Entre ellas, se creó el Instituto Nacional de las Artes Gráficas —INAG—, en el ámbito del Ministerio de Cultura de la Nación y el Registro Único de Artistas Gráficos, Agrupaciones y Asociaciones Afines.
El Senado y Cámara de Diputados de la Nación Argentina
reunidos en Congreso, etc. sancionan con fuerza de Ley:
ARTÍCULO 1° — Objeto. Esta ley tiene por objeto el fomento, la promoción, la protección y la difusión de las artes gráficas nacionales.
ARTÍCULO 2° — Definición. A los efectos de la presente ley, se entiende por artes gráficas la ejecución artística en las siguientes disciplinas: a) La ilustración; b) El dibujo humorístico y caricatura; c) La historieta humorística y dramática; d) El arte tipográfico.
ARTÍCULO 3° — Creación. Créase el Instituto Nacional de las Artes Gráficas —INAG—, en el ámbito del Ministerio de Cultura de la Nación.
ARTÍCULO 4° — Funciones. El Instituto Nacional de las Artes Gráficas, como organismo rector del fomento, promoción, preservación, archivo y difusión de las artes gráficas argentinas, tiene las siguientes funciones: a) Promover, fomentar y estimular el desarrollo de las artes gráficas en todo el territorio de la República Argentina, a través de las distintas herramientas que se disponen en la presente ley; b) Promover la edición de libros, revistas y publicaciones que sean impulsados por artistas gráficos, en formato papel y en soporte digital; c) Propiciar la preservación del patrimonio histórico generado por los artistas gráficos; d) Custodiar, exhibir y entender en la adquisición de obras originales y colecciones significativas del patrimonio gráfico nacional; e) Preservar donaciones de obras y colecciones de particulares, instituciones públicas o privadas; f) Llevar a cabo exposiciones permanentes, especiales e itinerantes de artistas gráficos argentinos o extranjeros; g) Estimular la enseñanza y contribuir a la capacitación y perfeccionamiento de los artistas gráficos en todas sus expresiones y especialidades; h) Generar planes de estudios y proyectos de investigación sobre las artes gráficas en general y nacionales en particular, por sí o a través de convenios con instituciones de reconocida trayectoria; i) Celebrar convenios y acuerdos que resulten conducentes para el cumplimiento de los objetivos de la presente ley.
ARTÍCULO 5° — Estructura funcional. El Instituto Nacional de las Artes Gráficas es conducido por un director, en colaboración con un Consejo Asesor, que se rigen por las disposiciones de la presente ley, y demás normas que le sean aplicables conforme a su objeto y funciones.
ARTÍCULO 6° — Director. El candidato a director debe acreditar idoneidad y antecedentes profesionales en las artes gráficas y en la gestión cultural, y es designado y removido por el Poder Ejecutivo nacional. Dura en su cargo por el término de cuatro (4) años, pudiendo ser designado por un (1) nuevo período. Durante el ejercicio de su mandato, no puede ocupar otros cargos en el Estado nacional, provincial o municipal, y tampoco en entidades representativas de artistas gráficos o vinculadas a ellos.
ARTÍCULO 7° — Funciones. El Director del Instituto Nacional de las Artes Gráficas tendrá las siguientes funciones: a) Elaborar un Plan Anual de Acción y Presupuesto General del Instituto Nacional de las Artes Gráficas, conjuntamente con el Consejo Asesor; b) Gestionar, percibir y administrar el presupuesto y los ingresos que pudiera obtener por todo concepto, así como administrar los bienes del instituto; c) Ejecutar las medidas de fomento tendientes a desarrollar la actividad de los artistas gráficos, en sus aspectos culturales, artísticos, técnicos, industriales y comerciales, pudiendo a tal efecto auspiciar concursos, establecer premios, adjudicar becas de estudio e investigación y todas aquellas acciones conducentes para alcanzar su cometido; d) Promover la conformación de un archivo y centro de documentación, con el objeto de resguardar y dar a conocer el patrimonio que conforman las diferentes artes gráficas del país e integrar la información con otros archivos y centros de documentación similares, de la Argentina y del exterior; e) Promover la difusión y exhibición de las obras de los artistas gráficos nacionales en el exterior; f) Administrar y actualizar el Registro Único de Artistas Gráficos, Agrupaciones, y Asociaciones Afines, que se crea por el artículo 10 de la presente ley; g) Asesorar a otros organismos del Estado en asuntos en que se encuentre involucrada la actividad de las artes gráficas; h) Elaborar un informe anual sobre las acciones implementadas para lograr la ejecución de los objetivos dispuestos en la presente ley, presentarlo ante el Consejo Asesor y elevarlo al Ministerio de Cultura de la Nación.
ARTÍCULO 8° — Consejo Asesor. El Consejo Asesor es presidido por el director del Instituto Nacional de las Artes Gráficas, y se integra con cinco (5) vocales designados por el Poder Ejecutivo nacional, quienes duran en sus cargos por el plazo de dos (2) años, renovable por igual término. A saber: Un (1) representante del Ministerio de Cultura de la Nación. Un (1) representante del Consejo Federal de Cultura. Dos (2) miembros a propuesta del conjunto de las entidades representativas de los artistas gráficos o de las que tengan la mayor cantidad de asociados. Un (1) miembro de acreditada trayectoria en el área de investigación de las artes gráficas. Los miembros del Consejo Asesor ejercen sus funciones ad honorem y los gastos que demande su función serán financiados por el Instituto Nacional de las Artes Gráficas.
ARTÍCULO 9° — Funciones. El Consejo Asesor tiene las siguientes funciones: a) Colaborar con el director del Instituto Nacional de las Artes Gráficas en el diseño e implementación del plan anual de acción y el presupuesto general del instituto; b) Asesorar al director del Instituto Nacional de las Artes Gráficas en todas las acciones tendientes al cumplimiento de los objetivos de la presente ley; c) Proponer al director del Instituto Nacional de las Artes Gráficas la realización de actividades, homenajes, exposiciones, y otras acciones que estimen conducentes; d) Analizar el informe de gestión anual elaborado por el director del Instituto Nacional de las Artes Gráficas y hacer las observaciones que estime conducentes.
ARTÍCULO 10. — Registro Único de Artistas Gráficos, Agrupaciones y Asociaciones Afines. Créase el Registro Único de Artistas Gráficos, Agrupaciones y Asociaciones Afines, en el ámbito del Instituto Nacional de las Artes Gráficas, en el cual deberán ser inscriptos los artistas gráficos, las agrupaciones y asociaciones afines, a los efectos de garantizar su participación plena en las distintas actividades que se desarrollen en su ámbito. La inscripción en el registro de los artistas gráficos se efectuará por medio de una declaración jurada sobre su condición de tal, sin otra exigencia. Las agrupaciones y asociaciones afines podrán inscribirse acreditando su personería jurídica y cumpliendo los demás requisitos que determine la reglamentación.
ARTÍCULO 11. — Presupuesto. El presupuesto del Instituto Nacional de las Artes Gráficas estará constituido por los fondos que en forma anual se determinen en el Presupuesto Nacional.
ARTÍCULO 12. — Participación en los medios de comunicación. Los medios audiovisuales que compongan Radio y Televisión Argentina Sociedad del Estado deberán emitir y difundir las actividades, las agendas de exposiciones y cualquier otra actividad que lleve a cabo el Instituto Nacional de las Artes Gráficas, entendiéndose que los mencionados contenidos son de interés público.
ARTÍCULO 13. — Reglamentación. La presente ley deberá ser reglamentada por el Poder Ejecutivo nacional, en el plazo de noventa (90) días contados a partir de su promulgación.
ARTÍCULO 14. — Comuníquese al Poder Ejecutivo nacional.
