El Tribunal Oral en lo Criminal de la Capital Federal Nº 3, resolvió condenar a un hombre a quien se le imputó la comisión del delito de abuso sexual simple, por haberse acreditado que manoseó los glúteos de una dama en el subte. La condena encuentra sustento en el art. 2 de la ley 25.087, que establece que será reprimido con reclusión o prisión de seis meses a cuatro años el que abusare sexualmente de persona de uno u otro sexo cuando, ésta fuera menor de trece años o cuando mediare violencia, amenaza, abuso coactivo o intimidatorio de una relación de dependencia, de autoridad, o de poder, o aprovechándose de que la víctima por cualquier causa no haya podido consentir libremente la acción.

Tribunal Oral en lo Criminal de Capital Federal Nº 3, 8 de Agosto de 2016.
Y VISTOS:
Se reúnen los señores jueces integrantes del Tribunal Oral en lo Criminal n° 3 de Capital Federal, doctores Gustavo Pablo Valle, como presidente, Miguel Ángel Caminos y Gustavo Jorge Rofrano, como vocales, juntamente con el Secretario Dr. Alejandro Almeida Leighton, para dictar sentencia en esta causa n° 1.727/15 (registro interno n° 4.887) seguida, por el delito de abuso sexual, a Darío Alberto SANABRIA, nacido el 30 de agosto de 1970 en esta ciudad, soltero, empleado de carpintería, titular del D.N.I. n° xxx, hijo de Felicitas Benítez y Valentín Sanabria, identificado en la P.F.A. con legajo serie S.P. n° xxx, y con domicilio en la calle xxx, provincia de Buenos Aires. Intervienen en el proceso el fiscal general subrogante Dr. Andrés Madrea y el defensor público coadyuvante Pablo Ordoñez.
Y CONSIDERANDO:
1°) Que a fs. 164 se agregó el acta celebrada en función de lo previsto en el artículo 431 bis del Código Procesal Penal de la Nación, en la que el procesado admitió la existencia del hecho que se le imputa y su participación en el mismo, según se describió en el requerimiento de elevación a juicio, así como también prestó conformidad la calificación legal y el quantum punitivo escogido. En virtud de ello, el fiscal general solicitó que se condene a Darío Alberto Sanabria, como autor del delito de abuso sexual simple, a la pena de dos años de prisión, de cumplimiento en suspenso, y costas. Celebrada la audiencia de visu por el Tribunal, y por considerar procedente el acuerdo mencionado, se llamó a autos para dictar sentencia, quedando la causa en condiciones de ser fallada (artículo 431 bis, inciso 3°, del Código Procesal Penal de la Nación).
2°) Que, de acuerdo con los términos del requerimiento de elevación a juicio fiscal obrante a fs. 94/95vta. Y las constancias de la causa, valoradas de conformidad con las reglas de la sana crítica racional (arts. 241, 263 y 398, segundo párrafo, del Código Procesal Penal de la Nación), se tiene por cierto que:
El 10 de enero de 2015, cerca de las 11.50, Darío Alberto Sanabria abusó sexualmente de N. C. C. al tocarle en varias oportunidades los glúteos, en circunstancias en que ambos viajaban en un tren subterráneo de la línea “C”. Ante ello, la damnificada descendió en la estación “Diagonal Norte”; Sanabria hizo lo mismo, se colocó detrás de ella y la siguió hasta la estación “9 de Julio” de la línea “D” de subterráneos.
Fue entonces que un pasajero, Roberto Alejandro Astrada, se acercó a Cáseres, le preguntó si conocía al imputado y si la había estado molestado. Cuando ésta le contestó que ignoraba quién era y que efectivamente la había estado tocando, Astrada recriminó a Sanabria su actitud, ocasión en que se acercó un hombre y golpeó al imputado. Luego se involucraron varias personas más y el agresor se arrojó a las vías del subte hasta la llegada de personal policial que procedió a detenerlo.
3°)Que para llegar a la conclusión arriba expresada se valoran los siguientes elementos probatorios:
a) N. C. C. contó (fs. 14/vta.) que el 10 de enero de 2015, siendo aproximadamente las 11.50, viajaba en el subte de la línea “C” cuando, encontrándose por la estación “Mariano Moreno”, notó que un hombre que estaba a su lado le tocaba los glúteos.
Refirió que, en un primer momento, pensó que se trataba de movimientos involuntarios, pero luego entró en pánico al darse cuenta que no había tanta gente como para tenerlo encima y que el roce ya era un manoseo.
Fue entonces que, si bien al principio no podía reaccionar, decidió descender en la estación “Diagonal Norte”, lo que también hizo el hombre, que la siguió a la par hasta la estación “9 de Julio”.
Dijo que un pasajero, que había visto lo ocurrido en el vagón, se puso a su lado y le preguntó si conocía al hombre y si la estaba molestando. Al referirle que la había estado tocando, el joven comenzó a increpar a Sanabria, ocasión en que se acercó un hombre y golpeó al imputado. Luego se involucraron varias personas más y el agresor se arrojó a las vías del subte hasta que llegó personal de la policía metropolitana y lo detuvo.
b) Corrobora los dichos de la víctima Roberto Alejandro Astrada, quien manifestó (fs. 6/vta. y 17/vta.) que ese mediodía, mientras viajaba en la línea “C” de subterráneos, observó que un hombre tocaba con una de sus manos la cola de una pasajera.
Declaró que, en un momento, llegó a pensar que iban juntos porque el hombre iba a donde se dirigía la señorita, incluso descendieron, al igual que el dicente, en la estación Diagonal Norte. Sin embargo, decidió acercarse y preguntarle a la muchacha si el hombre la estaba acompañando porque notaba algo extraño, ocasión en que ésta, de manera angustiada, le refirió que la estaba molestando.
Contó que enseguida le recriminó al hombre su actitud, ocasión en la que se acercaron varios pasajeros y comenzaron a propinarle golpes de puño, y el hombre se tiró a las vías para evitar ser linchado.
Dijo que luego arribó personal policial que procedió a detenerlo, labrando un acta, en la que oficio de testigo junto a otra persona.
c) Por su parte, el Oficial Pablo Andrés Dattoli de la Policía Metropolitana contó a fs. 2/3vta. que ese día estaba con el oficial Orue, efectuando tareas de prevención en un andén de la estación 9 de julio de subterráneos, cuando escuchó gritos solicitando la presencia policial por lo que se acercaron al lugar y, tras enterarse de lo ocurrido por la víctima y un pasajero, detuvieron al imputado.
d) El Oficial Nicolás Eduardo Orue declaró a fs. 4/5 en términos contestes con los de Dattoli, en cuanto a las circunstancias de lugar, tiempo y modo en que tomaron conocimiento de los hechos e intervinieron en la detención del imputado.
e) El acta de fs. 5/vta., que da cuenta de la detención y lectura de derechos de Darío Alberto Sanabria, el 10 de enero de 2016, a las 12.20, en un andén de la estación 9 de Julio de la línea de Subterráneos “D”.
f) Los testigos de dicha acta, Roberto Alejandro Astrada y Jorge Javier Bell, ratificaron su contenido al declarar a fs. 6/vta. y 8/vta., respectivamente.
g) El informe de colaboración de la Brigada Móvil de Atención a Víctimas de Violencia Sexual, de fs. 11/12, que da cuenta del relato efectuado por la víctima y el asesoramiento prestado.
h) El informe de fs. 76/91 del Área de Investigaciones de la División Subtes de la Policía Metropolitana, en el que se agregaron las imágenes obtenidas del disco compacto remitido por la firma Metrovías S.A., pudiéndose observar el momento en que Sanabria es increpado por el pasajero Astrada y otros pasajeros, en presencia de la damnificada, y la intervención de la policía.
i) Se cuenta además con el informe médico legal de la víctima Natacha Cásares de fs. 15/vta.; los DVD remitidos por la empresa Metrovías S.A. a fs. 61, que fueran reservados a 151vta., y las fotografías del imputado, obrantes a fs. 1/2vta. de su legajo para el estudio de la personalidad. Por último, Sanabria admitió la imputación que se le dirigió, al aceptar la forma abreviada del juicio, que no viene sino coadyuvar la absoluta convicción que adquiriese sobre el particular.
4°) Que el hecho que se tiene por acreditado es constitutivo del delito de abuso sexual simple por el que Darío Alberto Sanabria debe responder como autor (art. 119, primer párrafo, del Código Penal).
En efecto los actos impúdicos, en este caso, los tocamientos efectuados por el imputado en los glúteos de N. C. C. son una expresión inequívoca del sentido sexual de su acción. No cabe duda, a partir de su persistencia en tal conducta, que los realizó con plena representación de lo que hacía y voluntad de concreción.
5°) Que no hay causales de justificación que permitan excluir la antijuridicidad de la acción típica antes descripta, la que por otra parte es reprochable a Sanabria por no darse ninguna de las hipótesis de exclusión de la culpabilidad. En tal sentido, los informes médico legales agregados a fs. 25/vta. y 40/vta., concluyeron que estaba orientado en tiempo y espacio, y no presentaba síntomas de productividad psicótica ni tóxica.
6°) Que, en cuanto a la sanción a imponer se acepta la medida de la pena pactada por las partes -seis meses de prisión pues la misma se ubica dentro de los parámetros previstos para la figura penal seleccionada y parece ser una adecuada respuesta punitiva.
A esos efectos se toma en consideración, habida cuenta las pautas mensurativas prescriptas por los artículos 40 y 41 del Código Penal, como atenuante, que reconoció su falta, lo que demuestra interés por colaborar con la administración de justicia y la muestra de arrepentimiento sincero que exhibió en la audiencia de conocimiento personal; como agravante, que su accionar no se limitó a los tocamientos efectuados en el vagón, sino que descendió y siguió a la víctima, quien logró deshacerse del acecho gracias a la intervención de un pasajero.
Tal como lo acordaron las partes, nada habrá de cuestionarse con relación a la forma de su cumplimiento en los términos del artículo 26 del Código Penal. Es que esta será su primera condena, el monto de la pena, obviamente, no supera los tres años y no se advierten motivos para preferir el encierro antes que la permanencia en libertad de una persona que ha dado signos de arrepentimiento y se encuentra socializado.
Asimismo, con el fin de contribuir a evitar que reiteren comportamientos ilícitos, se entiende conveniente que durante el plazo de la condena cumplan con la regla prescripta por el art. 27 bis, inciso 1°, del Código Penal.
7°) Que en la medida en que esta resolución pone fin a la causa el imputado deberá pagar las costas procesales (art. 29, inc. 3° del C.P. y arts. 530, 531 y 533 del C.P.P.N.).
En virtud de ello, y de conformidad con lo previsto en los artículos 399, 403, 431 bis, 531 y concordantes del Código Procesal Penal de la Nación, el Tribunal por mayoría RESUELVE:
1°) CONDENAR a DARIO ALBERTO SANABRIA a la pena de DOS AÑOS DE PRISIÓN, de cumplimiento en suspenso y costas, como autor del delito de abuso sexual simple (arts. 26, 29, inc. 3°, y 119, primer párrafo, del Código Penal).
2°) IMPONER a DARIO ALBERTO SANABRIA, por el plazo de dos años contados a partir de que el presente alcance autoridad de cosa juzgada, la obligación de fijar domicilio y someterse al cuidado de un patronato (art. 27 bis, inc. 1°, del Código Penal de la Nación).
Regístrese, notifíquese a las partes, una vez firme comuníquese, y, oportunamente, archívese.
