El Fiscal de grado en su agravio entiende que conforme lo estipulado por el artículo 14 de la Ley N° 1.217, el acto administrativo que permite tener por levantada una clausura administrativa en nuestro régimen implica dos actividades de la administración, a saber: a) el levantamiento de la clausura por parte del controlador de faltas; y b) la revisión y confirmación de dicha decisión –que resulta obligatoria- por parte de la Junta de Faltas, por lo que en el caso surge del expediente que el levantamiento de la clausura administrativa fue dispuesta el día 14/10/16 y no el 12/10/16 como dispuso el Sr. Juez de grado interviniente.
Ahora bien, y tal como ha señalado el Judicante, asiste razón a la postura de la Defensa en cuanto a que el día 12/10/16 la clausura administrativa dispuesta ya no se encontraba vigente por haber sido levantada por la Unidad Controladora.
Al respecto, cabe señalar que tal como afirma el Fiscal de grado, el artículo 14 de la Ley N° 1.217 señala que “La Junta de Faltas sólo tiene intervención en la causa que corresponda, luego que la Unidad Administrativa de Control de Faltas haya adoptado resolución, siendo sus facultades: a. Revisar y resolver sobre las medidas precautorias dispuestas por la Unidad Administrativa de Control de Faltas”.
En este punto es necesario señalar que, más allá de la interpretación efectuada por el Fiscal de grado respecto de la facultad de la Junta de Faltas, lo cierto es que de dicho artículo se desprende que la intervención de esa instancia administrativa es sólo cuando una medida precautoria es dispuesta y no, como en el caso, que es levantada. Ellos pues, su intervención es obligatoria cuando se afecte los intereses del administrado.
