Ley N° 5574
Artículo 1
.- Modifícase el art. 30 de la ley 265, el que quedará redactado de la siguiente forma:
Artículo 30.- La parte afectada podrá presentar descargos y ofrecer pruebas dentro del plazo perentorio e improrrogable de diez (10) días de notificada.
El imputado podrá producir prueba testimonial, informativa, documental y pericial.
Estará a su cargo el diligenciamiento de la prueba. Recibida la prueba, la Autoridad Administrativa del Trabajo dictará resolución y notificará al infractor dentro de los sesenta días hábiles de levantada el acta, absolviendo o imponiendo la sanción que corresponda. En este lapso no se computará el tiempo transcurrido en la tramitación de la prueba, cuando ella deba realizarse fuera del territorio de la Ciudad.
Esta resolución será notificada en su parte dispositiva, personalmente, por cédula o telegrama colacionado.
Artículo 2.- Modifícase el art. 34 de la Ley Nº 265, el que quedará redactado de la siguiente forma:
Artículo 34.- Las clausuras y multas que imponga el funcionario a cargo de la Autoridad Administrativa del Trabajo podrán apelarse, dentro del plazo perentorio e improrrogable de cinco (5) días de notificadas, por ante la Justicia de Trabajo. El recurso deberá deducirse y fundarse ante la Autoridad Administrativa que impuso o notificó la sanción.
