Mediante la ley provincial 8.982 (B.O. 10/02/2017) se dispuso la creación del Cuerpo de Abogados para Víctimas de Violencia contra la Mujer. Dependiente del Ministerio de Gobierno, Justicia y Seguridad de la Provincia, el que tendrá por principal función asegurar el acceso gratuito y expedito a la justicia a las víctimas de Violencia contra la Mujer.
Dentro de sus funciones se encuentra el brindar asesoramiento legal y patrocinio jurídico gratuito a las víctimas de violencia y desarrollar mecanismos de coordinación y cooperación y la implementación de convenios con otros organismos de los poderes del Estado.
Ley 8.982 – Provincia de Tucuman.
Artículo 1
.- Créase, el Cuerpo de Abogados para Víctimas de Violencia contra la Mujer, en el ámbito del Ministerio de Gobierno, Justicia y Seguridad de la Provincia, el que tendrá por principal función asegurar el acceso gratuito y expedito a la justicia a las víctimas de Violencia contra la Mujer, en consonancia con lo dispuesto por la Ley Nacional N° 26.485 -Protección Integral para Prevenir, Sancionar y Erradicar la Violencia Contra la Mujer-, y la Ley N° 8336- Ley de Adhesión Provincial- así como las Normas Nacionales y Provinciales concordantes, con la finalidad de hacer efectivos los derechos y garantías consagrados tutelando a quienes sufren este flagelo.
Artículo 2.- El Cuerpo de Abogados para Víctimas de Violencia contra la Mujer, tendrá las siguientes funciones:
1. Brindar patrocinio jurídico gratuito y asesoramiento legal integral en todo el territorio de la Provincia, a las personas que sean víctimas de Violencia contra la Mujer, en cualquiera de las modalidades establecidas en la Ley N° 26.485, incluida la ejercida por razones de identidad de género y orientación sexual de modo de garantizar su acceso a la justicia de manera expedita y efectiva.
2. Desarrollar mecanismos de coordinación y cooperación, e implementar convenios o acuerdos con otros organismos del Poder Ejecutivo, del Poder Judicial y del Ministerio Público Fiscal, tanto de jurisdicción nacional como provincial, en pos de realizar acciones conjuntas que permitan brindar una respuesta eficiente y rápida, tanto en sede administrativa como en sede judicial a quienes padecen la Violencia contra la Mujer.
3. Celebrar convenios y coordinar acciones con colegios profesionales, instituciones académicas y organizaciones de la sociedad civil que tiendan a facilitar el logro de estos objetivos.
4. Brindar capacitación técnica, actualización normativa y charlas de concientización sobre la problemática de género, a los empleados del sistema de administración de justicia, agentes de la Policía de la Provincia y otros actores implicados en el abordaje integral de la Violencia contra la Mujer.
5. Formular recomendaciones y propuestas legislativas en materia de Violencia contra la Mujer.
6. Realizar investigaciones y elaborar informes estadísticos, cualitativos y cuantitativos, en relación a las causas, la naturaleza, la gravedad y las consecuencias de la Violencia contra la Mujer, así como de los resultados de las medidas aplicadas para impedirla y reparar sus efectos, y de la eficiencia del accionar de los organismos involucrados en su prevención, sanción y erradicación.
7. Promover la difusión periódica de los informes elaborados.
8. Brindar informes periódicos a la Corte Suprema de Justicia de la Provincia, a los fines de colaborar con el funcionamiento del Registro de Agresores por Violencia contra la Mujer, que se crea por esta Ley.
Artículo 3.- El Cuerpo de Abogados para Víctimas de Violencia contra la Mujer, estará a cargo de un (1) Director Ejecutivo, quien tendrá rango y jerarquía de Subsecretario de Estado, será designado por el Poder Ejecutivo Provincial, y deberá reunir las siguientes condiciones:
1. Ser ciudadano argentino, y tener tres (3) años como mínimo de residencia en la Provincia.
2. Poseer título de abogado expedido por una universidad nacional; acreditando una antigüedad mínima de cinco (5) años en la matrícula.
3. Acreditar experiencia o conocimiento en materia de Violencia contra la Mujer y derecho de familia.
Artículo 4.- El Director Ejecutivo del Cuerpo de Abogados, para Víctimas de Violencia contra la Mujer tendrá los siguientes deberes y atribuciones:
1. Ejercer la dirección del Cuerpo de Abogados para Víctimas de Violencia contra la Mujer; 2. Dictar y hacer cumplir el reglamento interno del Cuerpo; 3. Promover la capacitación y formación continua de los profesionales integrantes del Cuerpo; 4. Elaborar el plan operativo anual, para el cumplimiento de los fines de esta ley; 5. Establecer los requisitos para la admisión de solicitudes de patrocinio letrado de quienes quieran ingresar como litigantes al Cuerpo de Abogados; 6. Promover las relaciones institucionales del Cuerpo y suscribir convenios con organizaciones públicas o privadas, que sirvan al cumplimiento de sus objetivos; 7. Administrar los recursos presupuestarios del organismo.
Gestionar fondos públicos y privados que ayuden al cumplimiento de los fines del Cuerpo.
8. Cualquier otra función que se determine por vía reglamentaria y que persiga contribuir a la efectividad en la misión del Cuerpo de Abogados de las víctimas de Violencia contra la Mujer en la lucha contra esta problématica.
Artículo 5.- El Cuerpo de Abogados para Víctimas de Violencia contra la Mujer, contará con una Comisión Interdisciplinaria Asesora, encargada del abordaje integral de la Violencia contra la Mujer, constituida por profesionales de grado universitario, en las áreas de derecho, ciencias sociales y salud, que acrediten conocimientos especializados en la problemática de género. Los miembros de esta Comisión percibirán por sus servicios los montos que se determinen por vía reglamentaria.
Tendrán por funciones:
1. Auxiliar al Director Ejecutivo del Cuerpo, y asesorar técnicamente, a los profesionales del derecho que intervengan en causas de Violencia contra la Mujer, en aras de procurar un abordaje integral.
2. Promover la unificación de criterios y la sistematización de la información pertinente, entre los diferentes organismos y organizaciones abocados a la recepción de denuncias de Violencia contra la Mujer, a los fines de evitar las revictimizaciones y la judicialización innecesaria de casos que requieran otro tipo de abordaje.
3. Proponer recomendaciones de acciones y medidas reparatorias, relacionadas con tipos y modalidades de violencia ejercida en razón del género que no constituyan delito.
4. Realizar informes de riesgo en el marco de causas por Violencia contra la Mujer, cuanto sea necesario.
5. Crear conciencia sobre la importancia de la problemática, en los integrantes del Cuerpo y en los otros actores implicados en el abordaje integral de la Violencia contra la Mujer.
Artículo 6.- Los integrantes del Cuerpo de Abogados para Víctimas de Violencia contra la Mujer, podrán ser reclutados dentro de las filas del personal, que conforma la dotación permanente de Empleados Públicos de la Provincia, en sus distintas reparticiones, en tanto el traspaso de dependencia sea de carácter voluntario para el empleado, más allá de los beneficios que pudieran estipularse por vía reglamentaria para quienes optarán por el cambio de repartición. Los miembros de este Cuerpo también podrán ser designados por el Poder Ejecutivo de la Provincia.
El Director Ejecutivo del Cuerpo, podrá celebrar convenios con Universidades, para complementar la labor de la dotación del personal, con alumnos de los últimos años de la carrera de Derecho, sea en la modalidad de práctica tribunalicia o taller optativo para los mismos. Esta opción podrá también implementarse, con respecto a carreras pertenecientes a las ciencias sociales o a la rama de la salud, que pudieran involucrarse en la prevención, o erradicación de la Violencia contra la Mujer.
Articulo 7.- Créase, el Registro de Agresores por Violencia contra la Mujer, dentro del ámbito del Poder Judicial de la Provincia.
Artículo 8.- Modifícase la Ley N° 6238 y sus modificatorias (Orgánica del Poder Judicial), en la forma que a continuación se indica:
– En el art. 72, inc. 4) sustituir la expresión: “inc. 1. e) del Artículo 170”, por la expresión: “inc. 1. e) del Artículo 172”.
– Incorporar en el Libro III, Título II “Organismos Auxiliares” el:
“Capítulo VIII Registro de Agresores por Violencia contra la Mujer art. 161.- Funcionamiento. El Registro de Agresores por Violencia contra la Mujer, funcionará bajo dependencia de la Corte Suprema de Justicia de la Provincia, quien reglamentará por Acordada, su radicación y modalidad de implementación, designando al encargado y a los empleados que sean necesarios para su organización efectiva, los que deberán pertenecer a la planta personal permanente del Poder Judicial.
Artículo 162.- Son funciones del Registro de Agresores por Violencia contra la Mujer, las siguientes:
1. Llevar el listado de todas aquellas personas sobre quienes recayera una medida cautelar de restricción de acercamiento, ordenada en sede civil o penal, por haber considerado el Magistrado, que existe peligro real para la víctima, y de quienes hubieren sido condenados por sentencia firme en sede penal, por lesiones leves o delitos de mayor gravedad donde hubiere mediado Violencia contra la Mujer.
2. Expedir certificados ante requerimiento simple de cualquier persona física o jurídica, pública o privada, en forma gratuita, donde conste la causa iniciada, el alta o la baja en el registro y el cumplimiento de tratamiento psicológico al respecto, si contara con esta última información.
La Inscripción en el registro o la baja de la misma, sólo podrá ser ordenada por orden del Juez competente, de oficio o a petición de parte interesada, después de haber acreditado el cumplimiento de la condena o la realización de un tratamiento psicológico que reencauce al agresor.” – Los arts. 161 al 167 de la Ley N° 6238 y sus modificatorias, pasan a ser arts. 163 al 169.
– El art. 168 que pasa a ser art. 170 de la Ley N° 6238 y sus modificatorias:
– En el inc. 1, sustituir la expresión: “los *incs. 2. b) y 3. a) y b) del Artículo 170 de la presente Ley”, por la expresión: “los *incs. 2. b) y 3. a) y b) del Artículo 172 de la presente Ley”.
– Los arts. 169 al 176 de la Ley N° 6238 y sus modificatorias, pasan a ser arts. 171 al 178.
Artículo 9.- Las Instituciones u Organismos Públicos de la Provincia, no podrán designar como funcionarios públicos, ni como personal directivo o jerárquico, a quienes se encuentren incluidos en el Registro de Agresores por Violencia contra la Mujer, a tal fin se deberá solicitar el informe respectivo, con anterioridad a la designación mencionada, no será obstáculo para la misma, el hecho de revestir antecedentes en el mencionado registro, siempre que se demostrare la baja en el mismo, por haber subsanado el accionar que ha motivado la inscripción.
Artículo 10.- Autorízase al Poder Ejecutivo, a realizar las adecuaciones presupuestarias que sean necesarias a los fines del cumplimiento de esta Ley.
