VISTO el Expediente N° 2010/2008 del registro de la COMISIÓN NACIONAL DE VALORES, caratulado “PROYECTO DE RESOLUCIÓN GENERAL S/ADECUACIÓN DE ENTIDADES AUTORREGULADAS A COMUNICACIÓN “A” BCRA DEL 3-11-08”, lo dictaminado por la Gerencia de Agentes y Mercados, la Gerencia General de Mercados y la Gerencia de Asuntos Jurídicos, y
CONSIDERANDO:
Que el BANCO CENTRAL DE LA REPÚBLICA ARGENTINA (en adelante el “BCRA”) dictó las Comunicaciones “A” 4864, 4882 y 5677.
Que en virtud de ello, la COMISIÓN NACIONAL DE VALORES (en adelante la “COMISIÓN”) dictó las Resoluciones Generales N° 538/08, 539/08, 543/08, 548/09, 551/09, 563/09 y 636/14.
Que por su parte, las NORMAS CNV (N.T. 2013 y mod.) establecen que los Agentes sólo podrán dar curso a operaciones de venta de valores negociables con liquidación en moneda extranjera, cuando el vendedor acredite la tenencia de los valores negociables objeto de la transacción por un plazo no inferior a SETENTA Y DOS (72) horas hábiles; y deberán abstenerse de ordenar transferencias a entidades depositarias del exterior de valores negociables objeto de operaciones de compra, hasta tanto hayan transcurrido SETENTA Y DOS (72) horas hábiles desde la acreditación de los mismos en la cuenta del comprador.
Que con fecha 28 de diciembre de 2015, el BCRA, mediante Comunicaciones “A” 5861 y 5864, resolvió derogar las Comunicaciones “A” 4864, 4882 y 5677, que oportunamente sirvieron de sustento para los requisitos de las “operaciones en moneda extranjera” establecidos por la COMISIÓN a partir de la normativa reglamentaria citada precedentemente.
Que considerando lo dispuesto por el BCRA en su función de regulador de la moneda, crédito y de ejecución de la política cambiaria, resulta necesario eliminar la Sección XIX —OPERACIONES CON LIQUIDACIÓN EN MONEDA EXTRANJERA— del Capítulo V —NEGOCIACIÓN SECUNDARIA. OPERACIONES— del Título VI —MERCADOS Y CÁMARAS COMPENSADORAS— de las NORMAS (N.T. 2103 y mod.).
Que la presente se dicta en ejercicio de las facultades otorgadas por el artículo 19 incisos g) y h) de la Ley N° 26.831 y de su Decreto Reglamentario N° 1023/2013.
