Los montos, sin impuestos, de las facturas a partir del 1 de Abril de 2016, no deberán superar en más de un CUATROCIENTOS POR CIENTO (400%) al monto final, sin impuestos, que para dichos consumos hubiere correspondido facturar de aplicarse, al mismo usuario y para el volumen consumido en el nuevo período de facturación las tarifas vigentes al 31 de marzo de 2016.
Respecto a los usuarios de la categoría Servicio General P con servicio completo (subcategorías P1 P2 y P3, y equivalentes en el servicio de distribución de propano indiluido por redes; y que incluyan el costo de adquisición de gas natural) no deberán superar en más de un QUINIENTOS POR CIENTO (500%).
Las diferencias que resulten, deberán ser aplicadas como descuentos a los usuarios.

VISTO el Expediente N° S01:0043902/2016 del Registro del MINISTERIO DE ENERGÍA Y MINERÍA, y lo dispuesto por las Leyes Nros. 17.319, 25.561 y sus modificaciones, el Artículo 75 de la Ley N° 25.565 y la Ley N° 26.741, la Resolución N° 28 de fecha 28 de marzo de 2016 del MINISTERIO DE ENERGÍA Y MINERÍA y las Resoluciones del ENTE NACIONAL REGULADOR DEL GAS (ENARGAS) Nros. I-3725; I-3726; I-3727; I-3728; I-3729; I-3730; I-3731; I-3732, I-3733, todas del 31 de Marzo de 2016, y I-3737 del 8 de abril de 2016; y
CONSIDERANDO:
Que el Artículo 3° de la Ley N° 17.319 y el Artículo 2° de la Ley N° 26.741 establecen que el PODER EJECUTIVO NACIONAL tiene a su cargo fijar la política nacional respecto a la explotación, industrialización, transporte y comercialización de los hidrocarburos, teniendo como objetivo principal satisfacer las necesidades de hidrocarburos del país con el producido de sus yacimientos, manteniendo reservas que aseguren esa finalidad.
Que mediante la Resolución N° 28 de fecha 28 de marzo de 2016 de este Ministerio se establecieron nuevos precios de gas en el Punto de Ingreso al Sistema de Transporte (PIST) y del Gas Propano indiluido para redes.
Que los nuevos precios establecidos en la Resolución N° 28/2016 tienen por objeto incentivar las inversiones necesarias para incrementar las reservas de gas y los niveles de producción local.
Que en el Artículo 6° del mismo acto, se instruyó al ENTE NACIONAL REGULADOR DEL GAS (ENARGAS) para que, en el marco de su competencia, realizara los procedimientos correspondientes al efecto de dar cumplimiento a lo establecido en el numeral 9.4.2 de las Reglas Básicas de la Licencia de Distribución.
Que como consecuencia del pronunciado retraso en los precios de gas en el PIST que integraban las tarifas por el servicio de distribución de gas natural por redes, en determinados casos, la aplicación de lo dispuesto en la mencionada Resolución N° 28/2016 de este Ministerio, resultó en un incremento significativo del monto de las facturas de los servicios residenciales de provisión de gas por redes y del servicio General para Pequeños Consumos.
Que tales retrasos resultaban más significativos en aquellas jurisdicciones donde el precio del gas era inferior al del resto del país y en las que diversas medidas judiciales incidían en la aplicación de la normativa general.
Que en consecuencia, el Gobierno Nacional en conjunto con los Gobiernos Provinciales evaluaron la situación y acordaron la conveniencia de definir un límite en el incremento del monto final a facturar por las prestatarias de servicios de distribución de gas por redes a usuarios Residenciales y a los usuarios del Servicio General P (SGP), respecto del valor que hubiera correspondido facturar aplicando, al consumo del período actual, el Cuadro Tarifario vigente hasta el 31 de Marzo pasado.
Que resulta conveniente y necesario adoptar las medidas tendientes a mitigar el impacto de la aplicación de los cuadros tarifarios aprobados y, en tal sentido, determinar un límite en el incremento que vaya a afectar al monto final facturado por metro cúbico (m3) de gas suministrado por prestatarias de servicios de distribución de gas por redes a usuarios Residenciales y a los usuarios del servicio General para Pequeños Consumos (SGP) para el año 2016, respecto al que resultaba de aplicar el Cuadro Tarifario vigente hasta el 31 de marzo pasado.
Que dicho límite en el incremento del monto final a abonar por los usuarios supone un aumento del subsidio solventado por el Estado Nacional, que ya beneficia a los usuarios Residenciales y del Servicio General “P”, y que surge de la diferencia entre los precios que esos usuarios pagan por el valor del gas que integra sus tarifas, y el precio final que reciben los proveedores de ese gas natural o propano; todo ello sin perjuicio de los subsidios adicionales a consumos residenciales en la Región Patagónica, la región de La Puna y el Departamento de Malargüe de la Provincia de Mendoza, instituido por las disposiciones del Artículo 75 de la Ley N° 25.565, modificado por el Artículo 84 de la Ley N° 25.725 y el definido como Tarifa Social, dispuesto por la mencionada Resolución N° 28/2016 de este Ministerio.
Que la implementación de este subsidio no afecta las tarifas a percibir por las prestatarias de servicios de distribución, netas del costo de adquisición del gas que distribuyan, ni las tarifas de las prestatarias del servicio de transporte.
Que las diferencias que surjan de la implementación de la presente medida serán aplicadas durante el corriente año 2016 como un descuento sobre los precios a ser facturados por los proveedores de gas natural de las prestatarias del servicio de distribución de gas por redes; el que se aplicará en forma proporcional a todos los proveedores de gas natural en función del volumen de gas suministrado.
Que la SECRETARÍA DE RECURSOS HIDROCARBURÍFEROS de este Ministerio deberá determinar los mecanismos pertinentes para la compensación de los descuentos a realizarse en las facturas de los proveedores de gas.
Que por último, con el objeto de que el esfuerzo fiscal que el Estado Nacional realiza para establecer el subsidio al consumo de gas natural dispuestos en el presente no se vea afectado por eventuales aumentos en los gravámenes que cualquier jurisdicción aplicare al consumo o la facturación de consumos de gas por redes, corresponde disponer que tales incrementos, en caso de producirse, importarán la revisión, para esa jurisdicción, de lo dispuesto en la presente.
Que la DIRECCIÓN GENERAL DE ASUNTOS JURÍDICOS del MINISTERIO DE ENERGÍA Y MINERÍA ha tomado la intervención que le compete.
Que la presente medida se dicta en uso de las facultades conferidas por la Ley N° 17.319 y conforme a lo dispuesto en el Artículo 23 nonies de la Ley de Ministerios (Texto Ordenado por Decreto N° 438 de fecha 12 de marzo de 1992) y sus modificaciones.
Por ello,

Artículo 1° — Instrúyese al ENARGAS para que, en el ejercicio de sus facultades, disponga las medidas necesarias a fin de que, durante el año 2016, los montos, sin impuestos, de las facturas que emitan las prestatarias del servicio público de distribución de gas por redes de todo el país, que los usuarios residenciales (categoría R y sus subcategorías) deban abonar por consumos realizados a partir del 1 de Abril de 2016, no superen en más de un CUATROCIENTOS POR CIENTO (400%) al monto final, sin impuestos, que para dichos consumos hubiere correspondido facturar de aplicarse, al mismo usuario y para el volumen consumido en el nuevo período de facturación, las tarifas vigentes al 31 de marzo de 2016.

Art. 3° — Establécese que las diferencias que surjan entre el monto final resultante de los cuadros tarifarios vigentes y el monto efectivamente facturado en función de lo dispuesto en los artículos anteriores, será aplicado durante el año 2016 como un descuento sobre los precios a ser facturados por los proveedores de gas de las prestatarias del servicio de distribución de gas por redes. Dicho descuento se aplicará en forma proporcional por todos los proveedores de gas natural en función del volumen de gas suministrado a cada Distribuidor.
Art. 4° — Establécese que las diferencias que surjan entre el monto final resultante de los cuadros tarifarios vigentes y el monto efectivamente facturado en función de lo dispuesto en los artículos anteriores con relación al gas suministrado a los Subdistribuidores y por éstos a sus usuarios, con excepción de aquellos que adquieran el gas natural directamente a los productores, será aplicado como descuento sobre las facturas que las Licenciatarias de Distribución emitan para cada Subdistribuidor. Las Licenciatarias de Distribución darán a dicho descuento el tratamiento dispuesto en el artículo anterior.
Art. 5° — Establécese que los eventuales aumentos en los gravámenes que cualquier jurisdicción aplicare al consumo o la facturación de consumos de gas por redes, importará la revisión, para esa jurisdicción, de lo dispuesto en la presente resolución.
Art. 6° — La SECRETARÍA DE RECURSOS HIDROCARBURÍFEROS de este Ministerio determinará los mecanismos pertinentes para la compensación de los descuentos a realizarse en las facturas de los proveedores de gas a los que se refieren los Artículos 3° y 4° de la presente medida, la que será solventada con recursos del Tesoro Nacional.
