ARTÍCULO 1° — Declárase de utilidad pública y sujeto a expropiación el inmueble sito en la avenida Juan B. Justo 1776, entre las calles A. Fleming y Solís, de la ciudad de Mar del Plata, partido de General Pueyrredón, provincia de Buenos Aires, de propiedad de la Asociación de Obras Sociales de Mar del Plata, identificado según nomenclatura catastral: circunscripción VI; sección H; manzana 5-II-a; parcela 3-a, junto con todas sus instalaciones, mobiliario y equipamiento.
El proceso de expropiación estará regido por lo establecido en la ley 21.499 y actuará como expropiante el organismo que designe a tal efecto el Poder Ejecutivo nacional.
ARTÍCULO 2° — El precio de los bienes sujetos a expropiación se determinará conforme lo previsto en el artículo 10 y concordantes de la ley 21.499, debiendo el Tribunal de Tasaciones de la Nación efectuar la tasación de los mismos.
ARTÍCULO 3° — La suma que eventualmente deba abonarse en cumplimiento del proceso expropiatorio será pagada —hasta el monto correspondiente si excediera el de la tasación— con las deudas que la Asociación de Obras Sociales de Mar del Plata registre por el inmueble en cuestión ante la Administración Federal de Ingresos Públicos (AFIP), organismo actuante en el ámbito del Ministerio de Economía y Finanzas Públicas, u organismos de recaudación del ámbito provincial o municipal.
En caso de que existieran deudas con organismos de recaudación del ámbito provincial o municipal, el expropiante adoptará las medidas conducentes a fin de saldarlas.
ARTÍCULO 4° — Una vez culminado el proceso de expropiación, la totalidad de los bienes pasará a integrar el patrimonio del expropiante.
ARTÍCULO 5° — El personal que actualmente presta servicios en el inmueble identificado en el artículo 1°, será absorbido por el expropiante, conservando su régimen laboral, todos los derechos laborales adquiridos, la afiliación gremial que posean en la actualidad y la vigencia de su convenio colectivo de trabajo.
ARTÍCULO 6° — Para garantizar la continuidad de las actividades que se realizan en el inmueble identificado en el artículo 1°, el mantenimiento de las fuentes laborales y el propio resguardo de los bienes, el Poder Ejecutivo nacional, a través del organismo que designe, en los términos de los artículos 57 y 59 de la ley 21.499, ejercerá desde el momento de la entrada en vigencia de la presente ley todos los derechos que la titularidad de dichos bienes le confiere.
ARTÍCULO 7° — La presente ley es de orden público y entrará en vigencia a partir de su publicación en el Boletín Oficial.
ARTÍCULO 8° — Hágase saber al Juzgado Nacional de Primera Instancia en lo Comercial N° 10 el contenido de la presente medida, con agregación de copia certificada.
ARTÍCULO 9° — Comuníquese al Poder Ejecutivo nacional.
