La acción afirmativa también conocida como “discriminación positiva” es el término que se da a una acción que pretende establecer políticas que otorgan a un determinado grupo social, étnico, minoritario o que históricamente haya sufrido discriminación a causa de injusticias sociales, un trato preferencial en el acceso o distribución de ciertos recursos o servicios así como acceso a determinados bienes.
El objetivo de este instituto es mejorar la calidad de vida de los grupos desfavorecidos y compensarlos por los perjuicios o la discriminación de la que hayan sido víctimas. El término acción afirmativa, por ejemplo, hace referencia a aquellas actuaciones (medidas legales, administrativas o prácticas) que se encuentran dirigidas a reducir o, idealmente, eliminar las prácticas discriminatorias en contra de dos sectores históricamente excluidos como son por ejemplo las mujeres y los niños y niñas indígenas, cuestión que es hoy en día un asunto de especial preocupación cuando se pone en la balanza el ejercicio de los derechos colectivos de los pueblos indígenas y los derechos individuales de estos sujetos.
Lo que se busca, mediante este tipo de acciones, es aumentar por ejemplo la representación de las mujeres y los niños y niñas indígenas, a través de un tratamiento preferencial y de mecanismos de selección expresa y positivamente encaminados a estos propósitos.
La discriminación positiva o acción afirmativa se cristaliza a través de la aplicación de políticas públicas encaminadas al reconocimiento de las diferencias culturales de los grupos minoritarios o que históricamente hayan sufrido discriminación, con el objetivo de llegar a una sociedad más justa y equitativa brindándoles las mismas posibilidades que a los grupos hegemónicos.
El origen histórico de la “discriminación positiva” en nuestro país.
El 6 de diciembre de 1810, Mariano Moreno proyectó un decreto que luego sancionaría la Primera Junta según el cual “la libertad de los pueblos no consiste en palabras, ni debe existir en los papeles solamente. Cualquier déspota puede obligar a sus esclavos a que canten himnos de libertad, y este canto maquinal es muy compatible con las cadenas y opresión de los que lo entonan. Si deseamos que los pueblos sean libres, observemos religiosamente el sagrado dogma de la igualdad”.
Este principio fue antecedente del art. 1ro, Capítulo V y del artículo 5to del Capítulo XIV del Proyecto de Constitución para las Provincias del Río de la Plata de 1812; del art. 8vo del Capítulo II del Proyecto de la Sociedad Patriótica; del Decreto del 12 de marzo de 1813, las Leyes del 21 de mayo y del 13 de agosto de 1813, todos sancionados por la Asamblea General Constituyente reunida ese año. Por último, el principio fue receptado por el proyecto de Constitución de Juan B. Alberdi de 1853 y cristalizado en el artículo 16 de la Carta Magna.
En aquella afirmación de Moreno se hace referencia a una idea de igualdad que construida sobre el rechazo del sometimiento de esclavos por déspotas. Moreno entendía la igualdad como principio opuesto a la opresión y a la imposición de cadenas visibles o invisibles. Si bien el principio de “igualdad de trato en igualdad de circunstancias” parecería proveer de un estándar interpretativo del derecho constitucional a la igualdad de trato ante la ley, la cuestión no encuentra solución definitiva y completa en él. Este estándar interpretativo sólo ayuda a acercarnos un poco a una respuesta satisfactoria respecto del significado del artículo 16, pero aún resulta relativamente “vacío”. Lo único que parece dejar en claro este criterio de interpretación de la norma es que es posible tratar de modo diferente a las personas siempre y cuando se lo haga en forma homogénea, uniforme y no arbitraria, pero este “principio guía” sigue sin decirnos nada respecto de lo que califica a esa distinción homogéneamente aplicada como una distinción permitida por el artículo 16.
¿ Qué debe entenderse por “grupos vulnerables”?
Los grupos vulnerables pueden ser definidos como la persona o grupo que por sus características de desventaja por edad, sexo, estado civil; nivel educativo, origen étnico, situación o condición física y/o mental; requieren de un esfuerzo adicional para incorporarse al desarrollo y a la convivencia.
Los grupos vulnerables son aquellos grupos que por sus condiciones sociales, económicas, culturales o psicológicas pueden sufrir maltratos contra sus derechos humanos. Dentro de éste grupo se encuentran insertas las personas de la tercera edad, personas con discapacidades, mujeres, niños, pueblos indígenas, personas con enfermedades mentales, personas con VIH/SIDA, trabajadores migrantes, minorías sexuales y personas detenidas.
El concepto de vulnerabilidad se aplica a aquellos sectores o grupos de la población que por su condición de edad, sexo, estado civil y origen étnico se encuentran en condición de riesgo que les impide incorporarse al desarrollo y acceder a mejores condiciones de bienestar. El Sistema Nacional para el Desarrollo Integral de la Familia (DIF) define la vulnerabilidad como un fenómeno de desajustes sociales que ha crecido y se ha arraigado en la cultura de nuestras sociedades. La acumulación de desventajas es multicausal y adquiere varias dimensiones. Denota la carencia o ausencia de elementos esenciales para la subsistencia y el desarrollo personal, e insuficiencia de las herramientas necesarias para abandonar situaciones en desventaja, estructurales o coyunturales.
Libertad positiva y libertad negativa.
La libertad positiva es la posibilidad de actuar –o el hecho de actuar– de manera que se tome control de la propia vida y se realicen los objetivos fundamentales propios.
Mientras que la libertad negativa se atribuye normalmente a agentes individuales, la libertad positiva a veces se atribuye a colectivos, o a individuos considerados principalmente como miembros de colectivos determinados. La idea de distinguir entre un sentido positivo y uno negativo del término “libertad” se remonta al menos hasta Kant, e Isaiah Berlin la examinó y defendió en los años 50 y 60.

La igualdad es el trato idéntico que un organismo, estado, empresa, asociación, grupo o individuo le brinda a las personas sin que medie ningún tipo de reparo por la raza, sexo, clase social u otra circunstancia plausible de diferencia o para hacerlo más práctico, es la ausencia de cualquier tipo de discriminación.

La igualdad ante la ley es principio jurídico que se deriva del reconocimiento de la persona como criatura dotada de unas cualidades esenciales -comunes a todo el género humano- que le confieren dignidad en sí misma, con independencia de factores accidentales, lo que implica proscripción de toda forma discriminatoria, sea ella negativa o positiva, en las relaciones entre gobernantes y gobernados así como en la creación, definición y aplicación de las normas que componen el ordenamiento jurídico. Este, en el Estado de Derecho, es un conjunto armónico puesto en relación con la comunidad a la cual obliga y, en acatamiento al aludido principio, está llamado a procurar no tan solo una igualdad formal o de alcance puramente teórico en materia de derechos, deberes y obligaciones, sino que debe proyectarse al terreno de lo real, para hacerla efectiva mediante fórmulas concretas que eleven las posibilidades de quienes por sus condiciones de manifiesta inferioridad, no alcanzarían de otra manera el nivel correspondiente a su dignidad humana. El principio de la igualdad es objetivo y no formal; él se predica de la identidad de los iguales y de la diferencia entre los desiguales. Se supera así el concepto de la igualdad de la ley a partir de la generalidad abstracta, por el concepto de la generalidad concreta, que concluye con el principio según el cual no se permite regulación diferente de supuestos iguales o análogos y prescribe diferente normación a supuestos distintos. Con este concepto sólo se autoriza un trato diferente si está razonablemente justificado. Se supera también, con la igualdad material, el igualitarismo o simple igualdad matemática.
El principio de no discriminación tiene por objeto garantizar la igualdad de trato entre los individuos. Todas las personas tienen iguales derechos e igual dignidad y ninguna de ellas debe ser discriminada en relación con otra. La discriminación impide el desarrollo pleno del potencial de la persona, mina la confianza en las virtudes de las sociedades democráticas y provoca exclusión social. El principio de igualdad de trato y no discriminación debe ser real y efectivo en la educación, la sanidad, las prestaciones y los servicios sociales, la vivienda y, en general, la oferta y el acceso a cualesquiera bienes y servicios.
