Artículo 1 – Cargar Alerta.- Creación. Créase la Oficina de Transparencia y Acceso a la Información Pública en el ámbito del Poder Ejecutivo, que tendrá por objeto garantizar el efectivo ejercicio del derecho de acceso a la información pública, promoviendo la participación ciudadana y la transparencia de la gestión de los órganos del Estado.
Artículo 2 – Cargar Alerta.- Legitimación activa, Toda persona física o jurídica, pública o privada, está legitimada para acudir a la Oficina de Transparencia y Acceso a la Información Pública, no siendo necesario acreditar derecho subjetivo, interés legítimo, ni contar con patrocinio letrado.
Artículo 3 – Cargar Alerta.- Sujetos Obligados. Serán sujetos obligados la Administración Pública Provincial centralizada y descentralizada, empresas, sociedades y todo otro ente público o privado con participación del Estado o que tenga como principal fuente de recursos el aporte estatal.
Artículo 4 – Cargar Alerta.- Alcances. Determínase que se considera información a los efectos de la presente, toda constancia en documentos escritos, fotográficos, grabaciones, soporte magnético, digital o en cualquier otro formato o que sirva de base para una decisión de naturaleza administrativa, incluyendo las actas de las reuniones oficiales, que haya sido creada u obtenida por los organismos descriptos en el artículo precedente.
Artículo 5 – Cargar Alerta.- Plazos. El organismo estatal al cual se haya requerido la información, deberá otorgarla en un plazo de quince días (15) días hábiles, siendo prorrogable excepcionalmente por igual término, comunicando antes del vencimiento las razones del uso de la prórroga.
En el caso de que la repartición pública no cumpla y/o exhiba las razones sin causa justificada, el deber de otorgar la información de los plazos establecidos, será pasible de la sanción prevista en el art. 8 de la Ley Nº 6431.
Artículo 6 – Cargar Alerta.- Solicitud. La solicitud de información se regirá por el principio de informalidad. La información deberá ser provista sin otras consideraciones que las contempladas en la Ley Nº 6431.
Artículo 7 – Cargar Alerta.- Autoridad de Aplicación. Establécese como autoridad de aplicación a la Secretaría General de Gobierno y Coordinación.
Artículo 8 – Cargar Alerta.- Adhesión. Invitase a los Organismos de Contralor con jerarquía constitucional, al Poder Judicial y al Poder Legislativo de la Provincia del Chaco, a adherirse a los términos de la presente ley.
Artículo 9 – Cargar Alerta.- Regístrese y comuníquese al Poder Ejecutivo.
