El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de Ley,
ARTICULO 1° — Apruébase el Aumento de los Recursos de Capital del Fondo Financiero para el Desarrollo de la Cuenca del Plata (FONPLATA), de conformidad con la ‘Resolución A.G. 138/2013’ de la Asamblea de Gobernadores del mencionado Fondo, que en copia autenticada forma parte integrante de la presente ley como Anexo I.
ARTICULO 2° — Apruébanse las modificaciones al Convenio Constitutivo del Fondo Financiero para el Desarrollo de la Cuenca del Plata, contenidas en la ‘Resolución A.G. N° 137/2013’, cuya copia autenticada forma parte integrante de la presente ley como Anexo II. En virtud de tales reformas se modifican los artículos 15, 17, 19, 20, 29, 30, 31 y 37 del mencionado Convenio.
ARTICULO 3° — Apruébase el aporte citado en el artículo 1° de la presente ley, de acuerdo a lo establecido en el artículo 3° de la ‘Resolución A.G. N° 138/2013’, el cual estará representado por un total de dólares estadounidenses trescientos ochenta y tres millones trescientos cuarenta y seis mil quinientos (U$S 383.346.500), de los cuales dólares estadounidenses ciento dieciséis millones seiscientos sesenta y seis mil quinientos (U$S 116.666.500) corresponden al capital integrado pagadero en efectivo; y dólares estadounidenses doscientos sesenta y seis millones seiscientos ochenta mil (U$S 266.680.000) corresponden al capital exigible. Los montos de los aportes a que se refiere el artículo 1° que deberá realizar la República Argentina durante el período 2014-2018 serán realizados en cuotas anuales e iguales, distribuidos de la siguiente forma: dólares estadounidenses veintitrés millones trescientos treinta y tres mil trescientos (U$S 23.333.300) de capital integrado pagadero en efectivo; y dólares estadounidenses cincuenta y tres millones trescientos treinta y seis mil (U$S 53.336.000) de capital exigible; conforme a lo establecido en el artículo 3° de la ‘Resolución A.G. N° 138/2013’.
ARTICULO 4° — Apruébase que, de acuerdo a lo normado por el artículo 4° de la ‘Resolución A.G. N° 138/2013’, la República Argentina podrá optar por realizar en su moneda nacional los aportes de capital integrado pagadero en efectivo hasta un máximo del diez por ciento (10%) del capital a ser suscripto. Los aportes efectuados en moneda nacional, estarán sujetos a acuerdos celebrados con FONPLATA para el mantenimiento de valor de esa moneda respecto a su equivalencia en dólares estadounidenses, al tipo de cambio oficial al momento en que dicho aporte se haga efectivo.
ARTICULO 5° — Autorízase al Banco Central de la República Argentina a efectuar, en nombre y por cuenta de la República Argentina los aportes establecidos por la presente ley.
ARTICULO 6° — A fin de hacer frente a los compromisos emergentes de la presente ley, el Banco Central de la República Argentina deberá contar con los correspondientes aportes de contrapartida que serán proporcionados por la Secretaría de Hacienda del Ministerio de Economía y Finanzas Públicas, previa inclusión de dicha erogación en la Ley de Presupuesto General de la Administración Nacional para los ejercicios pertinentes.
ARTICULO 7° — Comuníquese al Poder Ejecutivo nacional.
