Dicho monto, inicialmente dispuesto en $ 26.587, por la norma en comentario aumentará a $ 31.020.

VISTO el Expediente N° S02:0072278/2015 del registro de este Ministerio, y
CONSIDERANDO:
Que mediante el Decreto N° 84 de fecha 4 de febrero de 2009 y sus modificatorios, se ordenó la implementación de un SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.) como medio de percepción de la tarifa para el acceso a la totalidad de los servicios de transporte público automotor, ferroviario de superficie, subterráneo de pasajeros de carácter urbano y suburbano y fluvial regular de pasajeros con tarifa regulada prestados por empresas destinatarias del régimen de suministro de gasoil a precio diferencial previsto en el artículo 4° del Decreto N° 159 de fecha 4 de febrero de 2004.
Que en el artículo 1° de la Resolución N° 1535 de fecha 4 de diciembre de 2014 de este Ministerio, se dispuso que las provincias y los municipios en cuya jurisdicción operen empresas destinatarias de la COMPENSACIÓN COMPLEMENTARIA PROVINCIAL (C.C.P.), en el marco de lo dispuesto en el artículo 3° del Decreto N° 98 de fecha 6 de febrero de 2007, que presten servicios urbanos y suburbanos de transporte público automotor de pasajeros en las ciudades capitales de provincia y/o en aquellas ciudades que cuenten con una población que supere los DOSCIENTOS MIL (200.000) habitantes, según el censo de población del año 2010, deberán adoptar las medidas necesarias a los fines de que dichas empresas implementen el SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.), conforme a lo dispuesto en el artículo 1° del Decreto N° 84/09, el artículo 8° del Decreto N° 98/07 y al Cronograma de Instalación N° 2 que la SECRETARÍA DE TRANSPORTE de este Ministerio establezca al efecto.
Que asimismo, en el artículo 10 de la Resolución N° 1535/14 se dispuso que las provincias y/o municipios podrán implementar el SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.) en las empresas de servicios urbanos y suburbanos de transporte público automotor de pasajeros bajo jurisdicción provincial o municipal que operen en ciudades no incluidas en el artículo 1° de dicha resolución, previa autorización de la SECRETARÍA DE TRANSPORTE.
Que mediante el artículo 1° de la Resolución N° 296 de fecha 11 de marzo de 2015 de este Ministerio, se aprobó el Cronograma N° 2 de Instalación del SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.) para la líneas afectadas a servicios de transporte público automotor urbano y suburbano de pasajeros en las ciudades capitales de provincia y/o en aquellas ciudades que cuenten con una población que supere los DOSCIENTOS MIL (200.000) habitantes, bajo jurisdicción provincial o municipal.
Que por el artículo 13 de la Resolución N° 225 de fecha 10 de marzo de 2015 de este Ministerio, se dispuso que las provincias y los municipios beneficiarios de la COMPENSACIÓN COMPLEMENTARIA PROVINCIAL (CCP), deberán informar en forma fehaciente a la COMISIÓN NACIONAL DE REGULACIÓN DEL TRANSPORTE, ente autárquico actuante en jurisdicción de la SECRETARÍA DE TRANSPORTE de este Ministerio, la oportunidad en que las empresas hayan instalado y se encuentre en funcionamiento el SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.) en el ámbito de su competencia, a los fines de que dicho organismo de control, proceda a inspeccionar e informar a la SECRETARÍA DE TRANSPORTE de este Ministerio, la cantidad de validadoras en funcionamiento que hubiera instalado por cada uno de los operadores, en cumplimiento de lo establecido en la Resolución N° 1535/14 de este Ministerio.
Que mediante el artículo 14 de la Resolución N° 225/15 de este Ministerio, se estableció que la SECRETARÍA DE TRANSPORTE de este Ministerio reconocerá a cada jurisdicción beneficiaria, la suma de PESOS VEINTISÉIS MIL QUINIENTOS OCHENTA Y SIETE ($ 26.587) por cada validadora que haya sido instalada y que haya sido inspeccionada, conforme el artículo 13 de la misma.
Que resulta pertinente señalar que una vez abonada la suma indicada en el considerando precedente, las validadoras pasaron a ser de titularidad del Estado Nacional, siendo necesario incluirlo en el artículo 14 de la Resolución N° 225/15 de este Ministerio.
Que por otra parte, NACIÓN SERVICIOS SOCIEDAD ANÓNIMA, en su calidad de agente de administración y gestión del SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.), efectuó el llamado a Licitación Pública N° 4/15 y N° 7/15 sobre “Provisión de equipos validadores, consolas de conductor y módulos GPS/GPRS, homologados por dicha entidad, para colectivos” y de la “Provisión de equipos validadores para colectivos, consolas de conductor y concentradores de transacciones para el SUBE”, respectivamente, con el objeto de adquirir una cierta cantidad de equipos validadores para entregar en comodato a aquellas provincias y municipios que aún no cuenten con el equipamiento para el SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.).
Que en ese marco, mediante Nota GG NS N° 2995 de fecha 24 de abril de 2015 y Nota GG NS N° 3019 de fecha 29 de junio de 2015, NACIÓN SERVICIOS SOCIEDAD ANÓNIMA informó el resultado de las cotizaciones ofrecidas por los distintos oferentes en las licitaciones referidas precedentemente, las cuales reflejan un aumento en los costos del equipamiento indicado.
Que en virtud de ello, y resultando el mentado equipamiento imprescindible para la viabilidad de la implementación del SISTEMA ÚNICO DE BOLETO ELECTRÓNICO (S.U.B.E.) en el interior del país, se ha decidido ampliar el monto de la compensación económica reconocida oportunamente a las provincias y municipios en el artículo 14 de la Resolución N° 225/15 de esta Ministerio, en concordancia con el monto informado por NACIÓN SERVICIOS SOCIEDAD ANÓNIMA.
Que la DIRECCIÓN GENERAL DE ASUNTOS JURÍDICOS de este Ministerio ha tomado la intervención de su competencia.
Que la presente medida se dicta en uso de las facultades conferidas por el Decreto N° 84/09 y por la Resolución N° 1535/14 de este Ministerio.

Artículo 1° — Modifícase el artículo 14 de la Resolución N° 225 de fecha 10 de marzo de 2015 del MINISTERIO DEL INTERIOR Y TRANSPORTE, el que quedará redactado de la siguiente manera:
“ARTÍCULO 14.- La SECRETARÍA DE TRANSPORTE del MINISTERIO DEL INTERIOR Y TRANSPORTE reconocerá a cada jurisdicción beneficiaria, la suma de PESOS TREINTA Y UN MIL VEINTE ($ 31.020), por cada validadora que haya sido instalada y que haya sido inspeccionada conforme al artículo precedente, cuya titularidad quedará en poder del Estado Nacional”.
Art. 2° — Notifíquese la presente medida a la COMISIÓN NACIONAL DE REGULACION DEL TRANSPORTE, ente autárquico actuante en jurisdicción de la SECRETARÍA DE TRANSPORTE del MINISTERIO DEL INTERIOR Y TRANSPORTE, a NACIÓN SERVICIOS SOCIEDAD ANÓNIMA y a las Entidades Representativas del Transporte Automotor de Pasajeros.
