Asimismo se efectuaron algunas modificaciones.
A continuación el texto de la norma:
EL MINISTRO
DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL
RESUELVE:
Artículo 1° — Prorrógase hasta el 31 de diciembre de 2016, la vigencia del PROGRAMA DE RECUPERACIÓN PRODUCTIVA creado por la Resolución MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 481 de fecha 10 de julio de 2002 y sus modificatorias.
Art. 2° — Sustitúyanse el Anexo l y el Anexo II (A, B y C) de la Resolución MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 50/15, por el Anexo I y Anexo II (A, B y C), respectivamente, que forman parte integrante de la presente medida.
Art. 3° — Facúltase a la UNIDAD TÉCNICA DE EVALUACIÓN conformada en el ámbito de la Dirección Nacional de Relaciones Federales, dependiente de la SECRETARIA DE TRABAJO para considerar la información y documentación contenidas en las solicitudes de adhesión y proyectos presentados por empresas y asociaciones sindicales, y para relevar datos adicionales que permitan ampliar y/o verificar los aportados inicialmente y solicitar la documentación que estime necesaria y, asimismo, disponer la realización de visitas de evaluación a la sede del establecimiento por parte de técnicos del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL, a efectos de ratificar y/o rectificar conclusiones y/o recabar cualquier nueva información considerada relevante a los fines de la evaluación de la propuesta.
Art. 4° — Las empresas cuyas solicitudes fueran aprobadas se comprometerán a abonar a los trabajadores beneficiarios del PROGRAMA, el suplemento en dinero necesario para alcanzar el salario establecido para la categoría de que se trate en el Convenio Colectivo de Trabajo aplicable a la actividad correspondiente, de acuerdo a lo dispuesto en el artículo 3° de la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 481/02; a mantener la dotación total de personal registrada al momento de la presentación de su solicitud y/o aprobación de la misma y a abstenerse de disponer despidos sin causa (art. 245 LCT) y por razones de fuerza mayor (art. 247 LCT).
La obligación de mantención de la nómina total de personal podrá ser exceptuada en los casos de las empresas que cuenten en su nómina de trabajadores contratados bajo el régimen del contrato de trabajo de temporada, situación que deberá ser fehacientemente comunicada y acreditada por el empleador al momento de su adhesión, la cual tendrá que estar estrictamente vinculada con la actividad que la empresa desarrolle.
Si el empleador dispusiera la suspensión y/o reducción de jornada del personal durante el período de inclusión en el PROGRAMA deberá presentar la correspondiente Acta Acuerdo tramitada en sede administrativa.
Asimismo, no podrán ser beneficiarios del programa las empresas que se encuentren incluidas en el Registro Público de Empleadores con Sanciones Laborales (REPSAL) de la ley 26.940.
Art. 5° — Vencido el plazo de otorgamiento informado, la empresa beneficiaria podrá solicitar una extensión del mismo, presentando la documentación detallada en el Anexo I – apartado: solicitud de extensiones. Dicha solicitud tendrá el mismo tratamiento establecido en el artículo 3° de la presente.
Art. 6° — No podrán ser beneficiarios del presente programa los trabajadores menores de 18 (DIECIOCHO) años.
Art. 7° — La Dirección Nacional de Relaciones Federales del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL realizará, a través de su estructura territorial el seguimiento, fiscalización y monitoreo del PROGRAMA referido en el artículo 1° de la presente medida y, a través del sistema informático “RePro”, podrá verificar, mediante el cruce automático con el Sistema Integrado Previsional Argentino (S.I.P.A) y “Mi Simplificación”, el mantenimiento de la dotación total de personal por parte de las empresas adherentes al mismo, como así también que sus beneficiarios se encuentren registrados como trabajadores en relación de dependencia, y en caso de corresponder, dispondrá las intimaciones de regularización pertinentes.
Art. 8° — En virtud de razones de índole objetiva, debidamente constatadas y analizadas que afecten particularmente a una empresa o región, con el objeto de contribuir a la recuperación, crecimiento y desarrollo de las empresas y sectores privados que presenten sus solicitudes, a fin de coadyuvar al sostenimiento y generación de puestos de trabajo, podrá disponerse el otorgamiento del beneficio por un lapso de hasta DOCE (12) meses y por una suma fija mensual de carácter remunerativa de hasta el monto equivalente al salario mínimo, vital y móvil, a favor de los trabajadores de las empresas adheridas al Programa.
El lapso estipulado en el presente podrá extenderse, por vía de excepción, ante circunstancias especiales debidamente fundadas y acreditadas.
Art. 9° — La presentación de la solicitud de adhesión, así como la tramitación del beneficio y su otorgamiento tienen, en todo su proceso, carácter gratuito, no siendo necesaria la intervención de intermediarios para ningún fin.
Art. 10. — A los fines de implementar acciones de sostenimiento del empleo podrán suscribirse actas acuerdo y/o convenios entre esta jurisdicción y los gobiernos provinciales, municipios, entidades gremiales y cámaras que agrupen diferentes sectores industriales, así como también formalizarse reuniones con otras entidades gubernamentales a los mismos fines o tendientes a obtener información de las empresas solicitantes
Art. 11. — El incumplimiento por parte de la empresa de las obligaciones dispuestas por la Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 481/02 y sus modificatorias, provocará la caducidad del beneficio otorgado, sin perjuicio de las acciones legales que correspondan, dirigidas a obtener el reembolso por parte del empleador, de los montos percibidos indebidamente.
Art. 12. — La Resolución del MINISTERIO DE TRABAJO, EMPLEO Y SEGURIDAD SOCIAL N° 223 del 1 de abril de 2005 seguirá vigente en todo lo que no hubiera sido expresamente modificado por la presente Resolución.
