La Sala V de la Cámara Nacional de Apelaciones en lo Contencioso Administrativo Federal confirmó la sanción impuesta por el Tribunal de Disciplina del Colegio Público de Abogados de la Capital Federal a un letrado que cobró honorarios sin haber tenido una intervención profesional que lo justifique, y que se negó a restituir la suma abonada en tal concepto ante los reclamos del denunciante.

Buenos Aires, 22 de diciembre de 2016.
VISTO Y CONSIDERANDO:
I.-Que la Sala I del Tribunal de Disciplina del Colegio Público de Abogados de la Capital Federal mediante decisorio de fs. 85/88 impuso al abogado Fabio Alejandro Pompetti (Tº 068 Fº 559) una sanción prevista en el art. 45 inc. c) de la Ley Nº 23.187, consistente en un llamado de atención en tanto entendió que el matriculado vulneró la disposición contemplada en el art. 19 inc. a) de la Ley Nº 23.187.-
II.-Que como surge de las constancias de autos, estas actuaciones se iniciaron a raíz de la denuncia efectuada por la actuación del matriculado en sendos expedientes de divorcio, ejecución y alimentos, en los que fue acusado de haber cobrado honorarios sin haber existido intervención profesional que lo justifique y de no haber tenido la voluntad de restituir la suma abonada, ante los reclamos de la denunciante.-
III.-Que contra lo resuelto por el Tribunal de Disciplina, la defensora del Dr. Fabio Alejandro Pompetti interpuso recurso de apelación a fs. 114/121, el que fue contestado por la representante del CPACF a fs. 134/138.
IV.-Que, como punto de partida, es dable señalar que las sanciones impuestas por el Tribunal de Disciplina del Colegio de Abogados de la Capital Federal remiten a la definición como injustos de faltas puramente deontológicas. Esto es, de infracciones éticas más que jurídicas, propiamente dichas, en cuyo diseño juegan enunciados generales e inespecíficos, que si bien resultarían admisibles en un sistema punitivo abstracto fundado en una situación de supremacía general, caben perfectamente bajo una relación de supremacía especial, como expresión tanto de la disciplina interna de la organización, como por la cercanía moral de los titulares del órgano sancionador, pares del inculpado; interpretando un sistema ético que los envuelve a ambos.
Por consiguiente, la subsunción del supuesto fáctico concreto dentro de la fórmula de la infracción deontológica profesional es como principio resorte primario de quien está llamado -porque así lo ha querido la ley- a valorar los comportamientos que precisamente pueden dar lugar a la configuración de aquellas infracciones, limitándose la revisión judicial a las hipótesis en las que ha mediado indefensión o la decisión resulte manifiestamente arbitraria. (conf. Sala I, in re: “Vitolo, Daniel, sentencia del 1-2-93; Sala V, in re: Álvarez, Teodora, sentencia del 16-8-95, Causa 50.161/95, sentencia del 2-4-96).-
V.-Que en su presentación, el recurrente no logra desvirtuar los argumentos tenidos en cuenta por el Tribunal de Disciplina, pues de las pruebas agregadas en estas actuaciones se encuentra suficientemente probada la percepción por parte del Dr. Fabio Alejandro Pompetti de la suma cuya devolución la denunciante reclama, que ese cobro no encontró reflejo en actuación alguna del referido matriculado que justificara la percepción de honorarios y que la conducta del matriculado “seguramente convenció a la cliente que el abogado finalizaría con los trámites de divorcio, cuestión esta que nunca ocurrió” (ver fs. 88 del decisorio recurrido).-
Por todo lo expuesto, corresponde desestimar el recurso interpuesto por la defensora del Dr. Fabio Alejandro Pompetti y confirmar en un todo el decisorio recurrido, con costas al recurrente (conf. art. 68 del C.P.C.C.N.).
Teniendo en cuenta la naturaleza y el monto del proceso, el resultado obtenido y la extensión, calidad y eficacia del trabajo profesional cumplido por la Dra. Karina Melano, corresponde fijar sus honorarios profesionales en la suma de $ 700 (pesos setecientos), de acuerdo a lo establecido en los arts. 6, 7, 9, 37 y 38 de la Ley N° 21.839, modificada por la Ley N° 24.432.
Se aclara que dicho importe no incluye suma alguna en concepto de impuesto al valor agregado, el cual deberá adicionarse en caso de que el profesional acredite su condición de responsable inscripto.
Todo lo cual, ASÍ SE DECIDE.-
