014 hasta el 7 de julio de 2015.
Art. 13. — El suministro de información por parte del interesado queda sujeto al posterior control por parte de la SUBSECRETARÍA DE COMERCIO INTERIOR.
Una vez cumplimentado correctamente el suministro de información, se emitirá una constancia electrónica.
Cualquier dato proporcionado que sufriera cambios, deberá ser actualizado por la misma vía.
Art. 14. — La SUBSECRETARÍA DE COMERCIO INTERIOR analizará y cotejará los datos recibidos, pudiendo requerir documentación o información adicional al MINISTERIO DE AGRICULTURA, GANADERÍA Y PESCA y/o a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS y/o a posibles beneficiarios y/o a otros organismos públicos y privados, a efectos de realizar el cálculo del beneficio correspondiente.
Art. 15. — Para efectuar el cálculo establecido por los Artículos 9° y 10 de la presente resolución, la SECRETARÍA DE COMERCIO, requerirá mensualmente la información pertinente a la SECRETARÍA DE POLÍTICA ECONÓMICA Y PLANIFICACIÓN DEL DESARROLLO del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS y al BANCO CENTRAL DE LA REPÚBLICA ARGENTINA.
Art. 16. — Los pagos a los beneficiarios se realizarán en forma mensual, y a mes vencido, mediante resolución de la SECRETARÍA DE COMERCIO y a través de transferencias bancarias del BANCO DE LA NACIÓN ARGENTINA, entidad autárquica en el ámbito del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS, desde la cuenta del referido Ministerio.
Art. 17. — Aquellos productores que hayan cumplimentado correctamente los requisitos de inscripción establecidos por este Programa a partir del mes de julio y hasta el 30 de octubre de 2015, y sean beneficiarios del mismo, recibirán como primer pago, las compensaciones a percibir desde el mes de julio y hasta el mes inmediato anterior al de su efectiva inscripción.
Los productores que se inscriban a partir del mes de julio y hasta el 30 de octubre de 2015, que asimismo cumplan con los requisitos establecidos en la Resolución N° 126/15 del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS y su modificatoria, recibirán en el primer pago los beneficios acumulados correspondientes a los meses de enero a junio del corriente año en el marco de esa resolución. Posteriormente, los pagos se realizarán en forma mensual, a mes vencido.
Art. 18. — Será medio de notificación suficiente a los beneficiarios del presente Programa la publicación en el Boletín Oficial de la resolución de la SECRETARÍA DE COMERCIO que disponga la aprobación del pago correspondiente a los beneficiarios.
Art. 19. — Facúltase a la SECRETARÍA DE COMERCIO para dictar las normas reglamentarias y a suscribir los convenios que resulten necesarios para la implementación y ejecución del Programa.
Art. 20. — Los gastos que demande la financiación del presente Programa serán solventados con fondos del Programa 28, Partida 5.1.9, Subparcial 2.447, Fuente de Financiamiento 11.
Art. 21. — Déjanse sin efecto los pagos correspondientes a los beneficiarios del Programa instituido por la Resolución N° 126/15 del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS y su modificatoria, para los meses de julio a diciembre de 2015, inclusive, en virtud de la implementación de la presente medida.
Art. 22. — La presente resolución entrará en vigencia a partir de su publicación en el Boletín Oficial.
