Por medio del Decreto 891/17, publicado en el Boletín Oficial del 2/11/17, se aprobó un sistema de «Buenas Prácticas en Materia de Simplificación» con el fin de lograr la simplificación y reducción de cargas y complejidades innecesarias de la Administración Pública, tendiendo a la implementación de regulaciones de cumplimiento simple facilitando la vida al ciudadano. Las mismas serán aplicables para el funcionamiento del Sector Público Nacional, el dictado de la normativa y sus regulaciones.

Apruébanse las Buenas Prácticas en Materia de Simplificación.
Ciudad de Buenos Aires, 01/11/2017
VISTO el Expediente N° EX-2017-25693180-APN-DSGA#SLYT, la Ley de Ministerios (texto ordenado por Decreto Nº 438 del 12 de marzo de 1992) y sus modificatorias, la Ley N° 24.156 y los Decretos Nros. 13 de fecha 10 de diciembre de 2015, 434 de fecha de fecha 1° de marzo de 2016, 1273 de fecha 19 de diciembre de 2016 y 87 de fecha 2 de febrero de 2017, y
CONSIDERANDO:
Que mediante la modificación introducida por el Decreto N° 13 del 10 de diciembre de 2015 a la Ley de Ministerios (texto ordenado por Decreto Nº 438 del 12 de marzo de 1992) y sus modificatorias, se ha readecuado la estructura gubernamental en función de atender los objetivos prioritarios definidos para cada área de gestión, reorganizando funciones con el propósito de tornar más eficiente y predecible la gestión pública.
Que ese proceso debe estar acompañado por una revisión del funcionamiento de la Administración Pública, que tenga por fin la simplificación y reducción de cargas y complejidades innecesarias, tendiendo a la implementación de regulaciones de cumplimiento simple facilitando la vida al ciudadano
Que medidas de esa índole tienen como principal destinatario al ciudadano, por tratarse del diseño de procesos que agilizan sus gestiones y evitan el dispendio de tiempo y costos, que desmejoran la calidad de vida.
Que en distintas entidades y jurisdicciones de la Administración Pública rigen en muchos casos regulaciones que han devenido anacrónicas con exigencias tal vez justificadas en su origen, que hoy generan dilaciones y costos infundados.
Que el Decreto N° 434 de fecha 1° de marzo de 2016 aprobó el Plan de Modernización del Estado como el instrumento mediante el cual se definen los ejes centrales, las prioridades y los fundamentos para promover las acciones necesarias orientadas a convertir al Estado en el principal garante de la transparencia y del bien común.
Que dicho Plan de Modernización tiene entre sus objetivos constituir una Administración Pública al servicio del ciudadano en un marco de eficiencia, eficacia y calidad en la prestación de servicios, a partir del diseño de organizaciones flexibles orientadas a la gestión por resultados.
Que, asimismo, se plantea la necesidad de iniciar un proceso de eliminación y simplificación de normas en diversos regímenes para brindar una respuesta rápida y transparente a los requerimientos del ciudadano.
Que es necesario adoptar un enfoque integral, creativo e innovador al abordar la reforma regulatoria y las cargas, poniendo énfasis en la importancia de la consulta, la coordinación, la comunicación y la cooperación para afrontar los desafíos que implica la interconectividad de los sectores y las economías.
Que, por su parte, la implementación de sistemas informáticos ofrece transparencia y acceso a los procesos administrativos, contribuyendo de esta manera a su simplificación, al crecimiento de la confianza y a la concreción de las iniciativas al fortalecimiento institucional, supuesto esencial en las sociedades democráticas, tendientes a la mejora constante del servicio al ciudadano.
Que la mejora en la calidad de atención del Estado supone simplificar procesos internos, capacitar a quienes interactúan directa o indirectamente con éste y ampliar las modalidades de atención incorporando procesos que permitan brindar servicios públicos de calidad, accesibles e inclusivos para todos.
Que en consonancia con lo antedicho, el Decreto N° 1273 de fecha 19 de diciembre de 2016, dispone que las entidades y jurisdicciones enumeradas en el artículo 8° de la Ley N° 24.156 que componen el Sector Público Nacional, deberán intercambiar la información pública que produzcan, obtengan, obre en su poder o se encuentre bajo su control, con cualquier otro organismo público que así se lo solicite.
Que el espíritu de dicha norma es reducir las cargas sobre los administrados, al disminuir los requisitos para suministrar información y datos y evitar la presentación de documentación que el administrado haya aportado, exhibido y/o informado con anterioridad en algún organismo del Sector Público Nacional, utilizando para ello los medios electrónicos y digitales que se encuentran disponibles.
Que, por ello, mediante el Decreto N° 87 de fecha 2 de febrero de 2017, se creó la Plataforma Digital del Sector Público Nacional para facilitar la interacción entre las personas y el Estado, con el objetivo de unificar la estrategia de servicios y trámites en línea, brindando así la posibilidad de realizar trámites a través de las distintas herramientas y servicios insertos en la plataforma, así como consultar dichos servicios, solicitar turnos y acceder a información mediante diversos canales.
Que es esencial para este gobierno contar con las herramientas necesarias para la promoción del bienestar general, resguardando los principios de transparencia, razonabilidad, publicidad, concurrencia, libre competencia e igualdad.
Que se propone el establecimiento de normas y procedimientos claros, sencillos y directos mediante la utilización de principios e institutos que pongan en primer plano a los ciudadanos, simplificando los requisitos que deben cumplir para poder llevar adelante su actividad, mediante la interacción digital y remota de los distintos agentes.
Que al respecto, la Organización para la Cooperación y el Desarrollo Económicos (OCDE) recomienda la aplicación de buenas prácticas regulatorias, las que desarrolló en sucesivos documentos de trabajo que se tienen especialmente en cuenta por este gobierno.
Que es indispensable elaborar una estrategia sistémica e integral que establezca como premisa básica la mejora regulatoria como una labor continua del sector público y abierta a la participación de la sociedad, que incluya la reducción de los trámites excesivos, la simplificación de procesos y la elaboración de normas de manera tal que nos lleve a un Estado eficiente, predecible, capaz de responder a las necesidades ciudadanas.
Que es necesario implementar las acciones del Estado Nacional que prevean, entre otras, mecanismos de consulta pública en el desarrollo y aprobación de las regulaciones, la simplificación administrativa y normativa así como la evaluación de su implementación.
Que, de acuerdo con los lineamientos de la Organización para la Cooperación y el Desarrollo Económico (OCDE), una adecuada política regulatoria exige que se implementen prácticas de buena gobernanza entre organismos y departamentos de gobierno tendientes a la simplificación de trámites y formalidades y la eliminación de normas que entorpecen y demoran el accionar del Estado.
Que en virtud de lo expuesto resulta necesario establecer las buenas prácticas para la normativa y regulación de la Administración Pública Nacional, sostenidas a través de la simplificación, la mejora continua de procesos internos y reducción de cargas a los administrados.
Que ha tomado intervención el servicio jurídico competente.
Que la presente medida se dicta en ejercicio de las atribuciones conferidas por el artículo 99, incisos 1 y 2, de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE DE LA NACIÓN ARGENTINA
DECRETA:
ARTÍCULO 1°.- APROBACIÓN. Apruébanse las BUENAS PRÁCTICAS EN MATERIA DE SIMPLIFICACIÓN aplicables para el funcionamiento del Sector Público Nacional, el dictado de la normativa y sus regulaciones.
ARTÍCULO 2°.- ÁMBITO DE APLICACIÓN. A los fines del presente decreto, entiéndese por Sector Público Nacional al definido en el artículo 8° de la Ley N° 24.156 de Administración Financiera y de los Sistemas de Control del Sector Público Nacional y sus modificatorias.
ARTÍCULO 3°.- SIMPLIFICACIÓN NORMATIVA. Las normas y regulaciones que se dicten deberán ser simples, claras, precisas y de fácil comprensión. El Sector Público Nacional deberá confeccionar textos actualizados de sus normas regulatorias y de las guías de los trámites a su cargo. Deberá evaluarse su inventario normativo eliminando las que resulten una carga innecesaria. En el mismo sentido el dictado de nuevas regulaciones que impongan cargas deberán a su vez reducir el inventario existente.
ARTÍCULO 4°.- MEJORA CONTINUA DE PROCESOS. El Sector Público Nacional deberá aplicar mejoras continuas de procesos, a través de la utilización de las nuevas tecnologías y herramientas informáticas, utilizar e identificar los mejores instrumentos, los más innovadores y los menos onerosos, con el fin de agilizar procedimientos administrativos, reducir tiempos que afectan a los administrados y eliminar regulaciones cuya aplicación genere costos innecesarios.
ARTÍCULO 5°.- EVALUACIÓN DE LA IMPLEMENTACIÓN. Todos los organismos del Sector Público Nacional deberán tender, en los casos que corresponda, a la evaluación de la implementación de las normas regulatorias que dicten.
ARTÍCULO 6°.- PARTICIPACIÓN CIUDADANA. Los organismos del Sector Público Nacional incrementarán los mecanismos de participación, intercambio de ideas, consulta, colaboración y de cultura democrática, incorporando las nuevas tecnologías, necesarios para facilitar la comprensión y medir el impacto que traerá aparejado las nuevas regulaciones.
ARTÍCULO 7°.- PRESUNCIÓN DE BUENA FE. Las regulaciones que se dicten deben partir del principio que reconoce la buena fe del ciudadano, permitiéndole justificar a través de declaraciones juradas situaciones fácticas que deban acreditarse ante los organismos del Sector Público Nacional.
ARTÍCULO 8°.- GOBIERNO DIGITAL. El Gobierno Nacional deberá fomentar la interoperabilidad entre las administraciones públicas provinciales, y de la Ciudad Autónoma de Buenos Aires, generando de esta manera un intercambio y colaboración mutua, a fin de implementar todas las herramientas tecnológicas existentes, permitiendo de este modo acercar a los ciudadanos herramientas eficaces para su interacción con la Administración.
ARTÍCULO 9°.- MEDICIÓN DE COSTO-BENEFICIO. El diseño de las regulaciones procurará la incorporación de la medición de los costos-beneficios que impliquen su implementación.
ARTÍCULO 10.- SILENCIO POSITIVO. En la elaboración de las normas regulatorias deberá tenerse en cuenta la posibilidad de incrementar el carácter positivo del silencio de la Administración, en la medida que resulte posible en atención a la naturaleza de las relaciones jurídicas tuteladas por la norma de aplicación, siempre y cuando sea en beneficio del requirente y no se afecten derechos a terceros.
ARTÍCULO 11.- COMUNICACIÓN EFICIENTE. Los organismos del Sector Público Nacional deberán promover el intercambio de buenas prácticas comunicacionales intra y extra organismos. La totalidad de las medidas dispuestas deberán comunicarse de manera clara y eficiente.
ARTÍCULO 12.- CREACIÓN DE REGISTROS. En caso de crearse nuevos Registros, en el ámbito de la administración centralizada se requerirá la previa autorización del JEFE DE GABINETE DE MINISTROS, mientras que en los demás casos dicha autorización será otorgada por el PODER EJECUTIVO NACIONAL. Los nuevos Registros que se creen deberán ser digitales, facilitando el acceso por parte de los ciudadanos y estarán regidos por el principio de gratuidad.
