El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de
Ley:
ARTÍCULO 1°.- Denomínanse electrodependientes por cuestiones de salud a aquellas personas que requieran de un suministro eléctrico constante y en niveles de tensión adecuados para poder alimentar el equipamiento médico prescrito por un médico matriculado y que resulte necesario para evitar riesgos en su vida o su salud.
ARTÍCULO 2°.- El titular del servicio o uno de sus convivientes que se encuentre registrado como electrodependiente por cuestiones de salud tendrá garantizado en su domicilio el servicio eléctrico en forma permanente. El medidor de dicho domicilio deberá estar debidamente identificado.
ARTÍCULO 3°.- El titular del servicio o uno de sus convivientes que se encuentre registrado como electrodependiente por cuestiones de salud gozará de un tratamiento tarifario especial gratuito en el servicio público de provisión de energía eléctrica que se encuentre bajo jurisdicción nacional.
ARTÍCULO 4°.- El beneficio otorgado por la presente ley a los usuarios registrados como electrodependientes por cuestiones de salud en todo el territorio nacional consistirá en el reconocimiento de la totalidad de la facturación del servicio público de provisión de energía eléctrica que se encuentre bajo jurisdicción nacional.
ARTÍCULO 5°.- El titular del servicio o uno de sus convivientes que se encuentre registrado como electrodependiente por cuestiones de salud quedará eximido del pago de los derechos de conexión, si los hubiere.
ARTÍCULO 6°.- La empresa distribuidora entregará al titular del servicio o uno de sus convivientes que se encuentre registrado como electrodependiente por cuestiones de salud, previa solicitud, un grupo electrógeno o el equipamiento adecuado, sin cargo incluyendo los costos de funcionamiento asociados, capaz de brindar la energía eléctrica necesaria para satisfacer sus necesidades conforme los preceptos establecidos en el artículo 1° de la presente ley.
ARTÍCULO 7°.- La empresa distribuidora deberá habilitar una línea telefónica especial gratuita de atención personalizada destinada exclusivamente a la atención de los usuarios electrodependientes por cuestiones de salud disponible las 24 horas incluyendo días inhábiles.
ARTÍCULO 8°.- El Ministerio de Salud de la Nación a través de sus organismos pertinentes, creará y tendrá a su cargo el Registro de Electrodependientes por Cuestiones de Salud.
ARTÍCULO 9°.- La presente ley no invalida los registros especiales para electrodependientes constituidos por las autoridades regulatorias o las empresas distribuidoras locales vinculados a una prestación especial de servicio que se hayan constituido hasta la fecha de sanción de la presente ley.
ARTÍCULO 10.- El Poder Ejecutivo desarrollará campañas de difusión, educación y concientización con el fin de promover los derechos de los electrodependientes por cuestiones de salud y de los principios comprendidos en esta ley. En el marco de la campaña se deberá contemplar que las facturas por los servicios de provisión de energía eléctrica de las empresas distribuidoras contengan una leyenda acorde a los principios de la presente ley.
ARTÍCULO 11.- El Poder Ejecutivo designará la autoridad de aplicación de la presente ley y asignará las partidas presupuestarias necesarias para el cumplimiento de sus fines.
ARTÍCULO 12.- Se invita a las provincias y a la Ciudad Autónoma de Buenos Aires a adherir a la presente y reconocer la gratuidad en los componentes de la facturación del servicio público de provisión de energía eléctrica que se encuentre bajo su propia jurisdicción.
ARTÍCULO 13.- Comuníquese al Poder Ejecutivo nacional.
