La aludida Comisión, creada mediante ley 27.103 (B.O. 23/1/2015), será continuadora de la Comisión Nacional de Museos y de Monumentos y Lugares Históricos, dependiente del organismo que determine el Poder Ejecutivo nacional.
En virtud de ello, se efectuaron una serie de modificaciones a la ley 12.665, creadora de la aludida Comisión. A continuación se transcriben tales las modificaciones:
«ARTÍCULO 2° — Incorpórese, a continuación del artículo 1° de la ley 12.665, como artículo 1° bis, el siguiente: ‘Artículo 1°.- bis: La Comisión Nacional será integrada por un presidente y diez (10) vocales, designados por el Poder Ejecutivo nacional, que durarán en sus cargos seis (6) años, pudiendo ser reelectos.’
ARTÍCULO 3° — Incorpórese, a continuación del artículo 1° de la ley 12.665, como artículo 1° ter el siguiente:
Artículo 1° ter: Son atribuciones de la comisión: a) Ejercer la superintendencia inmediata sobre los monumentos, lugares y bienes históricos nacionales y demás bienes protegidos en los términos de la presente ley, en concurrencia con las respectivas autoridades locales, cuando se trate de monumentos, lugares y bienes del dominio provincial o municipal; b) Proponer al Poder Ejecutivo nacional la declaratoria de monumentos, lugares y bienes históricos nacionales, y demás bienes protegidos en los términos de la presente ley, indicando con precisión el perímetro del área protegida conforme las clases enunciadas en la presente ley; c) Establecer, revisar y actualizar criterios y pautas de selección, clasificación y valoración para los monumentos, lugares y bienes protegidos; d) A solicitud del Congreso de la Nación, designar expertos para evaluar los méritos históricos artísticos, arquitectónicos, industriales o arqueológicos del monumento, lugar o bien sometido a opinión, quienes expedirán su dictamen por escrito, no vinculante, en el plazo establecido por la comisión. Dicho dictamen será refrendado por la comisión; e) Designar delegados en base a una terna vinculante remitida por los gobiernos provinciales y la Ciudad Autónoma de Buenos Aires, con asiento en los respectivos distritos, y por sí, subdelegados locales, asesores consultos, honorarios y eméritos; f) Organizar mecanismos de representación regional y federal; g) Establecer “áreas de amortiguación” en el entorno de los monumentos, coordinando con la autoridad local las restricciones urbanísticas que correspondan; h) Establecer los alcances y límites de la protección inherente a cada declaratoria; i) Recomendar al Poder Ejecutivo que impulse ante el Congreso Nacional la declaración de utilidad pública de los inmuebles que así lo ameriten; j) Llevar un registro público de los bienes protegidos según su clase; k) Intervenir con carácter previo y vinculante en toda transacción, transferencia de dominio, gravamen u otra modificación del estatus jurídico de un bien protegido; l) Intervenir con carácter previo y vinculante, aprobar o rechazar, y supervisar toda intervención material sobre los bienes protegidos; m) Proponer al Poder Ejecutivo nacional la adquisición de bienes de particulares cuando sea de interés público su ingreso al dominio del Estado nacional; n) Realizar por sí o auspiciar publicaciones de las materias de su competencia; o) Organizar, auspiciar o participar en congresos, seminarios, encuentros, jornadas, programas periodísticos y toda otra actividad de difusión de sus competencias; p) Proponer al Poder Ejecutivo nacional la aceptación de herencias, legados y donaciones vinculadas a la materia de esta ley; q) Aceptar y recibir subsidios y aportes en dinero o en especie; r) Celebrar convenios de cooperación con entidades públicas o privadas, nacionales o internacionales, gubernamentales o no gubernamentales.
ARTÍCULO 4° — Sustitúyese el artículo 2° de la ley 12.665 por el siguiente: ‘Artículo 2°.- Los monumentos, lugares y bienes protegidos, que sean de propiedad de la Nación, de las provincias, la Ciudad Autónoma de Buenos Aires o de los municipios, quedan sometidos por esta ley a la custodia y conservación del Estado nacional y, en su caso, en concurrencia con las autoridades locales. La Comisión Nacional podrá gestionar o apoyar las gestiones de terceros ante organismos públicos o privados, para la obtención de créditos de fomento para la conservación de los bienes declarados, en cualquiera de sus clases.’
ARTÍCULO 5° — Sustitúyese el artículo 3° de la ley 12.665 por el siguiente: ‘Artículo 3°.- La Comisión Nacional podrá celebrar con los propietarios de los bienes declarados acuerdos a fin de determinar el modo cooperativo de asegurar el cumplimiento de los fines patrióticos de la ley. Si la conservación del lugar o monumento implicase una limitación al dominio, el Poder Ejecutivo indemnizará al propietario en su caso, y en la medida de dicha limitación.’
ARTÍCULO 6° — Sustitúyese el artículo 3° bis de la ley 12.665 por el siguiente: ‘Artículo 3° bis.- Ante iniciativa presentada en el Congreso de la Nación para declarar como protegido en los términos del artículo 4° de la presente ley un bien ubicado en cualquier jurisdicción de la República Argentina, corresponde la consulta previa a la Comisión Nacional de Monumentos, de Lugares y de Bienes Históricos, la cual emitirá su dictamen de carácter no vinculante, señalando la clasificación que en su opinión corresponde otorgar y todo otro alcance de la declaratoria.’
ARTÍCULO 7° — Sustitúyese el artículo 4° de la ley 12.665 por el siguiente:
Artículo 4°.- Corresponde a la Comisión Nacional llevar un registro público de los bienes protegidos, enunciados en las siguientes clases: 1. Monumento histórico nacional. 2. Lugar histórico nacional. 3. Poblado histórico nacional. 4. Área urbana histórica nacional. 5. Área de amortiguación visual. 6. Bien de interés histórico nacional. 7. Bien de interés artístico nacional. 8. Bien de interés arquitectónico nacional. 9. Bien de interés industrial nacional. 10. Bien de interés arqueológico nacional. 11. Sepulcro histórico nacional. 12. Paisaje cultural nacional. 13. Itinerario cultural nacional.
ARTÍCULO 8° — Sustitúyese el artículo 5º de la ley 12.665 por el siguiente: ‘Artículo 5°.- Los bienes protegidos en los términos de esta ley no podrán ser vendidos, ni gravados ni enajenados por cualquier título o acto, ni modificado su estatus jurídico, sin la intervención previa de la Comisión Nacional. La Comisión Nacional emitirá su dictamen vinculante dentro del plazo de sesenta (60) días hábiles computados a partir de la fecha en que el o los interesados soliciten la autorización. Queda expresamente prohibida la salida del territorio nacional de bienes protegidos, sean bienes muebles o inmuebles por accesión, sin la previa intervención y autorización de la Comisión Nacional, en los mismos términos dispuestos en el párrafo anterior.’
ARTÍCULO 9° — Sustitúyese el artículo 7° de la ley 12.665 por el siguiente: ‘Artículo 7°.- Los recursos para el funcionamiento de la Comisión Nacional de Monumentos, de Lugares y de Bienes Históricos estarán constituidos por una suma anual imputada a la partida del presupuesto general de gastos y cálculo de recursos de la administración nacional correspondiente al organismo que el Poder Ejecutivo nacional determine, en los términos del artículo 1° de la presente.’
ARTÍCULO 10. — Sustitúyese el artículo 8° de la ley 12.665 por el siguiente:
Artículo 8°.- El que infringiera la presente ley mediante ocultamiento, omisión, destrucción, alteración, transferencia o gravamen, exportación o cualquier otro acto material o jurídico practicado sobre bienes protegidos será sancionado con multa, cuyo valor se establecerá entre un mínimo de diez por ciento (10 %) hasta tres veces el valor del bien o los bienes que hayan motivado la conducta sancionada. Para la determinación de la multa se atenderá a la gravedad de la falta cometida y al carácter de reincidente del infractor. Los montos percibidos en concepto de multa serán destinados a las partidas presupuestarias asignadas a la Comisión Nacional. Las multas establecidas en el párrafo anterior serán aplicadas siempre que el hecho no se encontrase encuadrado en el tipo penal establecido en el artículo 184, inciso 5, del Código Penal. En caso de alteración total o parcial de fachadas u otras áreas de máxima tutela de un edificio declarado monumento histórico nacional, o de una parte sustancial de cualquier otro bien protegido en el marco de la presente ley, el propietario, a su costo, deberá restituirlo a su estado original en plazo perentorio establecido por la Comisión Nacional. Fenecido dicho plazo sin novedad, se aplicará una multa fijada a criterio de la Comisión Nacional, por cada día de demora en la reconstrucción.’
ARTÍCULO 11. — Sustitúyese el artículo 9° de la ley 12.665 por el siguiente:
Artículo 9°.- El Poder Ejecutivo reglamentará la presente ley dentro de los noventa (90) días de su publicación.
ARTÍCULO 12. — Derógase el artículo 4° bis de la ley 12.665.
ARTÍCULO 13. — Comuníquese al Poder Ejecutivo nacional.
