VISTO la Sección 4a, Capítulo VII, Título I, del Digesto de Normas Técnico-Registrales del Registro Nacional de la Propiedad del Automotor, y
CONSIDERANDO:
Que lo norma citada en Visto determina los trámites que se encuentran exceptuados de verificación física del automotor.
Que, junto con la solicitud de transferencia de dominio de un automotor inscripto inicialmente a partir del 1° de enero de 1985, debe obligatoriamente presentarse la verificación física de la unidad a transferir, con excepción de las situaciones previstas incisos a), b), c), d), g) e i) de la norma que nos ocupa.
Que esas excepciones, en particular las contenidas en los incisos a), c) y d) precedentemente mencionados, obedecen a un mismo principio rector, cual es que la transferencia que se registra en esos casos (y se exime de verificación) tiene como causa un acto producido con anterioridad y fuera de la órbita registral.
Que, en esos casos, no existe en rigor una entrega de la unidad por parte del vendedor en favor del adquirente.
Que, en esa misma línea argumental, el trámite de transferencia de un automotor que se registra a favor del tomador de un contrato de leasing que hace uso de la opción de compra se asemeja a los supuestos anteriormente mencionados.
Que en estos casos, la opción practicada por el tomador encuentra su antecedente no sólo en la inscripción del contrato de leasing sino en la misma inscripción del bien en favor del tomador, quien adquiere el bien justamente para entregarle la tenencia del mismo al tomador.
Que, practicada la opción de compra, el tomador pasa a ostentar la posesión del bien que desde el inicio de la relación contractual ya tenía en su poder.
Que, por ello, se entiende pertinente incluir en la nómina de trámites exceptuados de verificación a la transferencia de dominio en favor del tomador de un contrato de leasing.
Que, en ese marco, corresponde modificar la norma invocada en el Visto.
Que, por otra parte, se entiende conveniente en este acto actualizar el diseño de la Solicitud Tipo “24” utilizada para registrar los contratos de leasing, a los efectos de que contenga información detallada de los contratantes, en concordancia con las últimas modificaciones efectuadas a otras Solicitudes Tipo (v.gr.: Solicitud Tipo “08”, “01”).
Que ha tomado debida intervención el DEPARTAMENTO DE ASUNTOS NORMATIVOS Y JUDICIALES.
Que la presente se dicta en uso de las facultades conferidas por el artículo 2°, inciso c), del Decreto N° 335/88.
