Por decreto 205/2016 (B.O. 19/1/2016) se adoptaron las disposiciones de la Resolución N° 9 de fecha 13 de mayo de 2014 del Grupo Mercado Común y de la Decisión N° 26 de fecha 16 de julio de 2015 del Consejo del Mercado Común, lo cual implica la modificación de la Nomenclatura Común del MERCOSUR y su correspondiente Arancel Externo Común así como la modificación de los plazos previstos en el Artículo 1 de la Decisión CMC N° 58/10 que autoriza a los Estados Partes a mantener una Lista Nacional de Excepciones al Arancel Externo Común (AEC), todo ello conforme los términos y alcances que se especifican en los anexos que forman parte de la norma en comentario.

VISTO el Expediente N° S01:0186737/2015 del Registro del ex MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS, y
CONSIDERANDO:
Que a través de la Decisión N° 58 de fecha 16 de diciembre de 2010 del Consejo del Mercado Común se autorizó a la REPÚBLICA ARGENTINA a mantener, hasta el día 31 de diciembre de 2015, una Lista Nacional de Excepciones al Arancel Externo Común (A.E.C.) de hasta CIEN (100) códigos de la Nomenclatura Común del MERCOSUR (N.C.M.).
Que el Decreto N° 100 de fecha 12 de enero de 2012 en su Artículo 15, adoptó las disposiciones de la norma comunitaria mencionada en el considerando precedente.
Que asimismo, el Artículo 2° del mencionado decreto, actualizó la señalada Lista Nacional de Excepciones, sustituyendo el Anexo II del Decreto N° 509 de fecha 15 de mayo de 2007 y sus modificaciones, por el Anexo II allí establecido.
Que, por otro lado, mediante la Decisión N° 26 de fecha 16 de julio de 2015 del Consejo del Mercado Común, se modificaron los plazos previstos en el Artículo 1 de la citada Decisión N° 58/10 del Consejo del Mercado Común, estableciéndose, para la REPÚBLICA ARGENTINA, la posibilidad de mantener una Lista Nacional de Excepciones hasta el día 31 de diciembre de 2021, manteniéndose vigentes los demás plazos y condiciones en ella previstos.
Que por otro lado, entre los códigos de la Lista Nacional de Excepciones actualmente vigente, se encuentra contemplada la posición arancelaria de la Nomenclatura Común del MERCOSUR (N.C.M.) 2826.12.00, por la cual clasifica la mercadería denominada “fluoruro de aluminio”, fijándose para la misma un Derecho de Importación Extrazona del DOS POR CIENTO (2%).
Que el Arancel Externo Común (A.E.C.) acordado a nivel regional sobre ese compuesto químico, fue objeto de las modificaciones introducidas por la Resolución N° 9 de fecha 13 de mayo de 2014 del Grupo Mercado Común, que estableciera para el mismo una alícuota del DOS POR CIENTO (2%).
Que, por la equiparación de las alícuotas señaladas, resulta ocioso mantener incluido al producto en cuestión en la Lista Nacional de Excepciones, correspondiendo su exclusión.
Que, además, resulta conveniente incorporar en la mencionada lista, a los herbicidas que clasifican por la posición arancelaria de la Nomenclatura Común del MERCOSUR (N.C.M.) 3808.93.24, elaborados a base de glifosato o de sus sales.
Que, por otro lado, corresponde adecuar la excepción actualmente establecida para la posición arancelaria de la Nomenclatura Común del MERCOSUR (N.C.M.) 3824.90.31, reemplazándola por el código 3909.30.20, en orden a las disposiciones de la ORGANIZACIÓN MUNDIAL DE ADUANAS (O.M.A.) sobre la materia.
Que, en consecuencia, corresponde incorporar al ordenamiento jurídico de la REPÚBLICA ARGENTINA la Resolución N° 9/14 del Grupo Mercado Común y la Decisión N° 26/15 del Consejo del Mercado Común, efectuando las adecuaciones correspondientes en los Anexos I y II del Decreto N° 509/07 y sus modificaciones.
Que han tomado intervención las áreas técnicas pertinentes del MINISTERIO DE PRODUCCIÓN y del MINISTERIO DE HACIENDA Y FINANZAS PÚBLICAS.
Que la Dirección General de Asuntos Jurídicos del MINISTERIO DE PRODUCCIÓN ha tomado la intervención que le compete.
Que el PODER EJECUTIVO NACIONAL se encuentra facultado para el dictado del acto, en virtud de las atribuciones conferidas por el artículo 99, inciso 1 de la CONSTITUCION NACIONAL y de los artículos 11, apartado 2, y 12 de la Ley N° 22.415 (Código Aduanero) y sus modificaciones, tal como se consignara en el Decreto N° 509/07 y sus modificatorios.
Por ello,

DECRETA:
Artículo 1° — Adóptanse las disposiciones de la Resolución N° 9 de fecha 13 de mayo de 2014 del Grupo Mercado Común y de la Decisión N° 26 de fecha 16 de julio de 2015 del Consejo del Mercado Común, que en copia autenticada se reproducen en TRES (3) planillas que, como Anexo I, forman parte integrante de la presente medida.
Art. 2° — Modifícase el Anexo I del Decreto N° 509 de fecha 15 de mayo de 2007 y sus modificaciones, de acuerdo al detalle que se consigna en la planilla que, como Anexo II, forma parte integrante del presente decreto.
Art. 3° — Sustitúyese el Anexo II del Decreto N° 509/07 y sus modificaciones, por el consignado en las DOS (2) planillas que, como Anexo III, forman parte integrante de la presente medida.
Art. 4° — Lo dispuesto en el Artículo 3° del presente decreto, mantendrá su vigencia en los términos de la citada Decisión N° 26/15 del Consejo del Mercado Común.
Art. 5° — Remítase copia autenticada de la presente medida al MINISTERIO DE RELACIONES EXTERIORES Y CULTO atento a su carácter de Coordinador de la Sección Nacional del Grupo Mercado Común.
Art. 6° — El presente decreto comenzará a regir a partir del día siguiente al de su publicación en el Boletín Oficial.

VISTO: El Tratado de Asunción, el Protocolo de Ouro Preto, las Decisiones N° 07/94, 22/94 y 31/04 del Consejo del Mercado Común y la Resolución N° 05/11 del Grupo Mercado Común.
CONSIDERANDO:
Que se hace necesario ajustar la Nomenclatura Común del MERCOSUR y su correspondiente Arancel Externo Común, instrumentos esenciales de la Unión Aduanera.
EL GRUPO MERCADO COMÚN
RESUELVE:
Art. 1 – Aprobar la “Modificación de la Nomenclatura Común del MERCOSUR y su correspondiente Arancel Externo Común”, en sus versiones en español y portugués, que constan como Anexo y forman parte de la presente Resolución.
Art. 2 – Las modificaciones a la Nomenclatura Común del MERCOSUR y su correspondiente Arancel Externo Común, aprobadas por la presente Resolución, tendrán vigencia antes del 01/I/2015, debiendo los Estados Partes asegurar su incorporación a sus respectivos ordenamientos jurídicos nacionales antes de esa fecha.

VISTO: El Tratado de Asunción, el Protocolo de Ouro Preto y las Decisiones N° 07/94, 22/94. 68/00, 31/03, 38/05, 59/07, 28/09 y 58/10 del Consejo del Mercado Común.
CONSIDERANDO:
Que la consecución de los objetivos del Tratado de Asunción requiere la adopción de instrumentos de política comercial que promuevan la competitividad en la región.
Que una adecuada gestión de la política arancelaria del MERCOSUR debe tener en cuenta la coyuntura económica internacional.
EL CONSEJO DEL MERCADO COMÚN
DECIDE:
Art. 1 – Modificar los plazos previstos en el Artículo 1 de la Decisión CMC N° 58/10 que autoriza a los Estados Partes a mantener una Lista Nacional de Excepciones al Arancel Externo Común (AEC) en los siguientes términos:
a) República Argentina: hasta 100 códigos NCM hasta el 31 de diciembre de 2021
b) República Federativa del Brasil: hasta 100 códigos NCM hasta el 31 de diciembre de 2021
c) República del Paraguay: hasta 649 códigos NCM hasta el 31 de diciembre de 2023
d) República Oriental del Uruguay: hasta 225 códigos NCM hasta el 31 de diciembre de 2022
e) República Bolivariana de Venezuela: hasta 225 códigos NCM hasta el 31 de diciembre de 2022
Art. 2 – Continuarán vigentes los demás plazos y condiciones previstos en la Decisión CMC N° 58/10.
Art. 3 – Esta Decisión deberá ser incorporada al ordenamiento jurídico de los Estados Partes antes del 01/XI/2015.
