Mediante el decreto 87/2017 (B.O. 03/02/2017) se dispuso la creación de la «Plataforma Digital del Sector Público Nacional», integrada por las siguientes herramientas y servicios: a) los Portales de Internet; b) las Aplicaciones Móviles; c) la Guía de Trámites; d) los Servicios de Mensajes de Texto Simples (SMS); e) los Servicios de Atención Telefónica; f) las Oficinas de Atención Presencial; g) el Perfil Digital del Ciudadano y h) los Servicios de Atención Prestados a través de Redes Sociales.
La misma norma crea también el Perfil Digital del Ciudadano “Mi Argentina”, que permitirá acceder a los servicios prestados por el Estado, efectuar trámites, consultar el estado de los mismos, solicitar turnos, etc., el cual funcionará dentro de la Portal Web General (argentina.gob.ar).

Creación.
Ciudad de Buenos Aires, 02/02/2017
VISTO: el Expediente electrónico EX-2016-02381000-APN-SSGD#MM, la Ley de Ministerios (texto ordenado por Decreto Nº 438 del 12 de marzo de 1992) y sus modificatorias, los Decretos Nros. 13 del 5 de enero de 2016, 561 del 6 de abril de 2016 y 1063 de fecha 4 de octubre de 2016, y
CONSIDERANDO:
Que por el Decreto N° 13 de fecha 10 de diciembre de 2015, se modificó la Ley de Ministerios (texto ordenado por Decreto N° 438 del 12 de marzo de 1992) y sus modificatorias, creándose entre otros el MINISTERIO DE MODERNIZACIÓN, estableciendo entre sus competencias, las de diseñar, proponer y coordinar las políticas de transformación y modernización del Estado en las distintas áreas del Gobierno Nacional, su Administración central y descentralizada, y determinar los lineamientos estratégicos y la propuesta de las normas reglamentarias en la materia; de diseñar, coordinar e implementar la incorporación y mejoramiento de los procesos, tecnologías, infraestructura informática y sistemas y tecnologías de gestión de la Administración Pública Nacional; y de proponer diseños en los procedimientos administrativos que propicien su simplificación, transparencia y control social y elaborar los desarrollos informáticos correspondientes.
Que, mediante el dictado del Decreto Nº 13 de fecha 5 de enero de 2016, se aprobó la conformación organizativa del MINISTERIO DE MODERNIZACIÓN, creándose, entre otras, la SUBSECRETARÍA DE GOBIERNO DIGITAL dependiente de la SECRETARIA DE GESTIÓN E INNOVACIÓN PÚBLICA, y estableciendo entre sus objetivos los de entender en el diseño, implementación y monitoreo de la plataforma digital del Sector Público Nacional, a través de sus diferentes canales; de participar en la elaboración de lineamientos y normas que promuevan la homogeneidad y pertinencia de los distintos nombres de los dominios de los sitios de Internet del Sector Público Nacional, en coordinación con las áreas competentes; de coordinar el desarrollo de portales de Internet en el Sector Público, de forma de mejorar el desempeño de las jurisdicciones en el marco de las atribuciones que les han sido asignadas y de facilitar la interrelación de los organismos entre sí y de éstos con las personas, estimulando la realización de trámites en línea; de supervisar el diseño, implementación y monitoreo del Portal Web General y aplicaciones móviles del Gobierno de la República Argentina y de coordinar los proyectos de mejora de servicios al ciudadano en las dependencias de atención al público del Sector Público Nacional.
Que afianzando la política emprendida por este Gobierno, mediante el Decreto Nº 561 de fecha 6 de abril de 2016, se aprobó la implementación del sistema de Gestión Documental Electrónica (GDE) como sistema integrado de caratulación, numeración, seguimiento y registración de movimientos de todas las actuacionesny expedientes del Sector Público Nacional, actuando como plataforma para la implementación de gestión de expedientes electrónicos.
Que, mediante el dictado del Decreto 1063 de fecha 4 de octubre de 2016, se aprobó la implementación de la Plataforma de Trámites a Distancia integrada por el módulo “Trámites a Distancia” (TAD) del Sistema de Gestión Documental Electrónica (GDE), como medio de interacción del ciudadano con la Administración, a través de la recepción y remisión por medios electrónicos de presentaciones, solicitudes, escritos, notificaciones y comunicaciones, entre otros.
Que la mejora de la calidad de atención a las personas que interactúan con el Estado supone simplificar procesos internos, capacitar a quienes vayan a interactuar directa o indirectamente con éstas y ampliar las modalidades de atención incorporando procesos que permitan brindar servicios públicos de calidad, accesibles e inclusivos para todos.
Que, en ese contexto, resulta necesaria la creación de una Plataforma Digital que facilite la interacción entre las personas y el Estado, con el objetivo de unificar la estrategia de servicios y trámites en línea, brindando así la posibilidad de realizar trámites a través de las distintas herramientas y servicios insertos en la plataforma, así como consultar dichos servicios, solicitar turnos y acceder a información mediante diversos canales.
Que dicha Plataforma Digital estará compuesta por los Portales de Internet y las Aplicaciones Móviles; la Guía de Trámites; el Perfil Digital del Ciudadano; los Servicios de Atención Telefónica; las Oficinas Públicas que presten atención presencial, los Servicios de Mensajes de Texto Simples (SMS), y los Servicios de Atención Prestados a través de Redes Sociales.
Que ante la existencia de múltiples sistemas de registración y perfiles de personas, se considera conveniente su integración en el Perfil Digital del Ciudadano para, de este modo, unificar todos aquellos, lo que se traducirá en una mejora en la experiencia de las personas.
Que a los fines de lograr una administración pública ágil, eficiente y al servicio de las personas, resulta necesario incorporar indicadores y métricas de gestión y de calidad de atención, lo que permitirá mejorar dicha atención, simplificar procesos y reducir tiempos de atención.
Que la OFICINA NACIONAL DE TECNOLOGÍAS DE INFORMACIÓN dependiente de la SUBSECRETARIA DE TECNOLOGÍA Y CIBERSEGURIDAD y la SUBSECRETARIA DE GOBIERNO DIGITAL de la SECRETARÍA DE GESTIÓN E INNOVACIÓN PÚBLICA, todas dependientes del MINISTERIO DE MODERNIZACIÓN se han expedido en el ámbito de su competencia.
Que ha tomado la intervención de su competencia la DIRECCIÓN GENERAL DE ASUNTOS JURÍDICOS de la SUBSECRETARÍA DE COORDINACIÓN ADMINISTRATIVA del MINISTERIO DE MODERNIZACIÓN.
Que la presente medida se dicta en ejercicio de las facultades conferidas por el artículo 99, inciso 1 de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE
DE LA NACIÓN ARGENTINA
DECRETA:
ARTÍCULO 1° — Créase la Plataforma Digital del Sector Público Nacional, la cual estará integrada por las siguientes herramientas y servicios que sean utilizados o prestados por los organismos y jurisdicciones alcanzadas por la presente:
a) los Portales de Internet;
b) las Aplicaciones Móviles;
c) la Guía de Trámites;
d) los Servicios de Mensajes de Texto Simples (SMS);
e) los Servicios de Atención Telefónica;
f) las Oficinas de Atención Presencial;
g) el Perfil Digital del Ciudadano y
h) los Servicios de Atención Prestados a través de Redes Sociales.
ARTÍCULO 2° — Créase, dentro del Portal Web General (argentina.gob.ar), el Perfil Digital del Ciudadano “Mi Argentina”, como medio a través del cual las personas podrán acceder a los servicios prestados por el Estado, efectuar trámites, consultar el estado de los mismos, solicitar turnos, acceder a información y definir sus suscripciones.
ARTÍCULO 3º — Los Portales de Internet del Sector Público Nacional que se encuentren actualmente en funcionamiento y aquellos que se desarrollen a partir de la entrada en vigencia de la presente medida, se alojarán en el Portal Web General (argentina.gob.ar).
ARTÍCULO 4º — Las Aplicaciones Móviles existentes y aquellas que se desarrollen a partir de la entrada en vigencia de la presente medida se alojarán en las tiendas oficiales en las plataformas definidas y administradas por la SUBSECRETARÍA DE GOBIERNO DIGITAL dependiente de la SECRETARÍA DE GESTIÓN E INNOVACIÓN PÚBLICA del MINISTERIO DE MODERNIZACIÓN.
ARTÍCULO 5° — Intégrase la Plataforma de Trámites a Distancia (TAD) dentro del Perfil Digital del Ciudadano “Mi Argentina”.
ARTÍCULO 6º — El presente decreto será de aplicación para las entidades y jurisdicciones comprendidas en el artículo 8° de la Ley N° 24.156 de ADMINISTRACION FINANCIERA Y DE LOS SISTEMAS DE CONTROL DEL SECTOR PUBLICO NACIONAL y sus modificaciones, quienes deberán:
a) integrar sus sistemas de perfil de personas con el Perfil Digital del Ciudadano “Mi Argentina”;
b) incorporar las herramientas de métricas y estadísticas definidas por el MINISTERIO DE MODERNIZACIÓN para Plataforma Digital del Sector Público Nacional en los canales de atención digital, telefónico y presencial, en el plazo y condiciones que este establezca, y
c) poner a disposición del MINISTERIO DE MODERNIZACIÓN los accesos a los servicios web y/o API correspondientes a sus sistemas de gestión mediante los cuales se prestan servicios a las personas para integrarlos con la Plataforma Digital del Sector Público Nacional con el objetivo de crear interoperabilidad entre los mismos.
ARTÍCULO 7° — El MINISTERIO DE MODERNIZACIÓN dictará las normas operativas, aclaratorias, y complementarias que resulten necesarias para la implementación de lo establecido en el presente decreto y elaborará planes, protocolos, cronograma de implementación, manuales y estándares, a ser aplicados por los organismos comprendidos en la presente medida.
