Por medio del Decreto 22/2015, publicado en el Boletín Oficial dle 14/01/2015, se reglamentó la ley 26.873 que tiene por objeto la promoción y la concientización pública acerca de la importancia de la lactancia materna y de las prácticas óptimas de nutrición segura para lactantes y niños de hasta dos (2) años.
LA PRESIDENTA DE LA NACIÓN ARGENTINA DECRETA:
Artículo 1° — Apruébase la reglamentación de la Ley N° 26.873 que como ANEXO I forma parte integrante del presente Decreto.
Art. 2° — Facúltase al MINISTERIO DE SALUD para dictar las normas complementarias y aclaratorias que fueren menester para la aplicación de la reglamentación que se aprueba por el presente.
Art. 3° — El presente decreto entrará en vigencia a partir del día siguiente de su publicación en el Boletín Oficial.

ANEXO I
REGLAMENTACIÓN DE LA LEY N° 26.873
TITULO I
DISPOSICIONES GENERALES
ARTICULO 1°.- Se entiende por promoción y concientización pública de la lactancia materna a todas las actividades enumeradas en el artículo 4° de la Ley objeto de reglamentación y a todas aquellas que la Autoridad de Aplicación considere oportuno establecer.
ARTICULO 2°.-
- a) Se entiende que la lactancia materna exclusiva hasta los SEIS (6) meses de edad del niño resulta la más adecuada alimentación del mismo, entendiéndose por tal a la alimentación con leche humana exclusiva e incluyéndose en dicho género a aquella administrada tanto directamente del pecho materno como a aquella extraída del mismo.
Las prácticas óptimas de alimentación constituyen otro medio de alimentación exclusivamente prescripto por un profesional médico para aquellos casos en que la lactancia materna esté médicamente contraindicada según la recomendación vigente de la ORGANIZACIÓN MUNDIAL DE LA SALUD al respecto.
- b) Se entiende por lactancia materna continuada a la lactancia materna más allá de los CIENTO OCHENTA (180) días de vida cumplidos.
Se entiende por alimentación complementaria oportuna a la introducción de alimentos líquidos o sólidos a fin de complementar la lactancia para cubrir los requerimientos nutricionales, a partir de los CIENTO OCHENTA (180) días de vida cumplidos.

- d) Se entiende por Centro de Lactancia Materna al espacio dentro del ámbito asistencial exclusivo para la extracción y conservación de leche materna. Su misión es asegurar la alimentación con leche de la propia madre a todos los niños nacidos o ingresados en la institución.
Se entiende por Banco de Leche Materna al servicio especializado, responsable de la recolección, transporte, procesamiento, control de calidad, conservación y distribución de la leche humana.
ARTICULO 3°.- El MINISTERIO DE SALUD como Autoridad de Aplicación de la Ley que se reglamenta, llevará a cabo las acciones preceptuadas por la misma a través de la Dirección Nacional de Maternidad e Infancia dependiente de la SUBSECRETARÍA DE MEDICINA COMUNITARIA, MATERNIDAD E INFANCIA de la SECRETARÍA DE SALUD COMUNITARIA.

ARTICULO 4°.-

c) Se entiende por promover el apoyo nutricional a las acciones de educación alimentaria nutricional y a la derivación oportuna de inquietudes generadas al respecto, a las redes de apoyo sanitario y/o social de carácter nacional, provincial o municipal ya sean públicas, privadas o de organizaciones no gubernamentales.
d) La difusión de la importancia de los beneficios de la lactancia materna deberá ser llevada a cabo incluyendo además los riesgos de la alimentación artificial.
e) Se entiende por alimento sucedáneo de la leche materna a todo alimento comercializado o de otro modo presentado como sustitutivo parcial o total de la leche materna.
Se entiende por alimento complementario a todo alimento o bebida, manufacturado o preparado en forma casera, que se utilice como complemento de la leche materna a partir de los CIENTO OCHENTA (180) días de vida cumplidos.
f) Los programas de capacitación y/o formación profesional en lactancia materna incluirán el conocimiento, difusión y alcance de los contenidos de la Ley que se reglamenta.

k) La promoción de provisión de leche materna aludida en este inciso, se realizará a través de las acciones de promoción de la lactancia materna destinadas a la población general y a través de las acciones de promoción vinculadas a los bancos de leche materna y centros de la lactancia materna. A los efectos de la presente reglamentación se entiende por circunstancias específicas a aquellas situaciones de emergencia, catástrofes (naturales o causadas por el hombre), separación de la madre y su hijo lactante por razones médicas o cualquier otra circunstancia que imposibilite el acceso del niño a la leche materna en forma directa desde el pecho materno.

m) Se promoverá la provisión de adecuados alimentos sucedáneos y complementarios, a través de guías alimentarias y la derivación oportuna de inquietudes generadas a su respecto, a las redes de apoyo sanitario y/o social de carácter nacional, provincial, municipal o de la Ciudad Autónoma de Buenos Aires ya sean públicas, privadas u organizaciones no gubernamentales.
n) A los efectos de la difusión del Código Internacional de Comercialización de Sucedáneos de la Leche Materna, se entiende que el alcance del mismo en los términos de la presente Ley, es hasta los DOS (2) primeros años de edad del niño.

p) El MINISTERIO DE SALUD a través de la Dirección Nacional de Maternidad e Infancia dependiente de la SUBSECRETARIA DE MEDICINA COMUNITARIA, MATERNIDAD E INFANCIA de la SECRETARIA DE SALUD COMUNITARIA, promoverá que se realice un relevamiento anual, en los efectores de salud públicos y/o privados de la situación de la lactancia materna mediante los indicadores propuestos por la ORGANIZACIÓN MUNDIAL DE LA SALUD en las provincias y la CIUDAD AUTÓNOMA DE BUENOS AIRES, así como también, procurará que la situación de la lactancia sea incorporada a otros relevamientos de salud.
