Por medio de la ley 27.412, publicada en el Boletín Oficial del 15/12/17, se modificó el Código Electoral Nacional promoviendo la paridad de género en ámbitos de representación política. Se modificó el artículo 60 bis del Capítulo III Oficialización de la lista de candidatos, el artículo 157 del Capítulo II de la elección de Senadores Nacionales, el artículo 164 del Capítulo III de los Diputados Nacionales, el artículo 164 o. del Capítulo IV De los parlamentarios del Mercosur, el inciso a) del artículo 26, del Capítulo III Presentación y oficialización de listas, del Título II Primarias abiertas, simultáneas y obligatorias, de la ley 26.571, de Democratización de la Representación Política, la Transparencia y la Equidad Electoral, el inciso b) del artículo 3° del Título I Principios Generales, de la ley 23.298, Orgánica de los Partidos Políticos, el artículo 21 del Capítulo I De la carta orgánica y plataforma electoral y se incorporó un inciso h) al artículo 50 del Título VI de la caducidad y extinción de los partidos, de la ley 23.298, Orgánica de los Partidos Políticos.

Código Electoral Nacional. Modificación.
El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de
Ley:
PARIDAD DE GÉNERO EN ÁMBITOS DE REPRESENTACIÓN POLÍTICA
ARTÍCULO 1°.- Modifíquese el artículo 60 bis del Capítulo III Oficialización de la lista de candidatos, del Título III De los actos preelectorales, del Código Electoral Nacional, el que quedará redactado de la siguiente forma:
Artículo 60 bis: Requisitos para la oficialización de las listas. Las listas de candidatos/as que se presenten para la elección de senadores/as nacionales, diputados/as nacionales y parlamentarios/as del Mercosur deben integrarse ubicando de manera intercalada a mujeres y varones desde el/la primer/a candidato/a titular hasta el/la último/a candidato/a suplente.
Las agrupaciones políticas que hayan alcanzado en las elecciones primarias el uno y medio por ciento (1,5%) de los votos válidamente emitidos en el distrito de que se trate, deberán presentar una sola lista por categoría, no admitiéndose la coexistencia de listas aunque sean idénticas entre las alianzas y los partidos que las integran.
Las agrupaciones políticas presentarán, juntamente con el pedido de oficialización de listas, datos de filiación completos de sus candidatos/as, el último domicilio electoral y una declaración jurada suscrita individualmente por cada uno/a de los/as candidatos/as, donde se manifieste no estar comprendido/a en ninguna de las inhabilidades previstas en la Constitución Nacional, en este Código, en la Ley Orgánica de los Partidos Políticos, en la Ley de Financiamiento de los Partidos Políticos y en el Protocolo Constitutivo del Parlamento del Mercosur.
Los/as candidatos/as pueden figurar en las listas con el nombre o apodo con el cual son conocidos/as, siempre que la variación del mismo no sea excesiva ni dé lugar a confusión a criterio del juez.
No será oficializada ninguna lista que no cumpla estos requisitos, ni que incluya candidatos/as que no hayan resultado electos/as en las elecciones primarias por la misma agrupación y por la misma categoría por la que se presentan, salvo el caso de renuncia, fallecimiento o incapacidad del candidato/a presidencial de la agrupación de acuerdo a lo establecido en el artículo 61.
ARTÍCULO 2°.- Modifíquese el artículo 157 del Capítulo II de la elección de Senadores Nacionales, del Título VII Sistema Nacional Electoral, del Código Electoral Nacional, el que quedará redactado de la siguiente forma:
Artículo 157: El escrutinio de cada elección se practicará por lista sin tomar en cuenta las tachas o sustituciones que hubiere efectuado el votante.
Resultarán electos los dos (2) titulares correspondientes a la lista del partido o alianza electoral que obtuviere la mayoría de los votos emitidos y el/la primero/a de la lista siguiente en cantidad de votos. El/la segundo/a titular de esta última lista será el/a primer/a suplente del Senador que por ella resultó elegido/a.
En caso de muerte, renuncia, separación, inhabilidad o incapacidad permanente de un/a senador/a nacional de la lista que hubiere obtenido la mayoría de votos emitidos lo/la sustituirá el/la senador/a suplente de igual sexo. Si no quedaran mujeres en la lista, se considerará la banca como vacante y será de aplicación el artículo 62 de la Constitución Nacional.
En caso de muerte, renuncia, separación, inhabilidad o incapacidad permanente de un/a senador/a nacional de la lista que hubiere resultado siguiente en cantidad de votos emitidos, será sustituido/a por el/la suplente por su orden.
ARTÍCULO 3°.- Modifíquese el artículo 164 del Capítulo III de los Diputados Nacionales, del Título VII Sistema Nacional Electoral, del Código Electoral Nacional, el que quedará redactado de la siguiente forma:
Artículo 164: En caso de muerte, renuncia, separación, inhabilidad o incapacidad permanente de un/a Diputado/a Nacional lo/a sustituirán los/as candidatos/as de su mismo sexo que figuren en la lista como candidatos/as titulares según el orden establecido.
Una vez que ésta se hubiere agotado ocuparán los cargos vacantes los/as suplentes que sigan de conformidad con la prelación consignada en la lista respectiva y el criterio establecido en el párrafo anterior. Si no quedaran mujeres o varones en la lista, se considerará la banca como vacante y será de aplicación el artículo 51 de la Constitución Nacional. En todos los casos los/as reemplazantes se desempeñarán hasta que finalice el mandato que le hubiere correspondido al titular.
ARTÍCULO 4°.- Modifíquese el artículo 164 octies del Capítulo IV De los parlamentarios del Mercosur, del Título VII Sistema Nacional Electoral, del Código Electoral Nacional, el que quedará redactado de la siguiente forma:
Artículo 164 octies: Sustitución. En caso de muerte, renuncia, separación, inhabilidad o incapacidad permanente de un/a parlamentario/a del Mercosur lo/a sustituirá el/la primer/a suplente del mismo sexo de su lista de acuerdo al artículo 164 septies.
ARTÍCULO 5°.- Modifíquese el inciso a) del artículo 26, del Capítulo III Presentación y oficialización de listas, del Título II Primarias abiertas, simultáneas y obligatorias, de la ley 26.571, de Democratización de la Representación Política, la Transparencia y la Equidad Electoral, el que quedará redactado de la siguiente forma:
Artículo 26: Las juntas electorales partidarias se integrarán, asimismo, con un (1) representante de cada una de las listas oficializadas.
Las listas de precandidatos se deben presentar ante la junta electoral de cada agrupación hasta cincuenta (50) días antes de la elección primaria para su oficialización. Las listas deben cumplir con los siguientes requisitos:
a) Número de precandidatos igual al número de cargos titulares y suplentes a seleccionar, respetando la paridad de género de conformidad con las disposiciones del artículo 60 bis del Código Electoral Nacional;
b) Nómina de precandidatos acompañada de constancias de aceptación de la postulación suscritas por el precandidato, indicación de domicilio, número de documento nacional de identidad, libreta de enrolamiento o libreta cívica, y declaración jurada de reunir los requisitos constitucionales y legales pertinentes;
c) Designación de apoderado y responsable económico-financiero de lista, a los fines establecidos en la Ley de Financiamiento de los Partidos Políticos, y constitución de domicilio especial en la ciudad asiento de la junta electoral de la agrupación;
d) Denominación de la lista, mediante color y/o nombre la que no podrá contener el nombre de personas vivas, de la agrupación política, ni de los partidos que la integraren;
e) Avales establecidos en el artículo 21 de la presente ley;
f) Declaración jurada de todos los precandidatos de cada lista comprometiéndose a respetar la plataforma electoral de la lista;
g) Plataforma programática y declaración del medio por el cual la difundirá. Las listas podrán presentar copia de la documentación descrita anteriormente ante la justicia electoral.
ARTÍCULO 6°.- Modifíquese el inciso b) del artículo 3° del Título I Principios Generales, de la ley 23.298, Orgánica de los Partidos Políticos, el que quedará redactado de la siguiente forma:
Artículo 3°: La existencia de los partidos requiere las siguientes condiciones sustanciales:
a) Grupo de electores, unidos por un vínculo político permanente;
b) Organización estable y funcionamiento reglados por la carta orgánica, de conformidad con el método democrático interno, mediante elecciones periódicas de autoridades y organismos partidarios, en la forma que establezca cada partido, respetando la paridad de género, sin necesidad del cumplimiento estricto del principio de alternancia;
c) Reconocimiento judicial de su personería jurídico-política como partido, la que comporta su inscripción en el registro público correspondiente.
ARTÍCULO 7°.- Modifíquese el artículo 21 del Capítulo I De la carta orgánica y plataforma electoral, del Título III De la doctrina y organización, de la ley 23.298, Orgánica de los Partidos Políticos, el que quedará redactado de la siguiente forma:
Artículo 21: La carta orgánica constituye la ley fundamental del partido en cuyo carácter rigen los poderes, los derechos y obligaciones partidarias y a la cual sus autoridades y afiliados deberán ajustar obligatoriamente su actuación, respetando la paridad de género en el acceso a cargos partidarios.
ARTÍCULO 8°.- Incorpórese como inciso h) al artículo 50 del Título VI de la caducidad y extinción de los partidos, de la ley 23.298, Orgánica de los Partidos Políticos, el siguiente texto:
Artículo 50: Son causas de caducidad de la personalidad política de los partidos:
h) La violación de la paridad de género en las elecciones de autoridades y de los organismos partidarios, previa intimación a las autoridades partidarias a ajustarse a dicho principio.
ARTÍCULO 9°.- Invítese a los partidos políticos a adecuar sus estatutos o cartas orgánicas a los principios y disposiciones de la presente ley.
ARTÍCULO 10.- Comuníquese al Poder Ejecutivo nacional.
