Por medio del Decreto 574, publicado en el Boletín Oficial del 12/04/2016, se aprobó el “PLAN NACIONAL DE PRIMERA INFANCIA”, como herramienta para garantizar el desarrollo integral de niños y niñas de CUARENTA Y CINCO (45) días a CUATRO (4) años de edad inclusive, en situación de vulnerabilidad social en pos de favorecer la promoción y protección de sus derechos, que será instrumentado en el ámbito del MINISTERIO DE DESARROLLO SOCIAL.

Aprobación. Objetivos.
Bs. As., 11/04/2016
VISTO el Expediente N° E-SENAF-3377-2016 del Registro de la Secretaría Nacional de Niñez, Adolescencia y Familia del MINISTERIO DE DESARROLLO SOCIAL, la Ley N° 26.061 de Protección Integral de los Derechos de las Niñas, Niños y Adolescentes, la Ley N° 26.233 de Promoción y Regulación de los Centros de Desarrollo Infantil y su Decreto Reglamentario N° 1202 del 28 de Julio de 2008, y
CONSIDERANDO:
Que la CONSTITUCIÓN DE LA NACIÓN ARGENTINA en su artículo 75, inciso 22, dota de jerarquía constitucional a diversos instrumentos internacionales de Derechos Humanos, incluyendo a la CONVENCIÓN SOBRE LOS DERECHOS DEL NIÑO.
Que la mencionada Convención, que fuera aprobada por Ley N° 23.849, establece en su artículo 3, inciso 2 que “…los Estados Parte se comprometen a asegurar al niño la protección y el cuidado que sean necesarios para su bienestar, teniendo en cuenta los derechos y deberes de sus padres, tutores u otras personas responsables de él ante la ley y, con ese fin, tomarán todas las medidas legislativas y administrativas adecuadas…”.
Que la Ley N° 26.061, tiene por objeto la protección integral de los derechos de las niñas, niños y adolescentes que se encuentren en el territorio de la REPUBLICA ARGENTINA, para garantizar el ejercicio y el disfrute pleno, efectivo y permanente de aquéllos reconocidos en el ordenamiento jurídico nacional y en los tratados internacionales en los que la Nación sea parte.
Que el citado cuerpo legal entiende, en su artículo 3°, por interés superior de la niña, niño y adolescente, la máxima satisfacción, integral y simultánea de los derechos y garantías que a ellos se les reconoce, entre los que se encuentran el derecho a una buena calidad de vida, educación, salud, como así también, a obtener los beneficios de la seguridad social.
Que, asimismo, en el artículo 7° de la Ley N° 26.061, se establece que “… la familia es responsable en forma prioritaria de asegurar a las niñas, niños y adolescentes el disfrute pleno y el efectivo ejercicio de sus derechos y garantías…”, y que “…los Organismos del Estado deben asegurar políticas, programas y asistencia apropiados para que la familia pueda asumir adecuadamente esta responsabilidad…”.
Que adicionalmente, la mencionada Ley prevé en su artículo 32, la conformación del Sistema de Protección Integral de Derechos de las Niñas, Niños y Adolescentes, por todos aquellos organismos, entidades y servicios que diseñan, planifican, coordinan, orientan, ejecutan y supervisan las políticas públicas, de gestión estatal o privadas, en el ámbito nacional, provincial y municipal, destinados a la promoción, prevención, asistencia, protección, resguardo y restablecimiento de los derechos de las niñas, niños y adolescentes, y establece los medios a través de los cuales se asegura el efectivo goce de los derechos y garantías reconocidos en la Constitución Nacional, la Convención sobre los Derechos del Niño, demás tratados de derechos humanos ratificados por el Estado argentino y el ordenamiento jurídico nacional.
Que la Política de Protección Integral de los Derechos de las Niñas, Niños y Adolescentes debe ser implementada mediante una concertación articulada de acciones de la Nación, las Provincias, la CIUDAD AUTÓNOMA DE BUENOS AIRES y los Municipios.
Que, en ese marco, se creó, en el ámbito del PODER EJECUTIVO NACIONAL, la SECRETARIA NACIONAL DE NIÑEZ, ADOLESCENCIA Y FAMILIA, organismo especializado en materia de derechos de infancia y adolescencia, la que funciona con representación interministerial y de las organizaciones de la sociedad civil.
Que, asimismo, se creó el CONSEJO FEDERAL DE NIÑEZ, ADOLESCENCIA Y FAMILIA, el que se encuentra integrado por quien ejerza la titularidad de la citada Secretaría Nacional, quien lo presidirá, y por los representantes de los órganos de Protección de Derechos de Niñez, Adolescencia y Familia existentes o a crearse en cada una de las provincias y de la CIUDAD AUTÓNOMA DE BUENOS AIRES.
Que por Decreto N° 416/06, fue incorporada dicha Secretaría Nacional en el ámbito del MINISTERIO DE DESARROLLO SOCIAL.
Que la Ley Nº 26.233 de Promoción y Regulación de los Centros de Desarrollo Infantil tiene por finalidad promover y regular dichos Centros como espacios destinados a la atención integral de la primera infancia, con el objeto de brindar los cuidados adecuados e imprescindibles, complementando, orientando y coadyuvando en su rol, a las familias desde una función preventiva, promocional y reparadora.
Que dicha norma instauró a la SECRETARIA DE NIÑEZ, ADOLESCENCIA Y FAMILIA, como Autoridad de Aplicación del citado régimen, quien deberá, en el marco del CONSEJO FEDERAL DE NIÑEZ, ADOLESCENCIA Y FAMILIA, elaborar los planes requeridos para la aplicación de la Ley, cuya implementación estará a cargo de los órganos administrativos de protección de cada jurisdicción, según lo establecido por la Ley Nº 26.061, en su artículo 42.
Que el Decreto N° 1202/08, reglamentario de la Ley N° 26.233, estipuló en el artículo 2° del Anexo, aprobado por el artículo 1°, que los Centros de Desarrollo Infantil estarán destinados a niños y niñas entre CUARENTA Y CINCO (45) días y CUATRO (4) años de edad inclusive, y formularán su proyecto institucional contemplando necesidades y demandas de las familias y comunidades en las que se encuentren insertos.
Que por el Decreto mencionado precedentemente se creó la COMISION DE PROMOCION Y ASISTENCIA DE LOS CENTROS DE DESARROLLO INFANTIL COMUNITARIOS, en el ámbito de la SECRETARIA NACIONAL DE NIÑEZ, ADOLESCENCIA Y FAMILIA del MINISTERIO DE DESARROLLO SOCIAL, la que tiene por objeto coordinar el trabajo interjurisdiccional en materia de los aspectos logísticos, administrativos y organizativos y todo otro que resulte pertinente para la preparación y organización de los Centros de Desarrollo Infantil, así como determinar y propiciar las medidas y actos que resulten necesarios para el cumplimiento del objeto señalado.
Que, en virtud de todo lo expuesto, se considera pertinente avanzar hacia la igualdad de derechos y oportunidades en las personas, generando condiciones de óptimo desarrollo desde la primera infancia.
Que para ello, resulta necesaria la implementación de un Plan Nacional cuyo objetivo principal sea garantizar el desarrollo integral de niños y niñas de CUARENTA Y CINCO (45) días a CUATRO (4) años de edad inclusive, en situación de vulnerabilidad social en pos de favorecer la promoción y protección de sus derechos.
Que a tales fines, se prevé como objetivos particulares la promoción y fortalecimiento de espacios de cuidado y abordaje integral de niñas y niños en su primera infancia, que garanticen una adecuada y saludable nutrición, así como la estimulación temprana y promoción de la salud, propiciando condiciones de participación activa en el ámbito familiar y comunitario que faciliten el proceso de crianza y desarrollo de niños y niñas, promoviendo el fortalecimiento intrafamiliar y comunitario.
Que la SECRETARIA NACIONAL DE NIÑEZ, ADOLESCENCIA Y FAMILIA, ha intervenido conforme sus competencias.
Que la DIRECCIÓN GENERAL DE ASUNTOS JURIDICOS del MINISTERIO DE DESARROLLO SOCIAL ha tomado la intervención de su competencia.
Que el PODER EJECUTIVO NACIONAL se encuentra facultado para dictar el presente en virtud de lo dispuesto por el artículo 99, inciso 1, de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE
DE LA NACIÓN ARGENTINA
DECRETA:
Artículo 1° — Apruébase el “PLAN NACIONAL DE PRIMERA INFANCIA”, como herramienta para garantizar el desarrollo integral de niños y niñas de CUARENTA Y CINCO (45) días a CUATRO (4) años de edad inclusive, en situación de vulnerabilidad social en pos de favorecer la promoción y protección de sus derechos, que será instrumentado en el ámbito del MINISTERIO DE DESARROLLO SOCIAL.
Art. 2° — El “PLAN NACIONAL DE PRIMERA INFANCIA” tendrá por objetivos, la promoción y fortalecimiento de espacios de cuidado y abordaje integral de niñas y niños en su primera infancia, que garanticen una adecuada y saludable nutrición, así como la estimulación temprana y promoción de la salud, propiciando condiciones de participación activa en el ámbito familiar y comunitario que faciliten el proceso de crianza y desarrollo de niños y niñas, promoviendo el fortalecimiento intrafamiliar y comunitario.
Art. 3° — Facúltase a la titular del MINISTERIO DE DESARROLLO SOCIAL a dictar las normas complementarias y todo acto administrativo que fuera menester para la implementación del “PLAN NACIONAL DE PRIMERA INFANCIA”.
