Se sancionó la ley 27.319 sobre Investigación, Prevención y Lucha de los delitos complejos, promulgada por decreto 1184/2016 (ambas normas publicadas en el Boletín Oficial del 22/11/2016).

Esta ley, complementaria del Código Penal, tiene por objeto brindar a las fuerzas policiales y de seguridad, al Ministerio Público Fiscal y al Poder Judicial las herramientas y facultades necesarias para ser aplicadas a la investigación, prevención y lucha de los delitos complejos, regulando las figuras del agente encubierto, el agente revelador, el informante, la entrega vigilada y prórroga de jurisdicción.

sancionan con fuerza de
Ley:

ARTÍCULO 1º — La presente ley tiene por objeto brindar a las fuerzas policiales y de seguridad, al Ministerio Público Fiscal y al Poder Judicial las herramientas y facultades necesarias para ser aplicadas a la investigación, prevención y lucha de los delitos complejos, regulando las figuras del agente encubierto, el agente revelador, el informante, la entrega vigilada y prórroga de jurisdicción.
Su aplicación deberá regirse por principios de necesidad, razonabilidad y proporcionalidad.
La presente ley es de orden público y complementaria de las disposiciones del Código Penal de la Nación.

ARTÍCULO 2º — Las siguientes técnicas especiales de investigación serán procedentes en los siguientes casos:
a) Delitos de producción, tráfico, transporte, siembra, almacenamiento y comercialización de estupefacientes, precursores químicos o materias primas para su producción o fabricación previstos en la ley 23.737 o la que en el futuro la reemplace, y la organización y financiación de dichos delitos;
b) Delitos previstos en la sección XII, título I del Código Aduanero;
c) Todos los casos en que sea aplicable el artículo 41 quinquies del Código Penal;
d) Delitos previstos en los artículos 125, 125 bis, 126, 127 y 128 del Código Penal;
e) Delitos previstos en los artículos 142 bis, 142 ter y 170 del Código Penal;
f) Delitos previstos en los artículos 145 bis y ter del Código Penal;
g) Delitos cometidos por asociaciones ilícitas en los términos de los artículos 210 y 210 bis del Código Penal;
h) Delitos previstos en el libro segundo, título XIII del Código Penal.

Agente encubierto

ARTÍCULO 3º — Será considerado agente encubierto todo aquel funcionario de las fuerzas de seguridad autorizado, altamente calificado, que presta su consentimiento y ocultando su identidad, se infiltra o introduce en las organizaciones criminales o asociaciones delictivas, con el fin de identificar o detener a los autores, partícipes o encubridores, de impedir la consumación de un delito, o para reunir información y elementos de prueba necesarios para la investigación, con autorización judicial.

ARTÍCULO 4° — Dispuesta la actuación por el juez, de oficio o a pedido del Ministerio Público Fiscal, su designación y la instrumentación necesaria para su protección estará a cargo del Ministerio de Seguridad de la Nación, con control judicial. El Ministerio de Seguridad tendrá a su cargo la selección y capacitación del personal destinado a cumplir tales funciones. Los miembros de las fuerzas de seguridad o policiales designados no podrán tener antecedentes penales.

Agente revelador

ARTÍCULO 5º — Será considerado agente revelador todo aquel agente de las fuerzas de seguridad o policiales designado a fin de simular interés y/o ejecutar el transporte, compra o consumo, para sí o para terceros de dinero, bienes, personas, servicios, armas, estupefacientes o sustancias psicotrópicas, o participar de cualquier otra actividad de un grupo criminal, con la finalidad de identificar a las personas implicadas en un delito, detenerlas, incautar los bienes, liberar a las víctimas o de recolectar material probatorio que sirva para el esclarecimiento de los hechos ilícitos. En tal sentido, el accionar del agente revelador no es de ejecución continuada ni se perpetúa en el tiempo, por lo tanto, no está destinado a infiltrarse dentro de las organizaciones criminales como parte de ellas.

ARTÍCULO 6º — El juez, de oficio o a pedido del Ministerio Público Fiscal, podrá disponer que agentes de las fuerzas policiales y de seguridad en actividad lleven a cabo las tareas necesarias a fin de revelar alguna de las conductas previstas en la presente ley, actuando como agentes reveladores.
Con tal fin tendrá a su cargo la designación del agente revelador y la instrumentación necesaria para su actuación.

Regulaciones comunes

ARTÍCULO 7º — La información que el agente encubierto y el agente revelador vayan logrando, será puesta de inmediato en conocimiento del juez y del representante del Ministerio Público Fiscal interviniente en la forma que resultare más conveniente para posibilitar el cumplimiento de su tarea y evitar la revelación de su función e identidad.

ARTÍCULO 8º — El agente encubierto y el agente revelador serán convocados al juicio únicamente cuando su testimonio resultare absolutamente imprescindible. Cuando la declaración significare un riesgo para su integridad o la de otras personas, o cuando frustrare una intervención ulterior, se emplearán los recursos técnicos necesarios para impedir que pueda identificarse al declarante por su voz o su rostro. La declaración prestada en estas condiciones no constituirá prueba dirimente para la condena del acusado, y deberá valorarse con especial cautela por el tribunal interviniente.

ARTÍCULO 9º — No será punible el agente encubierto o el agente revelador que como consecuencia necesaria del desarrollo de la actuación encomendada, se hubiese visto compelido a incurrir en un delito, siempre que éste no implique poner en peligro cierto la vida o la integridad psíquica o física de una persona o la imposición de un grave sufrimiento físico o moral a otro.

ARTÍCULO 10. — Cuando el agente encubierto o el agente revelador hubiesen resultado imputados en un proceso, harán saber confidencialmente su carácter al juez interviniente, quien en forma reservada recabará la pertinente información a la autoridad que corresponda. Si el caso correspondiere a las previsiones del artículo anterior, el juez lo resolverá sin develar la verdadera identidad del imputado.

ARTÍCULO 11. — Ningún integrante de las fuerzas de seguridad o policiales podrá ser obligado a actuar como agente encubierto ni como agente revelador. La negativa a hacerlo no será tenida como antecedente desfavorable para ningún efecto.

ARTÍCULO 12. — Cuando peligre la seguridad de la persona que haya actuado como agente encubierto o agente revelador por haberse develado su verdadera identidad, ésta tendrá derecho a optar entre permanecer activo o pasar a retiro, cualquiera fuese la cantidad de años de servicio que tuviera. En este último caso se le reconocerá un haber de retiro igual al que le corresponda a quien tenga dos (2) grados de escalafón mayor por el que cumpliera su función.
Deberán adoptarse, de ser necesarias, las medidas de protección adecuadas, con los alcances previstos en la legislación aplicable en materia de protección a testigos e imputados.
La adopción de las disposiciones contenidas en la presente ley deberá estar supeditada a un examen de razonabilidad, con criterio restrictivo, en el que el juez deberá evaluar la imposibilidad de utilizar una medida más idónea para esclarecer los hechos que motivan la investigación o el paradero de los autores, partícipes o encubridores.

Informante

ARTÍCULO 13. — Tendrá carácter de informante aquella persona que, bajo reserva de identidad, a cambio de un beneficio económico, aporte a las fuerzas de seguridad, policiales u otros organismos encargados de la investigación de hechos ilícitos, datos, informes, testimonios, documentación o cualquier otro elemento o referencia pertinente y útil que permita iniciar o guiar la investigación para la detección de individuos u organizaciones dedicados a la planificación, preparación, comisión, apoyo o financiamiento de los delitos contemplados en la presente ley.

ARTÍCULO 14. — El informante no será considerado agente del Estado. Debe ser notificado de que colaborará en la investigación en ese carácter y se le garantizará que su identidad será mantenida en estricta reserva.
El Ministerio de Seguridad de la Nación dictará las disposiciones necesarias a fin de reglamentar las cuestiones atinentes a la procedencia y forma de contraprestación económica.
No será admisible la información aportada por el informante si éste vulnera la prohibición de denunciar establecida en el artículo 178 del Código Procesal Penal de la Nación.
De ser necesario, deberán adoptarse las medidas de protección adecuadas para salvaguardar la vida y la integridad física del informante y su familia.

Entrega vigilada

ARTÍCULO 15. — El juez, de oficio o a pedido del Ministerio Público Fiscal, en audiencia unilateral, podrá autorizar que se postergue la detención de personas o secuestro de bienes cuando estime que la ejecución inmediata de dichas medidas puede comprometer el éxito de la investigación.
El juez podrá incluso suspender la interceptación en territorio argentino de una remesa ilícita y permitir que entren, circulen o salgan del territorio nacional, sin interferencia de la autoridad competente y bajo su control y vigilancia, con el fin de identificar a los partícipes, reunir información y elementos de convicción necesarios para la investigación siempre y cuando tuviere la seguridad de que será vigilada por las autoridades judiciales del país de destino. Esta medida deberá disponerse por resolución fundada.

ARTÍCULO 16. — El juez podrá disponer en cualquier momento, la suspensión de la entrega vigilada y ordenar la detención de los partícipes y el secuestro de los elementos vinculados al delito, si las diligencias pusieren en peligro la vida o integridad de las personas o la aprehensión posterior de los partícipes del delito sin perjuicio de que, si surgiere ese peligro durante las diligencias, los funcionarios públicos encargados de la entrega vigilada apliquen las normas de detención establecidas para el caso de flagrancia.

Sanciones

ARTÍCULO 17. — El funcionario o empleado público que indebidamente revelare la real o nueva identidad de un agente encubierto, de un agente revelador o de un informante, si no configurare una conducta más severamente penada, será reprimido con prisión de cuatro (4) a ocho (8) años, multa equivalente en pesos al valor de seis (6) unidades fijas a ochenta y cinco (85) unidades fijas e inhabilitación absoluta perpetua.
El funcionario o empleado público que por imprudencia, negligencia o inobservancia de los deberes a su cargo, permitiere o diere ocasión a que otro conozca dicha información, será sancionado con prisión de uno (1) a tres (3) años, multa equivalente en pesos al valor de cuatro (4) unidades fijas a sesenta (60) unidades fijas e inhabilitación especial de tres (3) a diez (10) años.
A los efectos de la presente ley, una (1) unidad fija equivale a un (1) salario mínimo, vital y móvil actualizado al momento de la sentencia.

Prórroga de jurisdicción

ARTÍCULO 18. — Cuando se encontrase en peligro la vida de la víctima o su integridad psíquica o física o la demora en el procedimiento pueda comprometer el éxito de la investigación, el juez y el fiscal de la causa podrán actuar en ajena jurisdicción territorial, ordenando a las autoridades de prevención las diligencias que entienda pertinentes, debiendo comunicar las medidas dispuestas al juez del lugar dentro de un plazo no mayor de veinticuatro (24) horas.

Disposiciones finales

ARTÍCULO 19. — Deróguense los artículos 31 bis, 31 ter, 31 quáter, 31 quinquies, 31 sexies, 33 y 33 bis de la ley 23.737.

ARTÍCULO 20. — Comuníquese al Poder Ejecutivo nacional.
