La CSJN hizo lugar a la demanda de la actora, quien habiéndose desempeñado en el ámbito del Poder Judicial de la Nación como jefe de despacho de primera, obtuvo oportunamente el beneficio de la jubilación bajo el régimen de la ley 24.018. No obstante ello, no cobró la prestación acordada dado que la Dirección de Administración Financiera del Consejo de la Magistratura se negó a liquidar y pagar la suma correspondiente, lo que motivó a la jubilada a promover la acción. Conforme el decreto 109/1976, en materia de procedimiento para la percepción de las prestaciones jubilatorias de magistrados y funcionarios judiciales y del Ministerio Público, se delegó en la actual Dirección de Administración Financiera las facultades de liquidar y pagar las prestaciones acordadas, pero mantuvo entre las atribuciones de la ANSeS la de establecer la procedencia de los derechos jubilatorios peticionados, la fecha inicial de pago de los beneficios y los conceptos integrantes de la remuneración a tener en cuenta para la determinación del haber de aquéllos, por lo que la demandada carece de legitimación para discutir el derecho de la actora, pues sus facultades únicamente se extienden a liquidar y pagar el beneficio acordado y debe atenerse en forma estricta a la resolución administrativa que así lo dispone, hasta tanto no sea revocada por la autoridad competente.

Buenos Aires, 29 de Septiembre de 2015.-
Considerando:
1) Que la actora, quien se desempeñó en el Poder Judicial de la Nación en el cargo de jefe de despacho de primera, obtuvo en mayo de 2011 el beneficio de jubilación bajo el régimen de la Ley Nº 24.018, mediante resolución de la ANSeS 2750. Empero, la Dirección de Administración Financiera del Consejo de la Magistratura (D.A.F.) se negó a liquidar y pagar la prestación acordada, lo que motivó que la jubilada promoviera una acción de amparo.
2) Que la jueza de primera instancia hizo lugar a la pretensión y ordenó a la D.A.F. efectivizar el pago del beneficio, decisión que fue confirmada por la Sala 111 de la Cámara Federal de la Seguridad Social. Para decidir de tal modo, el a quo expresó que la actora había quedado incluida en el anexo 1 de la Ley Nº 24.018 por la resolución 196/06, dictada por el pro- pio Consejo de la Magistratura, por lo que era incongruente que ahora alegase su nulidad.
3) Que la cámara subrayó también que no se advertía el perjuicio que tal decisión provocaba a la Dirección de Administración Financiera, pues no actuaba como ente otorgante de la prestación, sino como mero agente pagador del beneficio, por lo que debía cumplir con aquella resolución en tanto no fuese suspendida, revocada, modificada o sustituida por la autoridad competente.
4) Que contra dicho pronunciamiento, la demandada interpuso el recurso extraordinario, que fue parcialmente concedido por encontrarse en tela de juicio la interpretación y aplicación de normas de naturaleza federal.
5) Que la recurrente sostiene que la inclusión del cargo desempeñado por la actora en el Poder Judicial en el anexo 1 de la Ley Nº 24.018 fue consecuencia de la resolución 196/06, dictada por el Consejo de la Magistratura, que fue declarada inválida por esta Corte Suprema por acordada 20/2012, que ratificó las atribuciones del Tribunal en lo concerniente a las decisiones finales en materia de reestructuraciones funcionales y remuneraciones de los magistrados, funcionarios y empleados del Poder Judicial.
6) Que el Decreto Nº 109/76, que establece el procedimiento para la percepción de las prestaciones jubilatorias de magistrados y funcionarios judiciales y del Ministerio Público, delegó en la actual Dirección de Administración Financiera las facultades de liquidar y pagar las prestaciones acordadas por aplicación de las leyes especiales 18.464 y 24.018, pero mantuvo entre las atribuciones de la actual Administración Nacional de la Seguridad Social la de estable.cer la procedencia de los derechos jubilatorios peticionados, la fecha inicial de pago de los beneficios y los conceptos integrantes de la remuneración a tener en cuenta para la determinación del haber de aquéllos.
7) Que, asimismo, el mencionado decreto dispuso que las liquidaciones que debe efectuar la actual Dirección de Administración Financiera deben practicarse en un todo de acuerdo con la resolución que concedió el beneficio. En forma concorde, determina que toda duda que se suscitare respecto del derecho a la prestación o su monto, debe ser sometida a consideración y decisión de la autoridad que otorgó la prestación.
8) Que lo expuesto lleva a concluir que la Dirección de Administración Financiera del Consejo de la Magistratura carece de legitimación para discutir el derecho de la actora, reconocido por la Administración Nacional de la Seguridad Social.
Sus facultades únicamente se extienden a liquidar y pagar el beneficio acordado y financiado por medio de ese organismo, y debe atenerse en forma estricta a la resolución administrativa que así lo dispone, hasta tanto no sea revocada por la autoridad competente.
Por ello, el Tribunal resuelve: desestimar el recurso extraordinario interpuesto. Con costas (art. 14, Ley Nº 16.986). Notifíquese.
