Por medio del Decreto 257/15, publicado en el Boletín Oficial del 29/12/15, se aplazó la entrada en vigencia del Código Procesal Penal de la Nación aprobado por la ley 27.063. El mismo entrará en vigencia de conformidad con el cronograma de implementación progresiva que establezca la COMISIÓN BICAMERAL DE MONITOREO E IMPLEMENTACIÓN DEL NUEVO CÓDIGO PROCESAL PENAL DE LA NACIÓN que funciona en el ámbito del HONORABLE CONGRESO DE LA NACIÓN, previa consulta con el MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS y el CONSEJO DE LA MAGISTRATURA DE LA NACIÓN.

Ley N° 27.148, N° 27.149, N° 27.150, N° 27.198 y N° 27.063. Modificaciones.
Bs. As., 24/12/2015
VISTO la Ley N° 27.063, la Ley Orgánica del Ministerio Público Fiscal de la Nación N° 27.148, la Ley Orgánica del Ministerio Público de la Defensa de la Nación N° 27.149, la Ley de Implementación del Código Procesal Penal de la Nación N° 27.150, la Ley N° 27.198, y
CONSIDERANDO:
Que la Ley N° 27.063, por el artículo 1°, aprobó el CÓDIGO PROCESAL PENAL DE LA NACIÓN y, por su artículo 3°, estableció que dicho cuerpo legal entraría en vigencia en la oportunidad que estableciera una Ley de Implementación.
Que el 10 de junio del corriente año el HONORABLE CONGRESO DE LA NACIÓN sancionó un conjunto de leyes destinadas a implementar la reforma procesal penal instaurada en la Ley N° 27.063.
Que la Ley de Organización y Competencia de la Justicia Federal y Nacional Penal N° 27.146 estableció, en su artículo 51, que: “Las disposiciones de la presente ley se aplicarán de acuerdo al régimen progresivo que establezca la Ley de Implementación del Código Procesal Penal de la Nación”.
Que la Ley N° 27.148 rediseñó la estructura y funcionamiento del MINISTERIO PÚBLICO FISCAL DE LA NACIÓN a fin de adaptarlo a las necesidades del sistema procesal acusatorio y que, con similar objeto, se dictó la Ley N° 27.149 en lo que respecta al MINISTERIO PÚBLICO DE LA DEFENSA DE LA NACIÓN.
Que, por último, la Ley N° 27.150 estableció los mecanismos para implementar el CÓDIGO PROCESAL PENAL DE LA NACIÓN, y por el artículo 2° dispuso la entrada en vigencia de ese Código a partir del 1° de marzo de 2016 en el ámbito de la Justicia Nacional.
Que en virtud de la magnitud de la tarea aún pendiente, la cual ha sido advertida por la COMISIÓN BICAMERAL DE MONITOREO E IMPLEMENTACIÓN DEL NUEVO CÓDIGO PROCESAL PENAL DE LA NACIÓN, creada en el ámbito del HONORABLE CONGRESO DE LA NACIÓN por el artículo 7° de la Ley N° 27.063, y por la Unión de Empleados de la Justicia de la Nación, no se encuentran reunidas las condiciones básicas para asegurar la implementación proyectada en el plazo oportunamente establecido.
Que, en consecuencia, tal implementación en las actuales condiciones pondría en grave riesgo la correcta administración de justicia.
Que las reformas operadas por las Leyes Nros. 27.148, 27.149, y 27.150, encuentran su razón de ser y operatividad funcional en la efectiva puesta en marcha del CÓDIGO PROCESAL PENAL DE LA NACIÓN sancionado por la Ley N° 27.063.
Que, dada la imposibilidad de que ello ocurra antes del 1° de marzo de 2016, resulta razonable dejar sin efecto aquellos aspectos de las Leyes Nros. 27.063, 27.148, 27.149 y 27.150 vinculados con la implementación del CÓDIGO PROCESAL PENAL DE LA NACIÓN. Todo ello con la finalidad de evitar la aplicación asistemática y carente de integralidad de un diseño institucional cuya puesta en funcionamiento no se encuentra acabadamente planificada.
Que, en atención al diferimiento de la entrada en vigencia del CÓDIGO PROCESAL PENAL DE LA NACION aprobado por la Ley N° 27.063, corresponde también sustituir los artículos 39 de la Ley N° 27.148 y 65 de la Ley N° 27.149, toda vez que aluden a una pauta presupuestaria vinculada directamente a la efectiva puesta en funcionamiento de las nuevas estructuras y organismos previstos por las respectivas leyes orgánicas del Ministerio Público.
Que, en consecuencia, se prevé el establecimiento de un mecanismo progresivo de asignación de recursos para atender las erogaciones que demande la efectiva implementación del CÓDIGO PROCESAL PENAL DE LA NACION.
Que, en vista de las razones aquí expuestas, y en atención al período de receso legislativo que se extiende hasta el 1° de marzo de 2016, se verifican las circunstancias de carácter excepcional a las que hace referencia el inciso 3 del artículo 99 de la CONSTITUCIÓN NACIONAL, que hacen imposible seguir los trámites ordinarios previstos para la sanción de las leyes.
Que el presente no implica modificación alguna de normas de carácter penal, sino que proyecta sus efectos sobre la organización, el funcionamiento y aspectos presupuestarios del Ministerio Público.
Que la Ley N° 26.122 regula el trámite y los alcances de la intervención del HONORABLE CONGRESO DE LA NACIÓN respecto de los Decretos de Necesidad y Urgencia dictados por el PODER EJECUTIVO NACIONAL, en virtud de lo dispuesto por el artículo 99, inciso 3, de la CONSTITUCIÓN NACIONAL.
Que la citada ley determina que la COMISIÓN BICAMERAL PERMANENTE tiene competencia para pronunciarse respecto a la validez o invalidez de los Decretos de Necesidad y Urgencia, así como elevar el dictamen al plenario de cada Cámara para su expreso tratamiento, en el plazo de DIEZ (10) días hábiles.
Que el artículo 22 de la Ley N° 26.122 dispone que las Cámaras se pronuncien mediante sendas resoluciones y que el rechazo o aprobación de los decretos deberá ser expreso conforme lo establecido en el artículo 82 de la Carta Magna.
Que el servicio jurídico permanente del MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS ha tomado la intervención de su competencia.
Que la presente medida se dicta en uso de las atribuciones conferidas por el artículo 99, inciso 3 de la CONSTITUCIÓN NACIONAL y de acuerdo con los artículos 2°, 19 y 20 de la Ley N° 26.122.
Por ello,
EL PRESIDENTE
DE LA NACIÓN ARGENTINA
EN ACUERDO GENERAL DE MINISTROS
DECRETA:
Artículo 1° — Sustitúyese el artículo 2° de la Ley N° 27.150 por el siguiente:
“ARTÍCULO 2°.- Entrada en vigencia. El Código Procesal Penal de la Nación aprobado por la Ley N° 27.063 entrará en vigencia de conformidad con el cronograma de implementación progresiva que establezca la COMISIÓN BICAMERAL DE MONITOREO E IMPLEMENTACIÓN DEL NUEVO CÓDIGO PROCESAL PENAL DE LA NACIÓN que funciona en el ámbito del HONORABLE CONGRESO DE LA NACIÓN, previa consulta con el MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS y el CONSEJO DE LA MAGISTRATURA DE LA NACIÓN.
Art. 2° — Sustitúyese el artículo 39 de la Ley N° 27.148 por el siguiente:
“ARTÍCULO 39.- Plan Progresivo de Asignación de Recursos. Finalizado el proceso de implementación establecido en la Ley N° 27.150, se convocará a una Comisión Técnica a integrarse por representantes del MINISTERIO PÚBLICO FISCAL DE LA NACIÓN, del MINISTERIO DE HACIENDA Y FINANZAS PÚBLICAS, de la COMISIÓN DE PRESUPUESTO Y HACIENDA de la HONORABLE CÁMARA DE DIPUTADOS DE LA NACIÓN, de la COMISIÓN BICAMERAL DE MONITOREO E IMPLEMENTACIÓN DEL NUEVO CÓDIGO PROCESAL PENAL DE LA NACIÓN que funciona en el ámbito del HONORABLE CONGRESO DE LA NACIÓN y del MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS a los efectos de establecer un Plan Progresivo de Asignación de Recursos para el MINISTERIO PÚBLICO FISCAL DE LA NACIÓN.”
Art. 3° — Sustitúyese el artículo 65 de la Ley N° 27.149 por el siguiente:
“ARTÍCULO 65.- Plan Progresivo de Asignación de Recursos. Finalizado el proceso de implementación establecido en la Ley N° 27.150, se convocará a una Comisión Técnica a integrarse por representantes del MINISTERIO PÚBLICO DE LA DEFENSA DE LA NACIÓN, del MINISTERIO DE HACIENDA Y FINANZAS PÚBLICAS, de la COMISIÓN DE PRESUPUESTO Y HACIENDA de la HONORABLE CÁMARA DE DIPUTADOS DE LA NACIÓN, de la COMISIÓN BICAMERAL DE MONITOREO E IMPLEMENTACIÓN DEL NUEVO CÓDIGO PROCESAL PENAL DE LA NACIÓN que funciona en el ámbito del HONORABLE CONGRESO DE LA NACIÓN y del MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS a los efectos de establecer un Plan Progresivo de Asignación de Recursos para el MINISTERIO PÚBLICO DE LA DEFENSA DE LA NACIÓN.”
Art. 4° — Deróganse los artículos 2° —texto según el artículo 43 de la Ley N° 27.150— y 3° al 37 del Anexo II de la Ley N° 27.063.
Art. 5° — Derógase el Título VI (artículos 81 al 88) de la Ley N° 27.148.
Art. 6° — Deróganse los artículos 75 al 81 y 83, y el Anexo I de la Ley N° 27.149.
Art. 7° — Sustituyese el segundo párrafo del artículo 67 de la Ley N° 27.198 por el siguiente:
“Asimismo facultase al jefe de Gabinete de Ministros para que en uso de las atribuciones conferidas por el artículo 37 de la ley 24.156, efectúe las reestructuraciones presupuestarias que resulten necesarias.”.
Art. 8° — Dese cuenta a la COMISIÓN BICAMERAL PERMANENTE del HONORABLE CONGRESO DE LA NACIÓN.
