Por su parte, la Dra. Conde agregó en su voto la necesidad de un rápido traspaso de la Justicia Nacional ordinaria al ámbito de la Ciudad para evitar problemas de competencia como el que planteó el proceso en cuestión.
El Dr. Casás resaltó que los actores debieron acudir al Poder Judicial ante la necesidad de obtener una definición sobre el vínculo filial de los menores
––distinto de los que surgirían de los “certificados médicos de nacimiento”–– para que ello pudiera quedar reflejado en los asientos del Registro Civil de la Ciudad. Agregó que, cualquiera fuera la solución a adoptar, ella requería la ponderación de los extremos alegados por las partes así como también de las normas del Código Civil y Comercial de la Nación ––por estar en juego vínculos propios del estado de familia–– que regían específicamente la materia (cláusula transitoria tercera y art. 562). Destacó además que dicha normativa, en los términos de su redacción vigente, importó una alteración de la formulación inicialmente concebida en el proyecto de ese Código que contemplaba expresamente la gestación por sustitución, que no alcanzó a tener concreción al tramitar en el Congreso. También señaló que no obstaba a la solución propuesta la circunstancia que no existiera controversia entre los actores y la hermana de la demandante.
El juez Luis Francisco Lozano, en su voto en disidencia, al que adhirió la juez Alicia E. C. Ruiz, hizo lugar al recurso con el argumento de que el asunto controvertido involucra la competencia de una autoridad administrativa local, y señaló que no es un obstáculo para otorgarla el hecho de que la cuestión esté regida por el Código Civil y Comercial de la Nación, toda vez que la interpretación de esa norma incumbe a los jueces locales, sin perjuicio de las causas que la Nación se haya reservado invocando el interés federal.
