Por medio del Decreto 904, publicado en el Boletín Oficial del 3/08/16, se instituyó un mecanismo de distribución directa de los recursos desde el FONDO SOLIDARIO DE REDISTRIBUCIÓN a los Agentes del Seguro de Salud, para ser destinados exclusivamente al financiamiento de las prestaciones contempladas en el Nomenclador de Prestaciones Básicas para Personas con Discapacidad aprobado mediante Resolución del entonces Ministerio de Salud y Acción Social N° 428/1999 o la norma que en el futuro la reemplace.

Fondo Solidario de Redistribución. Mecanismo “Integración”.
Buenos Aires, 02/08/2016
VISTO el Expediente N° 0028854/2016 del Registro de la SUPERINTENDENCIA DE SERVICIOS DE SALUD, las Leyes N° 23.660, N° 23.661 y N° 24.901 y los Decretos N° 1615, de fecha 23 de diciembre de 1996 y N° 2710 de fecha 28 de diciembre de 2012; y
CONSIDERANDO:
Que la Ley N° 23.660 regula diversos aspectos del SISTEMA NACIONAL DEL SEGURO DE SALUD, instituido por su similar N° 23.661 y sus modificatorias, la cual asimismo establece su financiamiento.
Que, asimismo, el artículo 22 de la Ley N° 23.661 crea un FONDO SOLIDARIO DE REDISTRIBUCIÓN para brindar apoyo financiero a los Agentes del Seguro en los términos prescriptos por el artículo 24 de la misma norma.
Que la Ley N° 24.901 establece un sistema de prestaciones básicas en habilitación y rehabilitación integral a favor de las personas con discapacidad, contemplando acciones de prevención, asistencia, promoción y protección, con el objeto de brindar a los beneficiarios, una cobertura integral a sus necesidades y requerimientos.
Que el artículo 2° de la mencionada norma prescribe que las obras sociales enunciadas en el artículo 1° de la Ley N° 23.660 tendrán a su cargo, con carácter obligatorio, la cobertura total de las prestaciones básicas enunciadas en dicha Ley, que necesiten las personas con discapacidad afiliadas a las mismas.
Que con relación al financiamiento de dicha cobertura, el artículo 7° de la Ley N° 24.901 establece que, para el caso de los afiliados al Sistema Nacional del Seguro de Salud, el mismo provendrá de los recursos del FONDO SOLIDARIO DE REDISTRIBUCIÓN al que se refiere el artículo 22 de la Ley N° 23.661.
Que para cumplir cabalmente con lo dispuesto por la normativa citada, resulta necesario sustituir el actual esquema de financiamiento por un mecanismo de asignación de recursos innovador, ágil, moderno, adecuado, eficiente, transparente y sustentable.
Que en tal sentido y de acuerdo a las disponibilidades existentes, corresponde instituir un mecanismo de distribución directa de los recursos desde el FONDO SOLIDARIO DE REDISTRIBUCIÓN a los Agentes del Seguro de Salud, para ser destinados exclusivamente al financiamiento de las prestaciones contempladas en el Nomenclador de Prestaciones Básicas para Personas con Discapacidad aprobado mediante Resolución del entonces Ministerio de Salud y Acción Social N° 428/1999 o la norma que en el futuro la reemplace.
Que, en consonancia con los nuevos lineamientos estratégicos de la actual gestión gubernamental, tanto en materia de salud como en lo concerniente a modernización del Estado, se procurará utilizar todas las herramientas que agilicen la gestión administrativa brindando eficiencia y transparencia a los procesos, como así también, asegurando la accesibilidad a los servicios esenciales a un grupo vulnerable como lo son las personas con discapacidad.
Que en mérito a lo expuesto, corresponde facultar a la SUPERINTENDENCIA DE SERVICIOS DE SALUD a adecuar los procedimientos administrativos necesarios y dictar las normas complementarias y aclaratorias para la aplicación del presente Decreto.
Que han tomado la intervención de su competencia los Servicios Jurídicos Permanentes del MINISTERIO DE SALUD y de la SUPERINTENDENCIA DE SERVICIOS DE SALUD.
Que la presente se dicta en virtud de las facultades conferidas por el artículo 99, incisos 1 y 2, de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE
DE LA NACIÓN ARGENTINA
DECRETA:
ARTÍCULO 1° — Institúyese un mecanismo denominado “INTEGRACIÓN” para el financiamiento directo del FONDO SOLIDARIO DE REDISTRIBUCIÓN a los Agentes del Seguro de Salud, de la cobertura de las prestaciones médico asistenciales previstas en el Nomenclador de Prestaciones Básicas para Personas con Discapacidad aprobado por la Resolución del entonces Ministerio de Salud y Acción Social N° 428/1999 o la que en el futuro la reemplace, destinadas a los beneficiarios del Sistema Nacional del Seguro de Salud, el que como ANEXO (IF-2016-00497982-APN-MS) forma parte integrante del presente Decreto.
ARTÍCULO 2° — Facúltase a la SUPERINTENDENCIA DE SERVICIOS DE SALUD a adecuar los procedimientos administrativos necesarios e incorporar el uso de nuevas herramientas tecnológicas como la firma digital y la notificación fehaciente digital, para dotar al sistema de transparencia y eficiencia.
ARTÍCULO 3° — Autorízase a la SUPERINTENDENCIA DE SERVICIOS DE SALUD a dictar las medidas complementarias y aclaratorias para la mejor implementación del nuevo mecanismo, el que reemplazará al actual Sistema Único de Reintegros (S.U.R.) en el financiamiento de las prestaciones básicas destinadas a personas con discapacidad afiliadas al Sistema Nacional del Seguro de Salud.
ARTÍCULO 4° — Comuníquese, publíquese, dése a la DIRECCIÓN NACIONAL DEL REGISTRO OFICIAL y archívese. — MACRI. — Marcos Peña. — Jorge D. Lemus.
ANEXO
MECANISMO “INTEGRACIÓN”
1.- Los Agentes del Seguro de Salud deberán abrir una cuenta bancaria conforme los recaudos exigidos en el primer párrafo del artículo 23 de la Ley N° 23.660, la que se denominará “CUENTA DISCAPACIDAD” y tendrá afectación específica y exclusiva para recibir las transferencias provenientes del FONDO SOLIDARIO DE REDISTRIBUCIÓN y proceder al pago de las prestaciones referidas en el artículo 1° del Decreto del que este ANEXO forma parte.
2.- Los Agentes del Seguro de Salud deberán comunicar mensualmente a la SUPERINTENDENCIA DE SERVICIOS DE SALUD, con carácter de declaración jurada y mediante el formato de notificación fehaciente digital, el padrón de beneficiarios con discapacidad, detallando la nómina de prestaciones que reciben de acuerdo al Nomenclador de Prestaciones Básicas para Personas con Discapacidad aprobado por la Resolución del entonces Ministerio de Salud y Acción Social N° 428/1999 o la norma que en el futuro la reemplace, con la respectiva valorización de las mismas.
3.- La SUPERINTENDENCIA DE SERVICIOS DE SALUD informará mensualmente a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS (AFIP) la asignación que deberá girarse desde el FONDO SOLIDARIO DE REDISTRIBUCIÓN a cada Agente del Seguro de Salud, en cumplimiento del mecanismo de INTEGRACIÓN que se instituye por el presente.
4.- Será requisito excluyente para el cobro directo del financiamiento que, al momento de la liquidación del mismo, el Agente del Sistema Nacional del Seguro de Salud no posea disposiciones de la SUPERINTENDENCIA DE SERVICIOS DE SALUD pendientes de cumplimiento, por negativa de afiliación y/o por falta de cobertura a personas con discapacidad.
5.- La SUPERINTENDENCIA DE SERVICIOS DE SALUD detraerá mensualmente de la base de cálculo a elevar a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS (AFIP), los Agentes del Sistema Nacional del Seguro de Salud que se encuentren en las condiciones indicadas en el punto anterior y que, habiendo sido intimados previamente en forma fehaciente, continuarán con el incumplimiento de aquellos trámites detallados en el apremio notificado.
