Creación. Objetivo.
Bs. As., 3/10/2014
VISTO el Expediente Nº 0049806/2014 del Registro de la JEFATURA DE GABINETE DE MINISTROS; y CONSIDERANDO: Que, en el marco de la política federal de mejora de las competencias de los Gobiernos Provinciales implementada por el ESTADO NACIONAL, se ha decidido la creación de un programa de fortalecimiento de las capacidades operativas de áreas de particular sensibilidad como son las de salud pública y seguridad ciudadana, que se denominará “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD”. Que dicho Programa consistirá en el otorgamiento de financiamiento a las Provincias y a la Ciudad Autónoma de Buenos Aires para la renovación y/o ampliación del parque automotor de las áreas de seguridad y salud a través de la adquisición de ambulancias y vehículos policiales, en condiciones favorables de plazo e interés del financiamiento a otorgar. Que esta medida, a propuesta de la JEFATURA DE GABINETE DE MINISTROS, se cumplirá a través de la constitución de un fideicomiso, que se denominará “Fondo para el Fortalecimiento Operativo Federal”, cuyo patrimonio fideicomitido provendrá del Tesoro Nacional. Que la JEFATURA DE GABINETE DE MINISTROS interviene en la coordinación de las actividades de los Ministerios y de las distintas áreas a su cargo a fin de alcanzar un coherente accionar de la administración e incrementar su eficacia. Que el MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS entiende en el análisis y diseño de políticas públicas con miras a la Planificación del Desarrollo Nacional de mediano y largo plazo, en articulación con los respectivos planes estratégicos sectoriales y territoriales. Que el MINISTERIO DE INDUSTRIA tiene a su cargo la definición de la política de fomento de la producción industrial y la formulación de políticas y programas de desarrollo destinados a la promoción y fortalecimiento de la industria nacional, como también la elaboración de los regímenes de promoción y protección de actividades económicas y de los instrumentos que los concreten, así como en la elaboración, ejecución y fiscalización de los mismos en su área. Que las facultades y funciones del MINISTERIO DE SALUD incluyen la fiscalización del funcionamiento de los servicios, establecimientos e instituciones relacionadas con la salud, la coordinación, articulación y complementación de sistemas de servicios de salud estatales del ámbito nacional, provincial y municipal, como así la formulación, promoción y ejecución de planes tendientes a la reducción de inequidades en las condiciones de salud de la población, mediante el establecimiento de mecanismos participativos y la construcción de consensos a nivel federal. Que el MINISTERIO DE SEGURIDAD tiene a su cargo entender en la organización, doctrina, despliegue, equipamiento y esfuerzos operativos de las Fuerzas de Seguridad y de las Fuerzas Policiales y coordinar la formulación de planes de mediano y largo plazo de capacitación, inversión, equipamiento y bienestar de las fuerzas, en el marco del sistema de seguridad interior. Que para facilitar la ejecución y la toma de decisiones relativas al funcionamiento del mencionado Fondo, resulta necesario crear un COMITE EJECUTIVO que será el encargado de fijar las condiciones, impartir instrucciones y/o autorizar en forma previa las actividades a cargo del FIDUCIARIO y efectuar su seguimiento. Que en virtud de lo expuesto el citado Comité estará conformado por UN (1) representante titular y UN (1) representante suplente de las Carteras citadas, interviniendo los representantes de los MINISTERIOS DE SEGURIDAD y DE SALUD, exclusivamente en las decisiones relacionadas con materias de su competencia. Que, por otra parte, se encomendará a NACION FIDEICOMISOS S.A. la administración del Fondo creado, en carácter de FIDUCIARIO, de acuerdo con las instrucciones que le imparta el COMITE EJECUTIVO, por ser una sociedad con amplia experiencia en la administración de fondos fiduciarios que aportan fortaleza, seguridad y compromiso con el desarrollo económico nacional. Que, asimismo, resulta procedente designar al MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS como AUTORIDAD DE APLICACION, facultándolo para dictar las medidas aclaratorias y complementarias que fueren menester, establecer las condiciones del financiamiento, así como también aprobar y suscribir el correspondiente Contrato de Fideicomiso. Que a los efectos de lograr el cumplimiento de los objetivos buscados, corresponde invitar a las Provincias y a la Ciudad Autónoma de Buenos Aires para que manifiesten su intención de ingresar al Programa que por el presente se crea, fundando sus necesidades iniciales. Que esta iniciativa se encuadra en el esquema de medidas fiscales contracíclicas que promueven la inversión pública y que están siendo implementadas con el objetivo de sostener el nivel de actividad y el empleo en la economía nacional. Que la naturaleza excepcional de la situación planteada hace imposible seguir los trámites ordinarios previstos en la CONSTITUCION NACIONAL para la sanción de las leyes, verificándose los presupuestos constitucionales y jurisprudenciales que habilitan el dictado del presente decreto. Que la Ley Nº 26.122 regula el trámite y los alcances de la intervención del HONORABLE CONGRESO DE LA NACION respecto de los Decretos de Necesidad y Urgencia dictados por el PODER EJECUTIVO NACIONAL, en virtud de lo dispuesto por el Artículo 99 inciso 3 de la CONSTITUCION NACIONAL. Que la citada ley determina que la COMISION BICAMERAL PERMANENTE del HONORABLE CONGRESO DE LA NACION tiene competencia para pronunciarse respecto de la validez o invalidez de los Decretos de Necesidad y Urgencia, así como elevar el dictamen al plenario de cada Cámara para su expreso tratamiento, en el plazo de DIEZ (10) días hábiles, conforme lo establecido en el artículo 19 de dicha norma. Que el Artículo 20 de la Ley Nº 26.122 prevé que, en el supuesto que la Comisión Bicameral Permanente no eleve el correspondiente despacho, las Cámaras se abocarán al expreso e inmediato tratamiento del decreto, de conformidad con lo establecido en los Artículos 99, inciso 3 y 82 de la CONSTITUCION NACIONAL. Que por su parte, el artículo 22 de la citada ley dispone que las Cámaras se pronuncien mediante sendas resoluciones y que el rechazo o aprobación de los decretos deberá ser expreso conforme lo establecido en el Artículo 82 de la Carta Magna. Que han tomado la intervención correspondiente los Servicios Jurídicos competentes. Que la presente medida se dicta en virtud de las atribuciones emergentes del Artículo 99, inciso 3 de la CONSTITUCION NACIONAL y de acuerdo con los Artículos 2°, 19 y 20 de la Ley Nº 26.122. Por ello,
LA PRESIDENTA DE LA NACION ARGENTINA EN ACUERDO GENERAL DE MINISTROS DECRETA:
Artículo 1° — Créase el “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD”, que consistirá en el otorgamiento de financiamiento a las Provincias y a la Ciudad Autónoma de Buenos Aires, para la renovación y/o ampliación del parque automotor de las áreas de seguridad y salud, a través de la adquisición de ambulancias y vehículos policiales.
Art. 2° — Para el cumplimiento del objetivo establecido en el Artículo 1°, créase el Fondo Fiduciario Público que se denominará “FONDO PARA EL FORTALECIMIENTO OPERATIVO FEDERAL” y regirá en todo el territorio de la REPUBLICA ARGENTINA, con los alcances establecidos en el presente decreto y en las normas reglamentarias que, en consecuencia, dicte el PODER EJECUTIVO NACIONAL o, en su caso, la Autoridad de Aplicación.
Art. 3° — A los efectos del presente decreto, los siguientes términos tendrán el significado que, a continuación, se indica: a) FIDUCIANTE: Es el ESTADO NACIONAL, a través del MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS, en cuanto transfiere la propiedad fiduciaria de los BIENES FIDEICOMITIDOS al FIDUCIARIO con el destino exclusivo e irrevocable al cumplimiento del presente decreto y del contrato de fideicomiso respectivo. b) FIDUCIARIO: Es NACION FIDEICOMISOS S.A., como administrador de los bienes que se transfieren en fideicomiso con el destino exclusivo e irrevocable que se establece en la presente norma, cuya función será administrar los recursos del FIDEICOMISO, de conformidad con las pautas establecidas en el Contrato de Fideicomiso y las instrucciones dispuestas por el COMITE EJECUTIVO. c) BENEFICIARIOS: Son las Provincias y la Ciudad Autónoma de Buenos Aires, en tanto hubieren oportunamente adherido al Programa que por el presente decreto se crea. d) FIDEICOMISARIO: El ESTADO NACIONAL será el destinatario final de los fondos integrantes del “FONDO PARA EL FORTALECIMIENTO OPERATIVO FEDERAL” en caso de su extinción o liquidación, los cuales deberán destinarse a programas con objetivos similares a los del presente decreto. e) AUTORIDAD DE APLICACION: Es el MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS. f) COMITE EJECUTIVO: Estará compuesto por los representantes mencionados en el Artículo 6° del presente. Es el encargado de fijar las condiciones, impartir instrucciones y/o autorizar en forma previa las actividades a cargo del FIDUCIARIO y efectuar su seguimiento. En ese marco, tendrá las siguientes funciones: (i) Aprobar o rechazar las solicitudes de equipamiento con financiamiento que le fueren remitidas para su consideración por la AUTORIDAD DE APLICACION; (ii) Establecer las especificaciones para la elaboración de los pliegos de bases y condiciones particulares para las distintas contrataciones, de acuerdo con la evaluación de las necesidades y capacidad financiera de cada uno de los beneficiarios, definiendo el orden de prelación de la entrega de bienes a adquirirse; (iii) Aprobar los pliegos elaborados por el FIDUCIARIO, de conformidad con las especificaciones técnicas oportunamente indicadas; (iv) Convalidar la decisión respecto de la oferta más conveniente; (v) Establecer los mecanismos pertinentes para que los automotores adquiridos con recursos del Fondo sean de origen nacional. A tal fin, el MINISTERIO DE INDUSTRIA constatará que las unidades ofrecidas cumplan con el requisito de origen. g) BIENES FIDEICOMITIDOS: Serán recursos por un monto de PESOS MIL MILLONES ($ 1.000.000.000) aportados por el Tesoro Nacional, que podrá ser oportunamente ampliado. h) CONTRATO DE MUTUO: El FONDO FIDUCIARIO PUBLICO suscribirá contratos de mutuo con las jurisdicciones adherentes a medida que sus solicitudes hubieren sido aprobadas. La monetización de los contratos de mutuo será realizada exclusivamente mediante el pago de las facturas emitidas por quienes resultaren adjudicatarios en los procedimientos de selección destinados a proveer los bienes incluidos en el Programa que por el presente decreto se crea. i) CONDICIONES DEL FINANCIAMIENTO: Serán las establecidas por la AUTORIDAD DE APLICACION.
Art. 4° — Las jurisdicciones deberán manifestar su intención de ingresar al “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD”, en un plazo de TREINTA (30) días corridos, contados a partir de la publicación de la presente medida, junto con un detalle fundado de sus necesidades iniciales.
Art. 5° — Aquellas jurisdicciones que hubieren manifestado su intención de ingresar al “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD”, contarán con un plazo máximo de SESENTA (60) días corridos desde la publicación de la reglamentación del presente, para adherirse al citado Programa y obtener la correspondiente aprobación de sus respectivas Legislaturas, la cual deberá contener: (i) La autorización de endeudamiento en el marco del presente y, para garantizar el cumplimiento de las obligaciones de reembolso del financiamiento contraído, la cesión irrevocable a favor del FIDEICOMISO de sus derechos sobre las sumas a percibir por el Régimen de Coparticipación Federal de Impuestos, de acuerdo a lo establecido en los artículos 1°, 2° y 3° del ACUERDO NACION-PROVINCIAS SOBRE RELACION FINANCIERA Y BASES DE UN REGIMEN DE COPARTICIPACION FEDERAL DE IMPUESTOS, ratificado por la Ley Nº 25.570, o el régimen que lo sustituya, hasta la total cancelación del capital solicitado más sus intereses; (ii) La adhesión en los términos del Artículo 11 del presente decreto; (iii) La aceptación expresa de los procedimientos de selección de proveedores que dispusiera el FIDUCIARIO, de conformidad con las pautas establecidas y las instrucciones dispuestas por el COMITE EJECUTIVO.
Art. 6° — Créase el COMITE EJECUTIVO del “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD” que estará integrado por UN (1) representante titular y UN (1) suplente, designados por los titulares de las Carteras que, a continuación, se detallan: a) JEFATURA DE GABINETE DE MINISTROS, b) MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS, c) MINISTERIO DE INDUSTRIA, d) MINISTERIO DE SALUD, e) MINISTERIO DE SEGURIDAD. La Presidencia del COMITE EJECUTIVO será ejercida por el representante del MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS. Las reparticiones ministeriales citadas en los incisos d) y e) intervendrán exclusivamente en las decisiones relacionadas con materias de su competencia.
Art. 7° — Desígnase como AUTORIDAD DE APLICACION del “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD” al MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS, el que en tal carácter podrá dictar las medidas aclaratorias y complementarias que fueren menester, debiendo establecer los términos del contrato de fideicomiso y aprobarlo, en un plazo no mayor a los CUARENTA Y CINCO (45) días de la publicación del presente.
Art. 8° — El “FONDO PARA EL FORTALECIMIENTO OPERATIVO FEDERAL” creado por el Artículo 2° del presente decreto no se encuentra comprendido en las disposiciones del inciso d) del Artículo 8° de la Ley de Administración Financiera y de los Sistemas de Control del Sector Público Nacional Nº 24.156 y sus modificaciones, sin perjuicio de las facultades de control que dicha norma les otorga a la SINDICATURA GENERAL DE LA NACION y a la AUDITORIA GENERAL DE LA NACION.
Art. 9° — El Fideicomiso tendrá una duración de DIEZ (10) años, renovable, contados desde la integración de los bienes fideicomitidos. No obstante ello, el FIDUCIARIO conservará los recursos suficientes para atender los compromisos pendientes, reales o contingentes, que haya asumido el “FONDO PARA EL FORTALECIMIENTO OPERATIVO FEDERAL” hasta la fecha de extinción de esas obligaciones. Al vencimiento del plazo establecido en el párrafo precedente, todos los bienes fideicomitidos que integren el patrimonio del citado Fondo en ese momento serán transferidos al ESTADO NACIONAL, en su carácter de FIDEICOMISARIO, los cuales deberán destinarse a programas con objetivos similares a los del presente decreto.
Art. 10. — Exímese al “FONDO PARA EL FORTALECIMIENTO OPERATIVO FEDERAL” y al FIDUCIARIO en las operaciones relativas al objeto del fideicomiso que se autoriza a constituir por el presente, de todos los impuestos, tasas y contribuciones nacionales existentes y a crearse. Esta exención comprende a los impuestos creados por las Leyes Nros. 20.628, 23.349, 24.674 y 25.413. La exención de impuestos internos comprende a los bienes adquiridos en el marco del “PROGRAMA FEDERAL DE FORTALECIMIENTO OPERATIVO DE LAS AREAS DE SEGURIDAD Y SALUD”.
Art. 11. — Invítase a las Provincias y a la Ciudad Autónoma de Buenos Aires a adherir a la eximición de todos los tributos aplicables en su jurisdicción en iguales términos a los establecidos en el artículo anterior.
Art. 12. — Instrúyese al señor Jefe de Gabinete de Ministros para que disponga las adecuaciones presupuestarias pertinentes, a través de la reasignación de partidas del Presupuesto Nacional, a los efectos de poner en ejecución lo dispuesto por el presente decreto.
Art. 13. — Las erogaciones que demande el cumplimiento del Programa creado por el artículo 1° serán atendidas con recursos del Tesoro Nacional e imputadas a la Jurisdicción 50 – MINISTERIO DE ECONOMIA Y FINANZAS PUBLICAS, según la naturaleza del gasto y la redistribución que, al efecto, se realice.
Art. 14. — Facúltase a la AUTORIDAD DE APLICACION y/o a quien ésta designe en su reemplazo a suscribir el Contrato de Fideicomiso con el FIDUCIARIO.
Art. 15. — El COMITE EJECUTIVO dictará su propio reglamento interno de funcionamiento dentro de los TREINTA (30) días de la publicación de la presente medida.
Art. 16. — El presente decreto entrará en vigencia a partir de su publicación en el Boletín Oficial.
Art. 17. — Dése cuenta a la COMISION BICAMERAL PERMANENTE del HONORABLE CONGRESO DE LA NACION.
