Por ley 27.152, promulgada por decreto 1163/2015 (ambas normas B.O. 24/6/2015) se dispuso la aprobación de diversas resoluciones de la Junta de Gobernadores del Banco Internacional de Reconstrucción y Fomento (BIRF).
A través de tales resoluciones, nuestro país se ha comprometido a suscribir acciones del referido banco, en unos casos, y a abonar ciertas sumas de dinero, en otros.
Para hacer frente a estos pagos, se ha encomendado al Banco Central de la República Argentina (autorizado para realizar los mismos) a contar con los correspondientes aportes de contrapartida que serán proporcionados por la Secretaría de Hacienda del Ministerio de Economía y Finanzas Públicas, previa inclusión de dicha erogación en la Ley de Presupuesto General de la Administración Nacional para los ejercicios pertinentes. El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de Ley:
ARTÍCULO 1° — Apruébase lo dispuesto por la Resolución N° 612 de fecha 16 de marzo de 2011 de la Junta de Gobernadores del Banco Internacional de Reconstrucción y Fomento (BIRF) denominada: ‘Aumento Selectivo del Capital Social Autorizado de 2010 para mejorar las voces y la participación de los países en desarrollo y en transición’, cuya copia autenticada forma parte de la presente ley como Anexo I, en lo que respecta a que la República Argentina suscriba dos mil seiscientos cuarenta y tres (2.643) acciones del mencionado Banco y abone al Banco Internacional de Reconstrucción y Fomento (BIRF) la suma de dólares estadounidenses trescientos dieciocho millones ochocientos treinta y ocho mil trescientos cinco (U$S 318.838.305) de los cuales el noventa y cuatro por ciento (94%) equivalen a dólares estadounidenses doscientos noventa y nueve millones setecientos ocho mil seis con setenta centavos (U$S 299.708.006,70) corresponden al capital exigible y el seis por ciento (6%) restante se divide en un cero coma seis por ciento (0,6%) de capital a pagar en dólares estadounidenses, equivalente a la suma de dólares estadounidenses un millón novecientos trece mil veintinueve con ochenta y tres centavos (U$S 1.913.029,83) y un cinco coma cuatro por ciento (5,4%) de capital pagadero en cualquier otra moneda de libre convertibilidad, equivalente a dólares estadounidenses diecisiete millones doscientos diecisiete mil doscientos sesenta y ocho con cuarenta y siete centavos (U$S 17.217.268,47). El pago podrá efectuarse en cuatro (4) años contados a partir de la fecha de aprobación de la Resolución N° 612/11 para suscribir las acciones que se le asignen, considerándose la posibilidad de proceder a una eventual prórroga por un período de hasta veinticuatro (24) meses después de los cuatro (4) años iniciales. Toda prórroga correspondiente a los primeros doce (12) meses deberá ser aprobada por la Administración, mientras que toda prórroga más allá de los primeros doce (12) meses tendrá que ser aprobada por los Directores Ejecutivos del Banco.
ARTÍCULO 2° — Apruébase lo dispuesto por la Resolución N° 613 de fecha 16 de marzo de 2011 de la Junta de Gobernadores del Banco Internacional de Reconstrucción y Fomento (BIRF) denominada: ‘Aumento General del Capital de 2010’, cuya copia autenticada se adjunta a la presente ley como Anexo II, en lo que respecta a que la República Argentina suscriba cinco mil quinientas sesenta y cuatro (5.564) acciones que equivalen a la suma de dólares estadounidenses seiscientos setenta y un millones doscientos trece mil ciento cuarenta (U$S 671.213.140) de los cuales el noventa y cuatro por ciento (94%) que equivalen a dólares estadounidenses seiscientos treinta millones novecientos cuarenta mil trescientos cincuenta y uno con sesenta centavos (U$S 630.940.351,60) corresponde al capital exigible y el seis por ciento (6%) restante, a su vez se divide en un cero coma seis por ciento (0,6%) de capital a pagar equivalente a la suma de dólares estadounidenses cuatro millones veintisiete mil doscientos setenta y ocho con ochenta y cuatro centavos (U$S 4.027.278,84) y un cinco coma cuatro por ciento (5,4%) de capital pagadero en cualquier otra moneda de libre convertibilidad equivalente a la suma de dólares estadounidenses treinta y seis millones doscientos cuarenta y cinco mil quinientos nueve con cincuenta y seis centavos (U$S 36.245.509,56). El pago podrá efectuarse en cinco (5) años contados a partir de la fecha de aprobación de la citada Resolución N° 613/11 para suscribir las acciones que se le asignen, considerándose la posibilidad de proceder a una eventual prórroga por un período de hasta veinticuatro (24) meses después de los cinco (5) años iniciales. Toda prórroga correspondiente a los primeros doce (12) meses deberá ser aprobada por la Administración, mientras que toda prorroga más allá de los primeros doce (12) meses tendrá que ser aprobada por los Directores Ejecutivos del Banco.
ARTÍCULO 3° — Apruébase lo dispuesto por la Resolución N° 614 de fecha 16 de marzo de 2011 de la Junta de Gobernadores del Banco Internacional de Reconstrucción y Fomento (BIRF) denominada: ‘Aumento Adicional del Capital Autorizado para suscripciones de nuevos miembros 2010’, cuya copia autenticada se adjunta a la presente ley como Anexo III.
ARTÍCULO 4° — Apruébase lo dispuesto por la Resolución N° 256/12 de la Junta de Gobernadores de la Corporación Financiera Internacional (CFI) denominada: ‘Enmienda del Convenio Constitutivo y Aumento Selectivo del Capital 2010’, cuya copia autenticada se adjunta a la presente ley como Anexo IV; en lo que respecta a que la República Argentina suscriba cuatro mil doscientas setenta y seis (4.276) acciones que equivalen a la suma de dólares estadounidenses cuatro millones doscientos setenta y seis mil (U$S 4.276.000) a pagar en dólares estadounidenses o mediante la emisión de pagarés expresados en la misma moneda. El pago podrá efectuarse antes del tercer aniversario de la fecha de efectividad del incremento de capital autorizado de la Corporación Financiera Internacional (CFI) abonando la totalidad de las acciones suscriptas o estableciendo una programación de pagos anuales.
ARTÍCULO 5° — Apruébase la cancelación de las Reposiciones Séptima, Octava, Novena, Duodécima, Decimotercera, Decimocuarta, Decimoquinta y de la Iniciativa para el Alivio de la Deuda Multilateral, pendientes en la Asociación Internacional de Fomento (AIF) por la cual la República Argentina suscribirá un total de ciento cincuenta y dos mil cuatrocientas sesenta y tres (152.463) acciones, que equivalen a un monto total de dólares estadounidenses tres millones ochocientos once mil quinientos treinta ocho (U$S 3.811.538), de acuerdo con lo expresado en Nota N° 140 de fecha 1° de octubre de 2010 del Ministerio de Economía y Finanzas Públicas, cuya copia autenticada se adjunta a la presente ley como Anexo V, a ser abonado mediante pagarés en tres (3) cuotas de las cuales la primer cuota se abonará a los treinta y un (31) días después de efectivizarse el instrumento y equivaldrá a la suma de dólares estadounidenses tres millones ciento noventa y ocho mil quinientos cincuenta y cuatro (U$S 3.198.554); la segunda cuota se abonará con fecha 15 de enero de 2016 y equivaldrá a la suma de dólares estadounidenses trescientos seis mil cuatrocientos noventa y dos (U$S 306.492) y la tercer cuota a abonar con fecha 15 de enero de 2026 equivaldrá a la suma de dólares estadounidenses trescientos seis mil cuatrocientos noventa y dos (U$S 306.492).
ARTÍCULO 6° — Aprúebase lo dispuesto por la Resolución N° 227 de fecha 26 de abril de 2011 de la Junta de Gobernadores de la Asociación Internacional de Fomento (AIF) denominada: ‘Aumento de los recursos: decimosexta reposición’ por la cual la República Argentina se comprometió a contribuir con dólares estadounidenses sesenta y siete millones seiscientos mil (U$S 67.600.000) realizando los pagos por medio de pagarés en tres (3) cuotas a abonar en un plazo de nueve (9) años a ejecutar entre los años 2012 y 2020, cuya copia autenticada se adjunta a la presente ley como Anexo VI.
ARTÍCULO 7° — Autorízase al Banco Central de la República Argentina, a efectuar en nombre y por cuenta de la República Argentina los aportes y suscripciones establecidos por la presente ley.
ARTÍCULO 8° — A fin de hacer frente a los pagos emergentes de la presente ley, el Banco Central de la República Argentina, deberá contar con los correspondientes aportes de contrapartida que serán proporcionados por la Secretaría de Hacienda del Ministerio de Economía y Finanzas Públicas, previa inclusión de dicha erogación en la Ley de Presupuesto General de la Administración Nacional para los ejercicios pertinentes.
ARTÍCULO 9° — Comuníquese al Poder Ejecutivo nacional.
