Según se desprende de los considerandos de la norma en comentario, la medida es una respuesta del contexto actual que hace «…conveniente y urgente adoptar nuevas medidas que, por un lado, permitan mitigar el impacto del incremento del consumo registrado a partir del mes de abril del corriente año en el marco de los nuevos precios y tarifas vigentes y, por otro lado, posibiliten mantener el camino iniciado en dirección a la normalización de precios y tarifas, en un marco que aliente las inversiones necesarias para obtener el gas natural que requieren los usuarios del país, a la vez que brinde protección para que los usuarios de menores recursos económicos puedan continuar accediendo al servicio a través de la Tarifa Social.» Ello así, se indica como adecuado «…fijar un tope de facturación para usuarios residenciales a fin de que el monto total facturado a un usuario residencial, para un determinado período de facturación, por consumos realizados a partir del 1 de abril de 2016, no supere en más de un CUATROCIENTOS POR CIENTO (400%) el monto total facturado al mismo usuario para el mismo período correspondiente al año 2015; es decir, que el monto facturado no supere una suma equivalente a CINCO (5) veces el monto de la factura referida al mismo período del año anterior.» Y «…asimismo, para la usuarios del Servicio General P con servicio completo, el tope de facturación —en los términos señalados en el párrafo anterior— se prevé en un QUINIENTOS POR CIENTO (500%) por encima del monto de la factura correspondiente al mismo período del año anterior, es decir, un monto equivalente a SEIS (6) veces el monto de dicha factura.»

VISTO el Expediente N° S01:0043902/2016 del Registro del MINISTERIO DE ENERGÍA Y MINERÍA, y lo dispuesto por las Leyes Nros. 17.319, 25.561 y sus modificaciones, el Artículo 75 de la Ley N° 25.565 y la Ley N° 26.741; y las Resoluciones del MINISTERIO DE ENERGÍA Y MINERÍA Nros. 28 de fecha 28 de marzo de 2016, 31 de fecha 29 de marzo de 2016 y 99 de fecha 6 de junio de 2016; y
CONSIDERANDO:
Que mediante la Resolución N° 28 de fecha 28 de marzo de 2016 de este Ministerio se establecieron nuevos precios de gas en el Punto de Ingreso al Sistema de Transporte (PIST) y del Gas Propano indiluido para redes, con vigencia a partir del 1 de abril de 2016; y se instruyó al ENTE NACIONAL REGULADOR DEL GAS (ENARGAS) para que, en el marco de su competencia, realizara los procedimientos correspondientes a efectos de dar cumplimiento a lo establecido en el numeral 9.4.2 de las Reglas Básicas de la Licencia de Distribución.
Que ello formó parte de una serie de medidas que tienen por objeto incentivar las inversiones necesarias para incrementar las reservas de gas y los niveles de producción local, en orden a cubrir la demanda de los usuarios de gas de todo el país, sin desatender en ese proceso la situación de los usuarios de menores recursos, para los que se creó un régimen de Tarifa Social, con importantes beneficios para sus destinatarios.
Que frente al pronunciado retraso en los precios de gas en el PIST que integraban las tarifas del servicio de distribución de gas natural, en determinados casos, la aplicación de lo dispuesto en la mencionada Resolución N° 28/2016 produjo incrementos significativos del monto de las facturas de los servicios a usuarios residenciales y del servicio General para Pequeños Consumos, particularmente en aquellas jurisdicciones donde el precio del gas era inferior al del resto del país en razón de diversas medidas judiciales que incidían en la aplicación de la normativa general, lo que motivó el dictado de la Resolución N° 99 de fecha 6 de junio de 2016 de este Ministerio.
Que mediante dicha Resolución N° 99/2016, se instruyó al ENARGAS para que las facturas que emitieran las prestadoras del servicio público de distribución de gas por consumos realizados a partir del 1 de abril de 2016, no superaran en más de un 400% en el caso de usuarios residenciales y 500% en el caso de usuarios del Servicio General P al monto final que, para dichos consumos, hubiere correspondido facturar de aplicarse al mismo usuario y para el volumen consumido en el nuevo período de facturación, las tarifas vigentes al 31 de marzo de 2016.
Que sin embargo, el significativo incremento del consumo de gas vinculado a las condiciones climáticas registradas en determinadas regiones del país, especialmente a las temperaturas considerablemente inferiores durante los meses de abril y mayo de 2016 respecto de las verificadas en los mismos meses del año anterior —sumado al hecho de que, por las condiciones de temperatura en dicho período de 2015, que favorecieron la disminución del consumo respecto de 2014, las tarifas de numerosos usuarios se habían visto reducidas debido a la aplicación de descuentos por ahorro establecidos por la Resolución de la ex SECRETARÍA DE ENERGÍA N° 226 del 31 de marzo de 2014— provocó que, aún con la aplicación de los topes de facturación establecidos en la Resolución N° 99/2016, se registraran facturas a usuarios por montos totales significativamente superiores a los del mismo período del año anterior.
Que en el contexto descripto se plantearon numerosas acciones judiciales contra las resoluciones que dispusieron los incrementos de precios y tarifas referidos al servicio de gas, con resultados dispares en distintas instancias y ámbitos territoriales, circunstancia que ha afectado el grado de certidumbre y claridad que deben tener los usuarios de todo el país con relación al servicio público que reciben.
Que por otra parte, las decisiones judiciales que se pronunciaron en contra de la aplicación o validez de tales resoluciones, han afectado también la aplicabilidad del régimen de Tarifa Social creado por medio de ellas y a través del cual este Ministerio buscó centrar especialmente en los sectores más vulnerables de la comunidad los subsidios que el Estado Nacional viene destinando a este servicio mediante el aporte de todos los contribuyentes, régimen que posibilitó cubrir las necesidades de aproximadamente 1.550.000 hogares, lo que equivale a cerca del 20% de la totalidad de hogares que tienen acceso a la red de gas natural.
Que frente a esa situación, se considera conveniente y urgente adoptar nuevas medidas que, por un lado, permitan mitigar el impacto del incremento del consumo registrado a partir del mes de abril del corriente año en el marco de los nuevos precios y tarifas vigentes y, por otro lado, posibiliten mantener el camino iniciado en dirección a la normalización de precios y tarifas, en un marco que aliente las inversiones necesarias para obtener el gas natural que requieren los usuarios del país, a la vez que brinde protección para que los usuarios de menores recursos económicos puedan continuar accediendo al servicio a través de la Tarifa Social.
Que en tal sentido, se estima adecuado fijar un tope de facturación para usuarios residenciales a fin de que el monto total facturado a un usuario residencial, para un determinado período de facturación, por consumos realizados a partir del 1 de abril de 2016, no supere en más de un CUATROCIENTOS POR CIENTO (400%) el monto total facturado al mismo usuario para el mismo período correspondiente al año 2015; es decir, que el monto facturado no supere una suma equivalente a CINCO (5) veces el monto de la factura referida al mismo período del año anterior.
Que asimismo, para la usuarios del Servicio General P con servicio completo, el tope de facturación —en los términos señalados en el párrafo anterior— se prevé en un QUINIENTOS POR CIENTO (500%) por encima del monto de la factura correspondiente al mismo período del año anterior, es decir, un monto equivalente a SEIS (6) veces el monto de dicha factura.
Que por otro lado, en cumplimiento de lo establecido por el Decreto N° 367 de fecha 16 de febrero de 2016, mediante la Resolución N° 31 de fecha 29 de marzo de 2016 de este Ministerio, se instruyó al ENTE NACIONAL REGULADOR DEL GAS (ENARGAS), a que lleve adelante el procedimiento de Revisión Tarifaria Integral previsto en las Actas Acuerdo de Renegociación Contractual Integral celebradas con las Licenciatarias en el marco de lo dispuesto en la Ley N° 25.561, sus modificaciones y complementarias, estableciéndose a esos efectos un plazo de UN (1) año desde la fecha de dicha medida y ordenándose instrumentar en ese marco el mecanismo de audiencia pública que posibilite la participación ciudadana, en los términos de lo establecido en el Artículo 5° del referido Decreto N° 367/2016.
Que en el ámbito concerniente a los segmentos de transporte y distribución de gas natural, y dentro del contexto reseñado más arriba, se estima conveniente establecer que la ejecución de las acciones previstas para el desarrollo de la Revisión Tarifaria Integral se completen dentro del último trimestre del corriente año, incluyendo la realización —antes de la finalización del mes de octubre de 2016— de la audiencia pública prevista en el referido decreto como oportunidad de participación ciudadana dentro del marco de dicha revisión integral, más allá de las instancias de participación que tuvieron lugar en el proceso de renegociación contractual, que dio lugar a las adecuaciones transitorias establecidas a partir de la Resolución N° 31/2016.
Que la DIRECCIÓN GENERAL DE ASUNTOS JURÍDICOS del MINISTERIO DE ENERGÍA Y MINERÍA ha tomado la intervención que le compete.
Que la presente medida se dicta en uso de las facultades conferidas por la Ley N° 17.319 y conforme a lo dispuesto en el Artículo 23 nonies de la Ley de Ministerios (Texto Ordenado por Decreto N° 438 de fecha 12 de marzo de 1992) y sus modificaciones.
Por ello,
EL MINISTRO

RESUELVE:
ARTÍCULO 1° — Sustitúyese el Artículo 1° de la Resolución N° 99 de fecha 6 de junio de 2016 de este Ministerio, por el siguiente:
“Instrúyese al ENARGAS a que, en el ejercicio de sus facultades, disponga las medidas necesarias a fin de que, durante el año 2016, el monto total, impuestos incluidos, de las facturas que emitan las prestadoras del servicio público de distribución de gas por redes de todo el país, que los usuarios residenciales (categoría R y sus subcategorías) deban abonar por consumos realizados a partir del 1 de abril de 2016, no superen en más de un CUATROCIENTOS POR CIENTO (400%) el monto total, impuestos incluidos, de la factura emitida al mismo usuario con relación al mismo período de facturación correspondiente al año anterior; es decir, que el monto facturado no supere una suma equivalente a CINCO (5) veces el monto total de la factura emitida al mismo usuario con relación al mismo período de facturación correspondiente al año anterior.”
ARTÍCULO 2° — Sustitúyese el Artículo 2° de la Resolución N° 99 de fecha 6 de junio de 2016 de este Ministerio, por el siguiente:
“Instrúyese al ENARGAS a que, en el ejercicio de sus facultades, disponga las medidas necesarias a fin de que, durante el año 2016, el monto total, impuestos incluidos, de las facturas que emitan las prestadoras del servicio público de distribución de gas por redes de todo el país, que los usuarios de la categoría Servicio General P con servicio completo (subcategorías P1, P2 y P3, y equivalentes en el servicio de distribución de propano indiluido por redes; y que incluyan el costo de adquisición de gas natural) deban abonar por consumos realizados a partir del 1 de abril de 2016, no superen en más de un QUINIENTOS POR CIENTO (500%) el monto total, impuestos incluidos, de la factura emitida al mismo usuario con relación al mismo período de facturación correspondiente al año anterior; es decir, que el monto facturado no supere una suma equivalente a SEIS (6) veces el monto total de la factura emitida al mismo usuario con relación al mismo período de facturación correspondiente al año anterior.”
ARTÍCULO 3° — Instrúyese al ENARGAS a adoptar las medidas necesarias a los efectos de concluir antes del 31 de diciembre de 2016 el proceso de Revisión Tarifaria Integral al que se refiere el Artículo 1° de la Resolución N° 31 de fecha 29 de marzo de 2016; a cuyo fin deberá realizarse la audiencia pública allí prevista antes del 31 de octubre de 2016.
