Ley N° 1.056
Artículo 1.- El ejercicio profesional de Licenciados en Obstetricia, Licenciados Obstétricos, Obstétricas y Obstétricos en la Provincia de Tierra del Fuego, Antártida e Islas del Atlántico Sur, se regirá por las prescripciones de la presente Ley.
Artículo 2
.- El ejercicio profesional de la Obstetricia, se encuentra respaldado por el título de Licenciado en Obstetricia, Licenciado Obstétrico, Obstétrica y Obstétrico.
Artículo 3.- La inscripción y habilitación para el ejercicio de esta profesión, su control y todo otro tipo de manejo de la matrícula respectiva, se realizará en el Ministerio de Salud, el que lo hará a través de sus dependencias competentes y específicas, mediante la inscripción en los registros respectivos y provisión de un carnet donde conste la habilitación para el ejercicio de la profesión.
Artículo 4.- El ejercicio profesional de la Obstetricia se autorizará a las personas que posean:
a) título de Licenciado en Obstetricia, Licenciado Obstétrico, Obstétrica y Obstétrico, otorgado por universidad nacional, provincial, escuelas nacionales o provinciales, de nivel superior no universitario, que hayan sido habilitadas por el Estado Nacional en las condiciones que se reglamenten;
b) título de Licenciado en Obstetricia, Licenciado Obstétrico, Obstétrica y Obstétrico, otorgado por universidad extranjera y lo hayan revalidado en universidad nacional o habilitado por universidad nacional de acuerdo con tratados internacionales de reciprocidad;
c) acreditación de identidad personal;
d) domicilio real y que constituyan domicilio legal en la Provincia; y e) que no se encuentren inhabilitados por autoridades competentes nacionales, provinciales, municipales o de su país de origen para el ejercicio de esta profesión.
Artículo 5.- Son facultades de los Licenciados en Obstetricia, Licenciados Obstétricos, Obstétricas y Obstétricos:
a) dar consulta obstétrica a la mujer en las etapas preconcepcionales;
b) diagnosticar, monitorear, dar tratamiento, asistencia profesional obstétrica a gestantes, parturientas y puérperas de bajo y mediano riesgo;
c) detectar en la madre o en el niño los signos indicadores de anomalías que precisen la intervención de un médico; referir y derivar según los niveles de atención, tomando las medidas de emergencia en ausencia del médico;
d) prescribir fármacos de su competencia;
e) indicar e interpretar los exámenes auxiliares de diagnóstico;
f) realizar detección precoz de cáncer cérvico uterino y mamario y referir al nivel correspondiente;
g) fomentar la lactancia materna con el fin de colaborar con el equilibrio del binomio madre-hijo;
h) realizar y coordinar los cursos de psicoprofilaxis obstétrica;
i) asesorar sobre métodos de planificación familiar;
j) dar consulta;
k) brindar consejos sobre medidas preventivo asistenciales de salud reproductiva, l) referir casos de problemas de salud no obstétrico a los profesionales competentes;
ll) dar consejería a escolares y adolescentes;
m) participar en el campo de la medicina legal, efectuando peritajes dentro de su competencia;
n) extender certificados de gestación, atención, descanso pre y posnatal, nacimiento y otros;
ñ) asumir responsabilidad legal profesional;
o) en la función administrativa podrá planificar, programar, coordinar, organizar, dirigir, supervisar, evaluar, monitorear, asesorar las actividades de atención materno-infantil, sexual y reproductiva;
p) planificar, programar, organizar y ejecutar actividades docentes; y q) diseñar, elaborar, ejecutar y evaluar proyectos de investigación.
Artículo 6.- El profesional Licenciado en Obstetricia, Licenciado Obstétrico, Obstétrica y Obstétrico está obligado a:
a) ejercer su labor dentro de los límites de incumbencia de su profesión, debiendo tomar los recaudos a su alcance para el permanente control de su ejercicio profesional;
b) cumplir con las leyes, reglamentos y toda norma que se dicte por autoridad competente respecto a la profesión;
c) proceder en todo momento de conformidad con las reglas éticas que regulan la profesión;
d) prestar la colaboración requerida por autoridad sanitaria en caso de emergencia;
e) guardar secreto profesional salvo, en las excepciones que fijan las leyes pertinentes;
f) informar al paciente -y/o a su responsable-
de las características y posibles riesgos y beneficios de cualquier método a utilizar o práctica a realizar;
g) respetar la voluntad del pacienteen cuanto sea negativa a la realización de cualquier procedimiento propuesto y/o indicado;
h) certificar y extender informes, debiendo constar en los mismos nombre completo, profesión, número de matrícula, fecha y la firma del profesional;
i) dar cumplimiento a las normas de registro, información, denuncia o notificación de tipo estadístico y/o epidemiológico que el organismo competente de la salud pública fueguina lo disponga para los profesionales que ejerzan en la Provincia; y
j) controlar y supervisar el correcto cumplimiento de las indicaciones dadas al personal técnico y/o auxiliar bajo sus directivas, así como su actuación dentro de los estrictos límites de su habilitación e incumbencia; siendo solidariamente responsable por los mismos, si por insuficiente o deficiente control sobre ello resultare daño a quien se asiste.
Artículo 7.- Queda prohibido a los Licenciados en Obstetricia, Licenciados Obstétricos, Obstétricas y Obstétricos:
a) anunciar o prometer métodos diagnósticos o de preparación y atención de la embarazada o el parto, infalibles o secretos;
b) interrumpir la gestación por cualquier razón, provocando el aborto o inducir el parto del feto no viable;
c) aplicar a la práctica profesional, en ámbito privado o público, métodos de utilidad no reconocida por instituciones científicas o académicas relevantes;
d) anunciar una especialidad no reconocida en los términos de la legislación provincial vigente al respecto;
e) percibir remuneraciones por prestaciones o prácticas que no haya realizado o en las que no haya participado, así como registrarlas en cualquier tipo de documentación y emitir certificaciones e informes al respecto;
f) participar sus honorarios a otros profesionales de la salud;
g) percibir bonificaciones, beneficios o participación de honorarios de otros profesionales, laboratorios, empresas de servicios o que elaboren, fraccionen o comercialicen insumos de laboratorio, fármacos, cosméticos, productos dietéticos o cualquier otro elemento utilizado en la prevención, el diagnóstico y el tratamiento de enfermedades o la prevención de la salud;
h) utilizar en los informes signos, abreviaturas o claves que no sean reconocidos como de su uso habitual y aceptados por autoridad académica competente;
i) ejercer la profesión padeciendo enfermedades físicas o disturbios psíquicos o emocionales que pongan en riesgo la salud y la seguridad de los pacientes;
j) ejercer la profesión en locales, consultorios o instituciones asistenciales o de investigación no habilitadas en los términos impuestos por la legislación vigente, a excepción de la atención brindada en el domicilio de los pacientes; y k) delegar en personal auxiliar o técnico facultades, funciones o atribuciones inherentes o privativas de su profesión.
Artículo 8.- La autoridad de aplicación de la presente ley será ejercida por el Ministerio de Salud de la Provincia.
Artículo 9.- El Poder Ejecutivo reglamentará la presente dentro de los sesenta (60) días de su promulgación.
Artículo 10.- Derógase toda otra norma legal reglamentaria o dispositiva que se oponga a la presente ley.
Artículo 11.- Comuníquese al Poder Ejecutivo.
