VISTO el Expediente S01:0256530/2015 del Registro del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS, la Ley N° 26.741, el Decreto N° 1.277 de fecha 25 de julio de 2012, las Resoluciones Nros. 3 de fecha 17 de septiembre de 2012, 49 de fecha 20 de septiembre de 2013 y 165 de fecha 19 de agosto de 2014, todas de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, y
CONSIDERANDO:
Que a través del Decreto N° 1.277 de fecha 25 de julio de 2012 se aprobó la reglamentación de la Ley N° 26.741 de Soberanía Hidrocarburífera de la REPÚBLICA ARGENTINA.
Que por el Artículo 2° del citado Reglamento, se creó la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas en la órbita de la SECRETARÍA DE POLÍTICA ECONÓMICA Y PLANIFICACIÓN DEL DESARROLLO del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS.
Que el Artículo 7° del referido Reglamento creó el Registro Nacional de Inversiones Hidrocarburíferas en el ámbito de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, en el cual deben estar inscriptos los sujetos que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles.
Que mediante la Resolución N° 3 de fecha 17 de septiembre de 2012 la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas aprobó el Formulario de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas, previendo los requisitos formales de inscripción.
Que el Artículo 2° de la referida Resolución N° 3/12 establece que los Formularios de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas deben ser presentados ante la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas antes del 30 de septiembre de cada año, en soporte papel y digital, por todas las personas físicas y jurídicas que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles.
Que a los fines de garantizar la actualización de la información del Registro Nacional de Inversiones Hidrocarburíferas, mediante la Resolución N° 49 de fecha 20 de septiembre de 2013, la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas aprobó un formulario actualizado para que los sujetos que ya se encontraban inscriptos en el referido registro presenten únicamente su Plan Anual de Inversiones correspondiente al año 2014, previendo los requisitos formales para su presentación así como también la información que debía detallarse.
Que, asimismo, se estableció que los sujetos que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles que aún no se encontraban inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas, debían solicitar su inscripción antes del 30 de septiembre de 2013, presentando al efecto el Formulario de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas, que como Anexo I forma parte integrante de la Resolución N° 3/12, y el Formulario de Información sobre el Plan Anual de Inversiones correspondiente al año 2014, que como Anexo l forma parte integrante de la Resolución N° 49/13.
Que, posteriormente, la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas dictó la Resolución N° 165 de fecha 19 de agosto de 2014 por medio de la cual sustituyó los Artículos 1° y 2° de la referida Resolución N° 49/13 aprobando, por un lado, el Formulario de Información sobre el Plan Anual de Inversiones correspondiente al año 2015 que debía ser presentado antes del 31 de octubre de 2014 por los sujetos inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas a los fines de actualizar su inscripción y estableciendo, por el otro, que los sujetos que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles que aún no se encontraban inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas, debían solicitar su inscripción antes del 31 de octubre de 2014, presentando el Formulario de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas, que como Anexo I forma parte integrante de la Resolución N° 3/12 y el Formulario de Información sobre el Plan Anual de Inversiones correspondiente al año 2015 que como Anexo forma parte de la citada Resolución N° 165/14.
Que, en tales condiciones, corresponde aprobar el Formulario de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas actualizado a fin de que los sujetos que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles que aún no se encuentren inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas puedan solicitar su inscripción ante la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, por lo que corresponde sustituir el Anexo I aprobado por el Artículo 1º de la Resolución N° 3/12 de la referida Comisión por el Formulario de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas que como Anexo I forma parte integrante de la presente.
Que, a su vez, de la práctica llevada adelante por la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas y por su Secretaría Administrativa durante las inscripciones en el Registro Nacional de Inversiones Hidrocarburíferas se ha advertido que resulta conveniente, a efectos de optimizar el régimen diseñado, omitir el establecimiento de un plazo temporal para la presentación de la solicitudes de inscripción por parte de los sujetos que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles.
Que, a raíz de lo expuesto, corresponde modificar el Artículo 2° de la precitada Resolución Nº 3/12 en cuanto dispone que los Formularios de Inscripción al Registro Nacional de Inversiones Hidrocarburíferas deben ser presentados ante la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas antes del 30 de septiembre de cada año.
Que, asimismo, habiendo acaecido los plazos que se dispusieron por las Resoluciones Nros. 49/13 y 165/14 resulta necesario determinar las nuevas condiciones para que los sujetos inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas presenten sus Planes Anuales de Inversiones correspondientes al año 2016.
Que, en consecuencia, resulta necesario aprobar el Formulario de Información sobre el Plan Anual de Inversiones correspondiente al año 2016, que como Anexo II forma parte integrante de la presente; el que deberá ser presentado por los sujetos inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas, a los fines de actualizar su inscripción antes del 31 de octubre de 2015, en soporte papel y digital, bajo apercibimiento de lo previsto por el Artículo 29 del Decreto N° 1.277/12.
Que, a los fines de facilitar la presentación de los formularios, tanto en formato papel como digital, resulta conveniente poner a disposición de los requirentes el soporte digital correspondiente, a través de la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas.
Que la Dirección General de Asuntos Jurídicos del MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS ha tomado la intervención que le compete.
Que la presente medida se dicta en uso de las facultades conferidas por los Artículos 3° y concordantes del Anexo I del Decreto N° 1.277 de fecha 25 de julio de 2012.

Artículo 1° — Sustitúyese el Anexo I aprobado por el Artículo 1° de la Resolución N° 3 de fecha 17 de septiembre de 2012 de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas por el Formulario de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas que, como Anexo I, forma parte integrante de la presente.
Art. 2° — Sustitúyese el Artículo 2° de la Resolución N° 3 de fecha 17 de septiembre de 2012 de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, el que quedará redactado de la siguiente manera:
“Los Formularios de Inscripción en el Registro Nacional de Inversiones Hidrocarburíferas deberán ser presentados ante la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, en soporte papel y digital, por todas las personas físicas y jurídicas que realicen actividades de exploración, explotación, refinación, transporte y comercialización de hidrocarburos y combustibles”.
Art. 3° — Sustitúyese el Artículo 4º de la Resolución N° 3 de fecha 17 de septiembre de 2012 de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, el que quedará redactado de la siguiente manera:
“El Formulario de Inscripción en el Registro Nacional de inversiones Hidrocarburíferas podrá ser solicitado en formato digital a la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, personalmente o a través de su correo electrónico: cepnihfor@mecon.gob.ar”.
Art. 4° — Apruébase el Formulario de Información sobre el Plan Anual de Inversiones correspondiente al año 2016, que como Anexo II forma parte integrante de la presente; el que deberá ser presentado por los sujetos inscriptos en el Registro Nacional de Inversiones Hidrocarburíferas, a los fines de actualizar su inscripción, antes del 31 de octubre de 2015, en soporte papel y digital, bajo apercibimiento de lo previsto por el Artículo 29 del Decreto N° 1.277/12.
Art. 5° — El Formulario de Información sobre el Plan Anual de Inversiones correspondiente al año 2016 podrá ser solicitado en formato digital a la Secretaría Administrativa de la Comisión de Planificación y Coordinación Estratégica del Plan Nacional de Inversiones Hidrocarburíferas, personalmente o a través de su correo electrónico: cepnihfor@mecon.gob.ar.
Art. 6° — La presente medida entrará en vigencia el día de su publicación en el Boletín Oficial.
