Mediante la ley provincial N° 8.893, publicada en el Boletín Oficial del 06/09/2016, se creó en la Provincia de Mendoza el Régimen de Cuidadores Polivalentes, es decir de aquellos cuidadores capacitados para la atención de adultos mayores, personas con discapacidad, con patologías crónicas o enfermedades invalidantes, con dependencia directa del mismo, de un familiar o persona a cargo. Los cuidadores incluidos podrán desempeñarse en establecimientos asistenciales, residencias de larga estadía para adultos mayores, geriátricos privados o en domicilios particulares.

Ley N° 8.893
Artículo 1
.- Ámbito. Establécese en el territorio de la Provincia de Mendoza, el Régimen de Cuidadores Polivalentes que se desempeñen en establecimientos asistenciales, residencias de larga estadía para adultos mayores, geriátricos privados o en domicilios particulares.
Artículo 2.- Definición. Definese como Cuidador Polivalente a quien preste el servicio de atención de adultos mayores, personas con discapacidad, con patologías crónicas o enfermedades invalidantes, con dependencia directa del mismo, de un familiar o persona a cargo.
Artículo 3.- Actividades de la Vida Diaria. A los efectos de la presente ley se entenderán como actividades de la vida diaria, aquellas indispensables para llevar una vida digna y en las cuales la persona con dependencia requiere asistencia permanente, tales como bañarse, preparar alimentos, alimentarse, vestirse, trasladarse, acceder a los servicios de salud o hacer las necesidades fisiológicas, así como actividades instrumentales como desplazamiento y ayuda para realizar trámites tendientes a satisfacer las necesidades básicas.
Artículo 4.- Funciones. Constituyen parte de las funciones esenciales del cuidador, las siguientes:
a) Apoyar a los profesionales que atiendan la salud del paciente/
asistido respetando las indicaciones que aquellos determinen.
b) Brindar compañía, aplicando técnicas para evitar la dependencia, procurando facilitar las acciones de la vida diaria de las personas con discapacidad.
c) Ejecutar las medidas higiénicas, dietéticas y terapéuticas generales, incluyendo la medicación vía oral y de uso externo prescripta por el profesional médico d) Observar y atender todo indicio de alteración de la salud física o mental de la persona bajo su cuidado informando a quien corresponda.
e) Colaborar en la ejecución de técnicas recreativas, fisioterapéuticas y de laborterapia.
f) Fomentar, sostener y articular las redes solidarias de apoyo que tiendan a mejorar la calidad de vida y la conservación del rol familiar y social del asistido.
g) Proveer información sobre la disponibilidad y acceso de recursos existentes a nivel comunitario.
h) Desempeñar el rol de interlocutor para difundir aquellos conocimientos específicos incorporados, a quien cuida y a su grupo familiar.
i) Transmitir conceptos acerca de cuidados y autocuidados.
j) Incidir en la desmitificación de prejuicios y estereotipos.
k) Participar en cursos de actualización profesional para atención, prevención y asistencia del paciente/asistido y de su entorno familiar.
Toda otra actividad que no se encuadre en las prescripciones de la presente ley, corresponde al profesional de enfermería por ser inherente a la atención de la salud o al servicio doméstico, por realizar tareas del hogar y no de la atención de la persona.
Artículo 5.- Acciones de los cuidadores. En los establecimientos geriátricos, residencias de larga estadía para adultos mayores las acciones de los cuidadores de adultos mayores están referidas al cuidado y a la atención alimentaria, higiene personal y confort, colaboración en la administración oral de medicamentos bajo supervisión de enfermería o médica, movilización y traslado dentro y fuera del hábitat natural de las personas residentes en estos establecimientos y todas aquellas acciones referentes a los aspectos sociales concordantes y/o complementarios enunciados en el artículo precedente.
Artículo 6.- Del Registro. Créase el Registro de Cuidadores Polivalentes en el ámbito del Ministerio de Salud, Desarrollo Social y Deportes de la Provincia o el que en el futuro lo reemplace, quien deberá expedir la matrícula correspondiente que habilite para desempeñar dicha función.
Artículo 7.- Requisitos de inscripción. Serán requisitos para Inscribirse en el registro de Cuidadores Polivalente de personas:
a) Poseer educación primaria completa.
b) Ser mayor de edad.
c) Poseer certificado habilitante otorgado por entidad oficial o capacitación afín, reconocidas por la Dirección General de Escuelas o el Ministerio de Salud, Desarrollo Social y Deportes de la Provincia o el que en el futuro lo reemplace.
d) Declarar ante el Registro de Cuidadores la situación ante AFIP, con su debida constancia otorgada por dicha entidad.
e) Certificado de Antecedentes Judiciales y Policiales otorgado por el Ministerio de Seguridad Provincial.
f) Aptitud psicofisica para la tarea, acreditada mediante certificado médico, expedido por un organismo público de salud.
Los requisitos enumerados previamente deberán renovarse anualmente, quedando a criterio de la autoridad de aplicación la disminución de dicho plazo.
Artículo 8.- Capacitación y perfeccionamiento. La formación, capacitación y perfeccionamiento del Cuidador Polivalente de Personas podrá realizarse en instituciones estatales o privadas reconocidas por la Dirección General de Escuelas o por el Ministerio de Salud, Desarrollo Social y Deportes o el que en el futuro lo reemplace.
Artículo 9.- Autoridad de Aplicación. El Ministerio de Salud, Desarrollo Social y Deportes o el que en el futuro lo reemplace, será la Autoridad de Aplicación de la presente ley.
Artículo 10.- Funciones de la Autoridad de Aplicación. Serán funciones de la Autoridad de Aplicación:
a) Determinar los contenidos, pautas y todos los requisitos necesarios para desempeñar la función de Cuidador Polivalente, incluido el curso de formación y capacitación que habilite para tal fin.
b) Establecer los requisitos que deban cumplimentar las instituciones públicas o privadas para ser formadoras de Cuidadores Polivalentes.
c) Publicar la lista de instituciones públicas o privadas habilitadas para realizar los cursos de capacitación y formación.
d) Expedir la certificación que habilita para el desempeño de la función de Cuidador Polivalente e inscripción en el Registro.
e) Confeccionar y mantener actualizado el Registro Provincial de Cuidadores Polivalentes.
f) Realizar campañas informativas sobre el cuidado de adultos mayores y personas con discapacidad.
g) Organizar y realizar cursos de formación y capacitación para Cuidadores Polivalentes.
h) Informar sobre el listado actualizado de Cuidadores Polivalentes cada vez que así lo requieran centros de salud o particulares.
i) Celebrar convenios con las Obras Sociales y Prepagas a los efectos de afrontar los gastos que requiere el servicio de Cuidador Polivalente.
Artículo 11.- Normativa Aplicable. El Régimen de Trabajo del Cuidador Polivalente, su jornada, así como los derechos y obligaciones de las partes se regirán por la legislación laboral vigente, el Convenio Colectivo de Trabajo que rija la actividad y el contrato individual de trabajo celebrado entre empleador y trabajador.
Artículo 12.- Publicidad. La Autoridad de Aplicación, deberá publicar vía internet el Registro de Cuidadores Polivalentes debidamente detallado por departamento con los respectivos datos de cada miembro del registro.
Artículo 13.- Obligación de denuncia. El Cuidador Polivalente de personas está obligado a efectuar las denuncias correspondientes, en el marco de lo dispuesto por el art. 2° de la Ley Nº 24.417 de Protección contra la Violencia Familiar y su reglamentación.
Artículo 14.- Reglamentación. El Poder Ejecutivo reglamentará la presente Ley en un plazo de noventa (90) días a partir de su publicación en el Boletín Oficial.
Artículo 15.- Invítase a los Municipios a adherir a la presente ley en el ámbito de sus respectivas competencias.
Artículo 16.-Comuníquese al Poder Ejecutivo.
