El citado procedimiento también resultará aplicable para el caso de cuotas impagas originadas en una solicitud de cancelación anticipada total.

VISTO el objetivo permanente de esta Administración Federal de facilitar el cumplimiento de las obligaciones tributarias, y
CONSIDERANDO:
Que para la consecución de dicho objetivo se implementaron diversos planes de facilidades de pago tendientes a permitir a los contribuyentes y responsables regularizar sus deudas impositivas, de los recursos de la seguridad social y aduaneras, así como sus intereses y multas.
Que en ese sentido, los regímenes vigentes contemplan la posibilidad de rehabilitar aquellas cuotas que no hubieran sido debitadas en los vencimientos fijados en las respectivas resoluciones generales, siempre que no se haya registrado la caducidad del plan.
Que a los fines de coadyuvar a la observancia de las obligaciones vencidas, resulta aconsejable incluir en el sistema informático denominado “MIS FACILIDADES” una nueva funcionalidad para que las cuotas impagas puedan ser rehabilitadas y luego canceladas mediante el procedimiento de pago electrónico a partir de la generación de un Volante Electrónico de Pago (VEP).
Que han tomado la intervención que les compete la Dirección de Legislación y las Subdirecciones Generales de Asuntos Jurídicos, de Recaudación, de Sistemas y Telecomunicaciones, de Servicios al Contribuyente, Técnico Legal Impositiva y Técnico Legal de los Recursos de la Seguridad Social, y las Direcciones Generales Impositiva y de los Recursos de la Seguridad Social.
Que la presente se dicta en ejercicio de las facultades conferidas por el Artículo 7° del Decreto N° 618 del 10 de julio de 1997, sus modificatorios y sus complementarios.
Por ello,
EL ADMINISTRADOR FEDERAL
DE LA ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS
RESUELVE:
ARTÍCULO 1° — Habilítase en el sistema informático denominado “MIS FACILIDADES” una nueva funcionalidad para rehabilitar las cuotas impagas de planes de facilidades de pago y ser abonadas a través de transferencia electrónica de fondos mediante la generación de un Volante Electrónico de Pago (VEP), de acuerdo con el procedimiento previsto en la Resolución General N° 1.778, su modificatoria y sus complementarias.
El citado procedimiento también resultará aplicable para el caso de cuotas impagas originadas en una solicitud de cancelación anticipada total.
ARTÍCULO 2° — La aludida funcionalidad se encontrará disponible para su utilización una vez que la entidad bancaria acredite la falta de débito de la/s cuota/s, luego del segundo intento de débito, excepto para los planes de facilidades establecidos por la Resolución General N° 3.756 y sus complementarias, en los que la rehabilitación estará disponible sin esperar el resultado del débito.
Si como consecuencia de esta nueva modalidad de pago se cancelara una misma cuota más de una vez, se la considerará abonada con el primer pago registrado, ya sea por Volante Electrónico de Pago (VEP) o por débito directo, y el excedente quedará a disposición del contribuyente para su posterior reafectación o devolución.
Se podrá generar un solo Volante Electrónico de Pago (VEP) por día y tendrá validez hasta la hora VEINTICUATRO (24) del día de su generación.
En caso que el indicado Volante Electrónico de Pago (VEP) se genere en un día feriado o inhábil no se trasladará su vencimiento al día hábil inmediato siguiente. Por ello, el contribuyente o responsable deberá arbitrar los recaudos necesarios para que durante la vigencia del mismo, los fondos y autorizaciones para su pago se encuentren disponibles y que dicho lapso coincida con los días y horarios de prestación del servicio de la respectiva entidad de pago.
La rehabilitación de la/s cuota/s impaga/s mediante Volante Electrónico de Pago (VEP) se podrá generar diariamente, excepto durante la ejecución de los procesos de control que imposibiliten habilitar dicha funcionalidad, situación que se comunicará a través de mensajes en la aplicación respectiva.
ARTÍCULO 3° — La cuota rehabilitada incluirá por el período de mora transcurrido desde la fecha de vencimiento original de la cuota hasta la fecha de generación/expiración del Volante Electrónico de Pago (VEP), inclusive, los intereses resarcitorios previstos en el Artículo 37 de la Ley N° 11.683, texto ordenado en 1998 y sus modificaciones o en el Artículo 794 de la Ley N° 22.415 y sus modificaciones, según corresponda.
ARTÍCULO 4° — La cancelación de las cuotas impagas por esta metodología será considerada en el proceso que determina la caducidad del plan.
ARTÍCULO 5° — Las disposiciones establecidas en esta resolución general entrarán en vigencia a partir del quinto día hábil de su publicación en el Boletín Oficial.
ARTÍCULO 6° — Regístrese, publíquese, dése a la Dirección Nacional del Registro Oficial y archívese. — Alberto Abad.
