Por medio del decreto 117/2016, publicado en el Boletín Oficial del 13/01/2016, con el fin de garantizar la publicidad de los actos de Gobierno y el derecho de acceso a la información pública, se instruyó a los Ministerios, Secretarías y organismos desconcentrados y descentralizados dependientes del PODER EJECUTIVO NACIONAL, a elaborar y presentar en un plazo no mayor a CIENTO OCHENTA (180) días desde la entrada en vigencia del presente, ante el MINISTERIO DE MODERNIZACIÓN y a los efectos de su publicación, un “Plan de Apertura de Datos”, el que deberá detallar los activos de datos bajo su jurisdicción y/o tutela, así como el cronograma de publicación aplicable a los mismos conforme los lineamientos que oportunamente defina el mencionado MINISTERIO DE MODERNIZACIÓN en su calidad de Autoridad de Aplicación.
El “Plan de Apertura de Datos”, contemplará un cronograma de publicación gradual de todos los datos producidos, almacenados o recopilados en medios digitales, cuya publicidad no se encuentre excluida por normas específicas.

VISTO el Expediente N° CUDAP: EXP-JGM:0000436/2016, la CONSTITUCIÓN NACIONAL, la Declaración Universal de los Derechos Humanos, el Pacto Internacional de Derechos Civiles y Políticos, la Convención Americana sobre Derechos Humanos, la Convención de las Naciones Unidas contra la Corrupción, la Convención Interamericana contra la Corrupción, la Ley de Ministerios (texto ordenado por Decreto N° 438/92) y sus modificatorias, y el Decreto N° 13 de fecha 10 de diciembre de 2015, y
CONSIDERANDO:
Que la CONSTITUCIÓN NACIONAL garantiza el principio de publicidad de los actos de Gobierno y el derecho de acceso a la información pública a través de los artículos 33, 41, 42 y 75 inciso 22, por el cual se incorporan con jerarquía constitucional diversos Tratados Internacionales;
Que el derecho de buscar y recibir información ha sido consagrado expresamente por la Declaración Universal de los Derechos Humanos (artículo 19), por el Pacto Internacional de Derechos Civiles y Políticos (artículo 19.2) y por la Convención Americana sobre Derechos Humanos (artículo 13.1.), incluidos en la mencionada disposición constitucional.
Que la Asamblea General de la Organización de las Naciones Unidas afirmó en su resolución 59 (I) que “la libertad de información es un derecho humano fundamental”, pronunciándose en el mismo sentido la Corte Interamericana de Derechos Humanos en el caso Claude Reyes y otros vs. Chile reconociendo como fundamental el derecho de acceso a la información pública en su doble vertiente, tanto como derecho individual de toda persona, así como obligación positiva del Estado para garantizar el efectivo ejercicio de dicho derecho.
Que la CORTE SUPREMA DE JUSTICIA DE LA NACIÓN y diversos tribunales inferiores de nuestro país han decidido en el mismo sentido que los citados antecedentes internacionales.
Que tanto la Convención de la Naciones Unidas contra la Corrupción (artículos 10 y 13) como la Convención Interamericana contra la Corrupción (párrafo 5 de su Preámbulo, y artículos III.11 y XIV.2) promueven la transparencia, el acceso a la información pública y la participación de la sociedad civil en la lucha contra la corrupción.
Que por el Decreto N° 13 de fecha 10 de diciembre de 2015, se sustituyó el Artículo 1° de la Ley de Ministerios (texto ordenado por Decreto N° 438/92) y sus modificatorias, creándose el MINISTERIO DE MODERNIZACIÓN, con el propósito de implementar nuevas formas de gestión que requiere un Estado moderno, como así también el desarrollo de tecnologías aplicadas a la administración pública central y descentralizada, que acerquen al ciudadano a la gestión del Gobierno Nacional.
Que entre las atribuciones asignadas al MINISTERIO DE MODERNIZACIÓN, se encuentra la de diseñar, proponer y coordinar las políticas de transformación y modernización del Estado en las distintas áreas y determinar los lineamientos estratégicos y la propuesta de las normas reglamentarias en la materia, como así también definir el Plan de Modernización y ejercer funciones como Autoridad de Aplicación del mismo.
Que entre las políticas a implementarse en el marco de la modernización del Estado se encuentran aquellas referidas al Gobierno Abierto, cuya realización requiere de la adopción de medidas que favorezcan la gestión de los conjuntos sistematizados de datos preservados digitalmente por los distintos Ministerios, Secretarías y organismos descentralizados del PODER EJECUTIVO NACIONAL como un activo cívico y gubernamental de carácter estratégico.
Que la República Argentina es Miembro de la Alianza para el Gobierno Abierto desde el año 2012, la cual es promotora de los principios de transparencia, colaboración y participación a nivel internacional, y ante la cual República Argentina ha presentado DOS (2) Planes de Acción con Compromisos concretos en torno a dichos principios.
Que la disponibilidad de los datos públicos en condiciones adecuadas para su uso y reutilización constituye un elemento catalizador para el fortalecimiento del proceso democrático, el desarrollo de políticas públicas basadas en la evidencia, la provisión de servicios públicos centrados en el usuario, y la promoción del desarrollo social, económico, científico y cultural de la Nación.
Que para garantizar lo antedicho, los datos públicos deben ser publicados en forma proactiva, completa y oportuna, en y por los canales, medios, formatos y bajo licencias que mejor faciliten su ubicación, acceso, procesamiento, uso, reutilización y redistribución.
Que en este sentido, los Ministerios, Secretarias y organismos descentralizados del PODER EJECUTIVO NACIONAL deberán diseñar un “Plan de Apertura de Datos”, el que contemplará un cronograma de publicación gradual de todos los datos producidos, almacenados o recopilados en medios digitales, cuya publicidad no se encuentre excluida por normas específicas.
Que el MINISTERIO DE MODERNIZACIÓN en su calidad de Autoridad de Aplicación del régimen de modernización, deberá coordinar la recepción de la mencionada información, cuya publicidad sólo será limitada cuando así lo dispongan normas específicas de aplicación o por razones fundadas de oportunidad, mérito y conveniencia, a juicio de dicha cartera ministerial.
Que la Secretaria de Ética Pública, Transparencia y Lucha contra la Corrupción a cargo de la OFICINA ANTICORRUPCIÓN ha tomado debida intervención.
Que la presente medida se dicta en ejercicio de las atribuciones conferidas por el artículo 99, inciso 1 de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE
DE LA NACIÓN ARGENTINA
DECRETA:
Artículo 1° — Instrúyese a los Ministerios, Secretarías y organismos desconcentrados y descentralizados dependientes del PODER EJECUTIVO NACIONAL, a elaborar y presentar en un plazo no mayor a CIENTO OCHENTA (180) días desde la entrada en vigencia del presente, ante el MINISTERIO DE MODERNIZACIÓN y a los efectos de su publicación, un “Plan de Apertura de Datos”, el que deberá detallar los activos de datos bajo su jurisdicción y/o tutela, así como el cronograma de publicación aplicable a los mismos conforme los lineamientos que oportunamente defina el mencionado MINISTERIO DE MODERNIZACIÓN en su calidad de Autoridad de Aplicación.
La publicación mencionada en el párrafo precedente, sólo será limitada cuando así lo dispongan normas específicas de aplicación o por razones fundadas en oportunidad, mérito y conveniencia, a juicio de la Autoridad de Aplicación.
Art. 2° — Arbítrense los medios necesarios para publicar en un plazo no mayor a NOVENTA (90) días, y mantener actualizado a través del Portal Nacional de Datos Públicos:
a) la estructura orgánica del PODER EJECUTIVO NACIONAL;
b) la nómina de Autoridades Superiores del PODER EJECUTIVO NACIONAL, así como la Declaración Jurada Patrimonial Integral de carácter público que a cada uno de ellos corresponda;
c) la nómina del personal contratado vigente, según conste en la Oficina Nacional de Empleo Público;
d) los escalafones y escalas salariales aplicables a los diferentes regímenes de empleo público;
e) los créditos presupuestarios, según surjan del Sistema Integrado de Información Financiera;
f) las contrataciones que tramiten en el sistema Sistema Electrónico de Contrataciones Públicas;
g) las Solicitudes de Acceso a la Información recibidas en virtud del Reglamento de Acceso a la Información Pública;
h) las Audiencias de Gestión de Intereses, según consten en el Registro Único de Audiencias de Gestión de Intereses del PODER EJECUTIVO NACIONAL.
Art. 3° — El MINISTERIO DE MODERNIZACIÓN en su calidad de Autoridad de Aplicación, realizará el seguimiento de lo dispuesto en el presente decreto y brindará la asistencia técnica requerida para su mejor implementación.
Art. 4° — El MINISTERIO DE MODERNIZACIÓN y la JEFATURA DE GABINETE DE MINISTROS, en forma conjunta, realizarán el dictado de las normas reglamentarias, aclaratorias, interpretativas y/o complementarias que resulten necesarias para la mejor implementación de lo establecido en el presente Decreto.
Art. 5° — El presente decreto entrará en vigencia a partir de la fecha de su publicación en el Boletín Oficial.
