Por esa razón, encuadró su conducta en el delito de homicidio calificado por el vínculo, por promesa remuneratoria y por codicia, en concurso ideal.
En la sentencia, el camarista Gustavo Ispani, autor de voto, explicó: “La codicia no es otra cosa más que es el apetito desenfrenado de riqueza, lo que sin lugar a dudas, se vio reflejado en el accionar la imputada al decidir sobre la vida de Héctor Corradini (…). Segalá, en el caso que analizo, mató sólo para obtener un rédito o la posibilidad de él, pues el interés en la vocación hereditaria y el cobro de los seguros de vida así lo evidencian”.
El tribunal -presidido por el camarista Alejandro Weiss e integrado por los vocales Gustavo Ispani y Luis Paoloni, y ocho jurados populares- consideró a acreditado con certeza que la muerte del comerciante “fue producto de una convergencia de intereses tanto de la acusada Segalá (finalizar su matrimonio y el cobro de seguros de vida) y la llamada ‘pata policial o azul’ (evitar el conocimiento de las irregularidades en la cooperadora policial del precinto)”.
“Para ello, buscaron como sicario al acusado Víctor Hugo Quinteros, quien junto a otro sujeto no identificado, asumieron el compromiso de sacar a la víctima de su domicilio (…) y luego ejecutarlo”, prosigue la sentencia.
El tribunal agregó que Quinteros o el otro sujeto utilizaron un arma proporcionada clandestinamente por miembros de la plantilla del Precinto nº 36 y recibieron como pago, promesa de pago o ambas cosas a la vez, una suma dineraria aportada por la acusada Segalá.
“También, quedó acreditado que luego de producida la muerte, Segalá cobró dos seguros de vida que detentaba en vida Héctor Corradini, de los cuales era la beneficiaria y, sorprendiendo a propios y extraños, nunca le comentó a nadie que los había percibido”, detalla la sentencia.
Puesta en escena
La Cámara Tercera en lo Criminal precisó que el arribo de la imputada a su domicilio, justo cuando los autores materiales se estaban llevando a su marido, fue una puesta en escena destinada a que “quedara bien claro que ella no tenía nada que ver” con el crimen.
“Por un lado, pretendía con su presencia en el domicilio, desincriminarse de cualquier murmuración que pudiera hacerse en su contra, poniéndose también en situación de víctima. Por otro, asegurar un contexto de acción en el que pudiera impedir cualquier reacción y contienda entre los ingresantes y su familia y, con ello, garantizar una salida limpia y rápida de aquellos”, aseguró la sentencia.
Además de las condenas a Segalá y a Quinteros a prisión perpetua por el homicidio, el tribunal dispuso remitir los antecedentes a la Fiscalía de Instrucción que por sorteo o turno corresponda para que investigue a la posible comisión de delitos por parte del letrado Walter Ferrero, anterior abogado de la viuda; y de los testigos María Teresa Stephan de Budassi y Omar Gustavo Barrera. Finalmente, resolvió remitir los antecedentes a la Fiscalía de Instrucción Anticorrupción que corresponda, por las supuestas irregularidades en la investigación de la causa cometidas por la fiscal de Instrucción Liliana Sánchez.
Gradación penal
Al analizar la aplicación de la pena de prisión perpetua, el vocal Ispani expresó a los legisladores nacionales que “sería importante que, en algún momento, analicen y estudien una gradación penal que contemple en el mínimo de la escala que refleje la cantidad de años de prisión que consideren conveniente”.
“Esto, en razón, de contar con una herramienta legal en cuanto a la pena efectiva a imponer, que permita a los jueces adecuar la sanción penal al caso concreto, con referencia a la culpabilidad, peligrosidad, expuesta por el agente. En el caso concreto, se advierte que al accionar de dos de los autores les cupo la aplicación de dos de las calificantes del homicidio, a otro la autoría de una sola de ellas, mientras que al restante, sólo la participación necesaria de una de las agravantes, y sin embargo, la pena es sola una posible y la misma para todos, la prisión perpetua”, concluyó.
