TESTIMONIO En la ciudad de Buenos Aires, a los 31 días del mes de marzo del año dos mil quince, se reúne el Jurado de Enjuiciamiento de Magistrados de la Nación, integrado por los señores jueces de cámara Mario Gabriel Reynaldi —en su carácter de Presidente— y Beatriz Inés Fontana, los señores senadores nacionales Rodolfo Julio Urtubey y Oscar Aníbal Castillo, el señor diputado nacional Diego Matías Mestre y la señora representante de los abogados de la matrícula federal, doctora Cristina María Peleteiro, a los efectos de dictar el fallo definitivo en este expediente N° 32 caratulado “Doctor Axel Gustavo López s/ pedido de enjuiciamiento”. Intervienen en el proceso, por la Acusación, los señores representantes del Consejo de la Magistratura del Poder Judicial de la Nación doctores Jorge Daniel Candis y Gustavo Adolfo Valdés, y por la defensa del magistrado enjuiciado, los señores defensores particulares doctores Eugenio Raúl Zaffaroni, Adrián Daniel Albor y Federico Andrés Paruolo, y la señora defensora pública oficial designada en los términos del artículo 17 del Reglamento Procesal, doctora Nelly Amanda Allende.

I) RECHAZAR las cuestiones preliminares planteadas por la defensa del doctor Axel Gustavo López.
II) NO HACER LUGAR a la remoción del doctor Axel Gustavo López requerida por el Consejo de la Magistratura en orden a la causal constitucional de mal desempeño por no haberse reunido la mayoría de cinco (5) votos establecida por los artículos 24 de la ley 24.937 (t.o. ley 26.080) y 35 del Reglamento Procesal del Jurado.
III) COMUNICAR la presente resolución a la Corte Suprema de Justicia de la Nación, al Consejo de la Magistratura, al Ministerio de Justicia y Derechos Humanos de la Nación, a la Cámara Nacional de Casación Penal y a la Administración General del Poder Judicial de la Nación, a sus efectos.
IV) ORDENAR la publicación de la parte dispositiva del presente fallo en el Boletín Oficial (artículo 36 del Reglamento Procesal).
