Por medio de la Resolución 162 del Ministerio de Agroindustria, publicada en el Boletín Oficial del 3/05/2016, se estableció un Régimen de Compensaciones para Productores Tamberos, cuya Autoridad de Aplicación será la SUBSECRETARÍA DE LECHERÍA dependiente de la SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA del MINISTERIO DE AGROINDUSTRIA, que será responsable de su ejecución como así también de dictar las normas complementarias que contribuyan a su implementación.

Bs. As., 02/05/2016
VISTO el Expediente N° S05:0017936/2016 del Registro del MINISTERIO DE AGROINDUSTRIA, la Ley de Ministerios (texto ordenado por Decreto N° 438/92) y sus modificaciones, la Resolución Conjunta N° 8 y N° 9 de fecha 1 de febrero de 2016 del MINISTERIO DE AGROINDUSTRIA y del MINISTERIO DE PRODUCCIÓN respectivamente, el Acta Compromiso suscripta el día 8 de enero de 2016 entre el ESTADO NACIONAL, los Gobiernos de las Provincias que conforman el CONSEJO FEDERAL LECHERO, Representantes de la Producción Primaria, la ASOCIACIÓN DE PEQUEÑAS Y MEDIANAS EMPRESAS LÁCTEAS, el CENTRO DE LA INDUSTRIA LECHERA y la JUNTA INTERCOOPERATIVA DE PRODUCTORES DE LECHE, y
CONSIDERANDO:
Que es interés del ESTADO NACIONAL que todos los eslabones productivos de la cadena láctea continúen su proceso de expansión de la oferta en el mediano plazo, incrementando asimismo la productividad por unidad económica y la industrialización de la materia prima.
Que dada la sobreoferta de productos lácteos en el mercado internacional, los precios a nivel mundial se encuentran por debajo de los valores promedio históricos, lo cual dificulta la colocación de los productos nacionales en dicho mercado internacional y deriva en una crisis local que se ve profundizada por el aumento en los niveles de stock de los productos terminados y en el incremento de los costos de producción de los productores tamberos.
Que en tal contexto, con fecha 8 de enero del corriente se suscribió entre los actores del sector lechero el Acta Compromiso citada en el Visto, a través de la que se comprometieron a la ejecución de distintas medidas tendientes a propender al crecimiento sostenible de la actividad láctea considerando el mercado interno y la exportación.
Que dichas medidas apuntan a promover el crecimiento sostenido del sector, mejorar los ingresos de los productores, asegurar el abastecimiento al mercado interno, promover una formación transparente de precios en todos los eslabones de la cadena, generar precios razonables para productos de consumo masivo y a la vez fortalecer la inserción de la lechería argentina en el mercado internacional.
Que por medio de la Resolución Conjunta N° 8 y N° 9 de fecha 1 de febrero de 2016 del MINISTERIO DE AGROINDUSTRIA y del MINISTERIO DE PRODUCCIÓN, respectivamente, se creó el “Régimen de Compensaciones para Productores Tamberos” designándose como Autoridad de Aplicación a la SUBSECRETARÍA DE LECHERÍA dependiente de la SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA del MINISTERIO DE AGROINDUSTRIA.
Que analizado el mencionado Régimen, se vislumbra que el pago de compensaciones ha significado un sostén para los establecimientos productivos, logrando contener a los tamberos argentinos que sufren las consecuencias de la crisis generalizada que atraviesa el sector, por lo que resulta procedente el establecimiento de un Régimen análogo en el ámbito de este Ministerio.
Que a los fines de otorgar una mayor operatividad al mecanismo previsto en la presente medida, resulta conveniente considerar la producción lograda en el período comprendido entre los meses de febrero y marzo de 2016, cuyos datos se encuentran ya procesados y reflejan la productividad promedio de los establecimientos.
Que la Dirección General de Asuntos Jurídicos del MINISTERIO DE AGROINDUSTRIA ha tomado la intervención que le compete.
Que la presente medida se dicta en uso de las facultades establecidas por la Ley de Ministerios (texto ordenado por Decreto N° 438/92), y sus modificaciones.
Por ello,
EL MINISTRO
DE AGROINDUSTRIA
RESUELVE:
Artículo 1° — Establécese, en el ámbito del MINISTERIO DE AGROINDUSTRIA, un Régimen de Compensaciones para Productores Tamberos, cuya Autoridad de Aplicación será la SUBSECRETARÍA DE LECHERÍA dependiente de la SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA del MINISTERIO DE AGROINDUSTRIA, que será responsable de su ejecución como así también de dictar las normas complementarias que contribuyan a su implementación.
Art. 2° — El beneficio contemplado en el presente Régimen consiste en un aporte de PESOS CERO COMA CUARENTA CENTAVOS ($ 0,40) por litro para los primeros TRES MIL LITROS (3.000 I) diarios de producción de leche cruda para los meses de febrero y marzo de 2016.
Para establecer el monto de los beneficios se tomará como base de cálculo lo producido y comercializado mensualmente por los productores tamberos durante el período consignado en el párrafo precedente, independientemente de la cantidad de unidades productivas que exploten.
Art. 3° — Estarán alcanzados por el aporte correspondiente al presente Régimen todos los productores tamberos que contando con Clave Única de Identificación Tributaria (C.U.I.T.) hubiesen producido y comercializado leche cruda durante los meses de febrero y marzo de 2016, y estuvieren incluidos en la nómina de tambos proveedores de cualesquiera de los operadores lácteos con los que comercializaron su producción en los referidos meses.
Estarán asimismo alcanzados por la presente medida, los siguientes sujetos:
a) Todos los productores tamberos que hubiesen producido y elaborado leche cruda en tambos de su propiedad durante los meses de febrero y marzo de 2016; y
b) Los “tambos fábrica” contemplados en la Ley N° 11.089 de la Provincia de BUENOS AIRES, entendiendo por tales a toda persona física o jurídica que, siendo productor tambero, sea asimismo responsable de la semi-elaboración de leche obtenida exclusivamente en su establecimiento agropecuario y bajo la forma de masa para mozzarella. En estos casos, a efectos de establecer la compensación, serán considerados los kilogramos de masa para mozzarella que han sido facturados durante los meses de febrero y marzo de 2016, y se computará un rendimiento de DIEZ (10) litros de leche cruda necesarios para elaborar UN KILOGRAMO (1 kg) de masa para mozzarella.
Art. 4° — Los beneficiarios del presente Régimen deberán informar los datos referidos a la Clave Bancaria Uniforme (C.B.U.) de su titularidad donde recibirán los aportes.
Art. 5° — Los operadores lácteos que hayan realizado operaciones de compra de leche cruda a productores tamberos durante los meses de febrero y marzo de 2016 deberán presentar ante la Autoridad de Aplicación la solicitud cuyo formulario obra como Anexo I de la presente resolución, conteniendo la información por separado respecto de cada uno de los meses a compensar.
Los beneficiarios contemplados por el Artículo 3° inciso a), deberán presentar los Anexos I y II y los beneficiarios contemplados en el inciso b) del mismo artículo deberán presentar el Anexo III.
La solicitud con sus respectivos anexos deberá ser presentada con carácter de declaración jurada, con firmas certificadas por Escribano Público, Juez de Paz o autoridad bancaria, en soporte papel, en la oficina de Atención al Público de la SUBSECRETARÍA DE LECHERÍA, sita en Avenida Paseo Colón N° 982, segundo piso, Oficina N° 204, código postal C1063ACW de la CIUDAD AUTÓNOMA DE BUENOS AIRES; y en formato digital a la casilla de correo electrónico: compensacioneslecheria@magyp.gob.ar .
Art. 6° — A los fines de efectuar el control y supervisión del correcto pago de los aportes establecidos por la presente resolución, la SUBSECRETARÍA DE LECHERÍA, en su carácter de Autoridad de Aplicación, podrá solicitar la documentación respaldatoria que entienda pertinente para la verificación de los datos brindados mediante declaración jurada, la que deberá ser puesta a disposición de aquélla al simple requerimiento y en la forma que fuera solicitada, pudiendo asimismo realizar dichos controles de documentación en los establecimientos. Ante la omisión o falseamiento de los datos declarados a los fines de liquidar los aportes establecidos por la presente medida, la Autoridad de Aplicación podrá realizar las denuncias judiciales o administrativas que en su caso correspondan.
Art. 7° — La SUBSECRETARÍA DE LECHERÍA aprobará los aportes a los beneficiarios mediante disposición dictada a ese efecto y procederá a la instrumentación de los pagos mediante resolución del MINISTERIO DE AGROINDUSTRIA, los que se realizarán mediante transferencias bancarias efectuadas en forma mensual.
Art. 8° — Dentro de los CINCO (5) días hábiles siguientes a la publicación en el Boletín Oficial de la presente medida, las provincias que lo deseen podrán adherirse al presente Régimen, asumiendo el compromiso de un “Aporte Adicional” por la suma de PESOS CERO COMA DIEZ CENTAVOS ($ 0,10) por litro para los primeros TRES MIL LITROS (3.000 I) diarios de producción según lo producido en el período comprendido entre los meses de febrero y marzo de 2016, que el MINISTERIO DE AGROINDUSTRIA podrá incluir al aporte previsto en el Artículo 2° de la presente resolución.
Dicho Aporte Adicional sólo será incluido en los casos en que el Gobernador de la provincia a la que pertenece el beneficiario, haya suscripto y remitido al MINISTERIO DE AGROINDUSTRIA la Nota de Adhesión que como Anexo IV forma parte integrante de la presente medida, en el plazo indicado, comprometiéndose a la devolución del mencionado Aporte Adicional al Tesoro Nacional.
Art. 9° — Los importes liquidados a los productores tamberos en concepto de compensaciones establecidas en la presente resolución serán publicados en la página: http://www.agroindustria.gob.ar.
Art. 10. — Establécese un plazo de TREINTA (30) días hábiles desde la publicación de la presente resolución en el Boletín Oficial para la presentación de la documentación necesaria para el pago de los aportes. Toda la documentación entregada luego de vencido el plazo previsto no será analizada por la SUBSECRETARÍA DE LECHERÍA, perdiéndose en consecuencia la posibilidad de cobro.
Art. 11. — Los gastos que demande la financiación del presente “Régimen de Compensaciones para Productores Tamberos” serán imputados al inciso 5) del presupuesto vigente del MINISTERIO DE AGROINDUSTRIA, quedando limitados a un monto máximo total de PESOS QUINIENTOS MILLONES ($ 500.000.000.-).
Art. 12. — La presente resolución tendrá vigencia a partir de su publicación en el Boletín Oficial.
