Por medio de la ley 27.080, promulgada por el Decreto 124/2015 -ambas normas publicadas en el B.O. del 9/02/2015-, se creó en el ámbito del Poder Judicial de la Nación, la Dirección de Control y Asistencia de Ejecución Penal, como auxiliar de la justicia federal y de la justicia nacional, cuya supervisión será ejercida por una Comisión conformada por los presidentes de la Cámara Federal de Casación Penal, de la Cámara Nacional de Casación en lo Criminal y Correccional de la Capital Federal, de la Cámara Nacional de Apelaciones en lo Criminal y Correccional Federal de la Capital Federal, de la Cámara Nacional de Apelaciones en lo Criminal y Correccional de la Capital Federal, y de la Cámara Nacional de Apelaciones en lo Penal Económico de la Capital Federal.
La Comisión deberá reglamentar la presente ley dentro de los noventa (90) días de su promulgación, y adoptar las medidas tendientes a garantizar la continuidad de la prestación de las funciones que hasta la entrada en vigencia de esta ley ejercía el Patronato de Liberados.
El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de Ley:
ARTÍCULO 1° — Créase en el ámbito del Poder Judicial de la Nación, la Dirección de Control y Asistencia de Ejecución Penal, como auxiliar de la justicia federal y de la justicia nacional, cuya supervisión será ejercida por una Comisión conformada por los presidentes de la Cámara Federal de Casación Penal, de la Cámara Nacional de Casación en lo Criminal y Correccional de la Capital Federal, de la Cámara Nacional de Apelaciones en lo Criminal y Correccional Federal de la Capital Federal, de la Cámara Nacional de Apelaciones en lo Criminal y Correccional de la Capital Federal, y de la Cámara Nacional de Apelaciones en lo Penal Económico de la Capital Federal.
ARTÍCULO 2° — La Dirección estará a cargo de un Director o Directora con título de abogado o de especialistas afines con las nuevas carreras penitenciarias y criminológicas, designado por concurso público de antecedentes y oposición, con acuerdo del Honorable Senado de la Nación, y será asesorada por un Consejo Consultivo, integrado interdisciplinariamente por psicólogos, asistentes sociales, trabajadores sociales, médicos, abogados y sociólogos. Apruébase el Anexo I que forma parte de la presente, y créanse los cargos que en el mismo se detallan, correspondientes a la estructura organizativa de la Dirección de Control y Asistencia de Ejecución Penal.
ARTÍCULO 3° — La Dirección de Control y Asistencia de Ejecución Penal tendrá las siguientes funciones: a) El control del cumplimiento de las condiciones contenidas en el auto de soltura de toda persona que haya obtenido la libertad condicional, donde actuará en colaboración con el magistrado a cargo de la ejecución de la pena; b) El control del cumplimiento de las reglas de conducta impuestas a toda persona a la que se le haya impuesto una pena de ejecución condicional; c) El seguimiento y control de las reglas de conducta impuestas a toda persona a la que se le haya otorgado la suspensión de juicio a prueba; d) La inspección y vigilancia de toda persona que se encuentre cumpliendo detención o pena con la modalidad de alojamiento domiciliario; e) Proporcionar asistencia social eficaz para las personas que egresen de establecimientos penitenciarios por el programa de libertad asistida, libertad condicional o agotamiento de pena, generando acciones que faciliten su reinserción social, familiar y laboral; f) El seguimiento y control de la ejecución de todo sistema sustitutivo de la pena que se cumpla en libertad. Intervenir como organismo de asistencia y supervisión del procesado, con sujeción a las condiciones compromisorias fijadas por el juez en el otorgamiento de la excarcelación; g) Asistir al liberado y su grupo familiar, facilitando los medios para su traslado de regreso al domicilio y trabajo; gestionando la atención de sus necesidades en los primeros días de la vida en libertad; procurando además garantizar el acceso a la educación, salud, vivienda y empleo; h) Verificar la restitución de fondos, documentos y pertenencias personales al egreso. Para el caso que alguna de las personas ingresantes al régimen previsto en la presente ley no tuviere documentación que acredite identidad o la tuviere de modo irregular, la Dirección en coordinación con el juez a cargo de la ejecución de la pena, deberá procurar la tramitación de la misma, actuando juntamente con el Registro Nacional de las Personas.
ARTÍCULO 4° — La Comisión creada en virtud del artículo 1° reglamentará la presente ley dentro de los noventa (90) días de su promulgación, y adoptará las medidas tendientes a garantizar la continuidad de la prestación de las funciones que hasta la entrada en vigencia de esta ley ejercía el Patronato de Liberados.
ARTÍCULO 5° — El desarrollo de las actividades de la Dirección debe financiarse con los recursos que anualmente determine el Presupuesto General de Gastos y Cálculo de Recursos de la Administración Nacional al programa específico que se creará para tal efecto. En consecuencia, se autoriza al Jefe de Gabinete de Ministros a realizar las adecuaciones presupuestarias necesarias para la vigencia de la presente ley.
ARTÍCULO 6° — Cláusula transitoria. Las disposiciones de la presente ley no podrán implicar en ningún caso pérdida de empleo de quienes se desempeñen actualmente dentro del Patronato de Liberados. Asimismo, la incorporación a la Dirección de Control y Asistencia de Ejecución Penal de tales empleados, se hará exceptuándolos de todo concurso público que exija para su ingreso el Poder Judicial de la Nación.
ARTÍCULO 7° — Comuníquese al Poder Ejecutivo nacional.
