Ley Nº VIII-0946-2016
Artículo 1
.- Esta Ley tiene por objeto eliminar o disminuir restricciones burocráticas administrativas preliminares para la registración de proveedores del Estado, habilitación de locales o actividades y/o servicios comerciales, a fin de agilizar y facilitar el cumplimiento de los recaudos de inscripción, como así también la apertura inicial de nuevos emprendimientos de naturaleza comercial, fomentando la actividad económica de dichos sectores a través de un sistema de registración o habilitación comercial inmediata sin inspección jurisdiccional Provincial o Municipal previa.-
Artículo 2.- La registración como proveedores del Estado o habilitación comercial, apertura de locales comerciales y/o de servicios, se producirá de forma inmediata cuando el interesado presente el respectivo formulario que tendrá carácter de Declaración Jurada. Mediante dicho formulario se indicará y describirá de manera explícita que se cumple con todos los requisitos Provinciales o Municipales que se encuentren establecidos para cada actividad o rubro objeto de registración o habilitación.-
Artículo 3.- Para el inicio y desarrollo de las actividades y/o servicios comerciales definidos en el Artículo anterior, no podrá exigirse por parte de las respectivas Autoridades Provinciales o Municipales, la obtención de habilitación comercial previa de instalaciones, de funcionamiento o de actividad, ni otras de clase similar o análogas que sujeten a una preliminar autorización el ejercicio de la actividad y/o servicio comercial a desarrollar o la posibilidad misma de la apertura del establecimiento correspondiente. Tampoco están sujetos a licencia o habilitación los cambios de titularidad de las actividades y/o servicios comerciales. En estos casos será exigible comunicación previa a la administración competente a los solos efectos informativos.-
Artículo 4.- En todos los casos el interesado en la registración como proveedor del Estado o habilitación comercial inmediata, deberá contar con el aval o autorización técnico o profesional que la actividad o rubro requiera, lo que acreditará y presentará conjuntamente con el formulario previsto en el Artículo 2.-
Artículo 5.- Deberá presentarse, junto al formulario de Declaración Jurada de registración como proveedor del Estado, actividad y/o servicio comercial previsto en el Artículo 2, un seguro de caución que cubra una eventual sanción por incumplimiento de los requisitos establecidos legalmente para la actividad o rubro que se pretende registrar o habilitar, según lo establezca la Reglamentación.-
Artículo 6.- La presentación de la Declaración Jurada junto al seguro de caución, los avales o autorizaciones técnicos y profesionales correspondientes, no prejuzgará en modo alguno la situación y efectiva adecuación de las condiciones del establecimiento a la normativa aplicable, ni limitará el ejercicio de las potestades administrativas, de comprobación, inspección, sanción y en general de control que a la administración en cualquier orden jurisdiccional Provincial o Municipal, le estén atribuidas por el ordenamiento sectorial aplicable en cada caso.-
Artículo 7.- Deberá darse precisa, clara, amplia y permanente difusión y publicidad de los requisitos necesarios que deben cumplir los interesados para la registración como proveedores del Estado o la habilitación comercial según los previstos legalmente en cada una de las actividades o rubros correspondientes.-
Artículo 8.- Quedan excluidas del sistema de Habilitación Comercial Express o inmediata instaurado por esta Ley, las actividades que se brindan en locales bailables, bares, pubs, boliches, salas de espectáculos nocturnos y todo tipo de recital público y eventos festivos en lugares cerrados y/o abiertos.-
Artículo 9.- La presente Ley no obsta al cumplimiento de los requisitos y condiciones que las normas nacionales establecen para actividades o servicios que sean de ese ámbito de competencia.-
Artículo 10.- La Autoridad de Aplicación de la presente Ley, para su interpretación, Reglamentación y aplicación, será determinada en su Decreto Reglamentario –
Artículo 11.- Invitar a todos los Municipios de la Provincia a adherir a la presente Ley.-
Artículo 12.- La presente Ley será Reglamentada por el Poder Ejecutivo Provincial en el plazo de NOVENTA (90) días.-
Artículo 13.- Regístrese, comuníquese al Poder Ejecutivo y archívese.-
