SÍNTESIS.- En el caso, corresponde revocar la resolución de grado en cuanto declinó la competencia de este fuero por considerarse incompetente en razón del territorio.
En efecto, la Judicante sostuvo que el hecho denunciado debía ser investigado por el tribunal que corresponde al lugar donde la víctima recibió las primeras atenciones médicas, sito en la Ciudad de San Carlos de Bariloche, antes del desenlace fatal producido en esta Ciudad.
Al respecto, si bien en el decreto de determinación de los hechos la conducta investigada fue «prima facie» calificada como constitutiva de la figura de abandono de persona seguido de muerte (art. 106 del C. Penal), los elementos hasta ahora recolectados no resultan suficientes para, por un lado, establecer en forma acabada dónde se produjo la desatención médica de la víctima que culminó con su posterior fallecimiento; y por otro, identificar a los posibles autores del hecho y comprobar quién se encontraba en posición de garante para evitar la puesta en peligro de la salud y la integridad física del fenecido.
En estas condiciones, la declinatoria de competencia resulta a todas luces prematura, pues toda decisión de esa naturaleza merece encontrarse precedida de una adecuada investigación que permita individualizar los hechos sobre los cuales versa, las circunstancias de modo y lugar en que habrían ocurrido y las calificaciones que les pueden ser atribuidas (Fallos 306:7278; 301:472 y 302:853), extremos que aún no se verifican en forma fehaciente en el trámite de las presentes actuaciones.
