Acordada 15/2015
Acordada N° 11/2015. Declaración. Expediente N° 4034/00
En Buenos Aires, a los 13 días del mes de mayo del año 2015, los señores Ministros que suscriben la presente, CONSIDERARON: Que mediante las acordadas N° 19 del 16 de octubre de 2012 y N° 11 del 21 de abril de 2015, esta Corte designó a los miembros que actualmente se desempeñan como Presidente y Vicepresidenta, y la continuidad de dichas autoridades a partir del primero de enero de 2016. Que esas designaciones fueron efectuadas con arreglo a la tradición más antigua en el ejercicio de esta atribución y reconocida por ley (ley 13.998, de 1950, art. 21; decreto ley 1285/58, ratificado por ley 14.467, art. 21), y que se ha mantenido inalterada en todas las composiciones de esta Corte hasta la presente fecha. Que con particular referencia a la elección de las autoridades que se desempeñarían a partir del 1° de enero de 2016, en el acuerdo ordinario celebrado por el Tribunal el 14 de abril de 2015 los cuatro ministros presentes deliberaron, inicialmente, sobre la necesidad de proceder a llevar a cabo esas designaciones, concordando en una respuesta afirmativa; decisión que se sustentó en una prudente ponderación de razones de diversa naturaleza, concernientes tanto a la seguridad jurídica —con la consecuente previsibilidad— en el Gobierno del Poder Judicial en el marco de sus relaciones institucionales con los otros Poderes de la Nación, con las Autoridades de Provincia y con la Sociedad Civil; como en preservar y profundizar la ingente actuación que la Corte viene llevando a cabo en defensa de la necesaria independencia del Poder Judicial que exige el sistema republicano de gobierno. Que tras esa definición, en el acuerdo del mencionado 14 de abril, los jueces y la jueza que integran el Tribunal deliberaron y consideraron diversas propuestas sobre las autoridades a designar, concluyendo en el modo que instrumenta la acordada suscripta por todos los miembros el día del siguiente acuerdo ordinario del Tribunal, celebrado el 21 de abril de 2015. Que en supuestos extremos el Tribunal ha cumplido en corregir, mediante la adecuada declaración de nulidad, situaciones resultantes de la falta del debido acuerdo que exige el dictado de sus sentencias y otra clase de decisiones (Fallos 233:172 y 293:698), al no haber participado ni ser debidamente citados todos sus miembros al acuerdo respectivo. Que esos antecedentes carecen de toda analogía con la situación que dio lugar a la acordada N° 11/2015, en la medida en que ella fue precedida del acuerdo celebrado por todos los miembros del Tribunal, a la par que da cuenta fidedigna de la deliberación llevada a cabo y de los resultados obtenidos, siendo indiferente para su validez el lugar de la Ciudad de Buenos Aires en que fue en definitiva firmada por los ministros y por la señora ministra, en la medida en que ha sido una práctica inveterada del Tribunal —mantenida hasta su última composición— la irrelevancia de que sus decisiones tomadas con arreglo a las normas establecidas fuesen suscriptas dentro o fuera del Salón de Acuerdos del Tribunal. Por ello,
