VISTO el Expediente N° S05:0035510/2015 del Registro del MINISTERIO DE AGRICULTURA, GANADERÍA Y PESCA, la Ley N° 26.509 y su Decreto Reglamentario N° 1.712 del 10 de noviembre de 2009, el Acta de la reunión de la COMISIÓN NACIONAL DE EMERGENCIAS Y DESASTRES AGROPECUARIOS del 16 de julio de 2015, y
CONSIDERANDO:
Que la Provincia de MENDOZA presentó en la reunión ordinaria del 16 de julio de 2015 de la COMISIÓN NACIONAL DE EMERGENCIAS Y DESASTRES AGROPECUARIOS, la solicitud para que dentro de los términos de la Ley N° 26.509, se declare el estado de emergencia y/o desastre agropecuario, según corresponda, que fuera declarado a nivel provincial mediante el Decreto N° 914 de fecha 11 de junio de 2015, en las propiedades rurales ubicadas en zonas bajo riego de distintos departamentos y distritos provinciales, afectados por granizadas ocurridas durante el período agrícola 2014/2015, desde el 16 de diciembre de 2014 al 31 de marzo de 2016.
Que el Artículo 1° del mencionado Decreto Provincial N° 914/15 declara en estado de emergencia agropecuaria a las propiedades rurales ubicadas en zonas bajo riego de los siguientes departamentos y distritos: Departamento Luján de Cuyo: Distritos Agrelo y El Carrizal; Departamento Maipú: Distritos Barrancas, Coquimbito, Fray Luis Beltrán y San Roque; Departamento Guaymallén: Distrito Los Corralitos; Departamento Las Heras: Distrito Panquehua; Departamento Lavalle: Distritos El Vergel, Las Violetas y Paramillos; y Departamento San Carlos: Distrito La Consulta.
Que el Artículo 2° del citado Decreto Provincial N° 914/15 declara en estado de desastre agropecuario a las propiedades rurales ubicadas en zona de riego de los siguientes departamentos y distritos: Departamento Luján de Cuyo: Distritos Agrelo y Ugarteche; Departamento Lavalle: Distritos El Vergel y Paramillos; Departamento Maipú: Distrito Fray Luis Beltrán; Departamento Tunuyán: Distrito Tunuyán; Departamento Rivadavia: Distrito Reducción; y Departamento San Martín: Distritos Montecaseros y San Martín.
Que la COMISIÓN NACIONAL DE EMERGENCIAS Y DESASTRES AGROPECUARIOS analizó la situación ocurrida y consideró pertinente para la aplicación de las medidas previstas en la Ley N° 26.509, contemplar el estado de emergencia y/o desastre agropecuario que fuera declarado por el citado Decreto Provincial N° 914/15, a través de la ampliación de la Resolución N° 420 de fecha 6 de julio de 2015 del MINISTERIO DE AGRICULTURA, GANADERÍA Y PESCA, que declaró el estado de emergencia y/o desastre agropecuario, según corresponda, desde el 26 de septiembre de 2014 al 31 de marzo de 2016 por heladas y granizadas ocurridas durante el período agrícola 2014/2015 a las explotaciones agropecuarias ubicadas en varios departamentos y distritos de la Provincia de MENDOZA.
Que la citada Comisión propuso incluir en los alcances de la mencionada Resolución N° 420/15 a los siguientes Departamentos: Luján de Cuyo: Distritos Agrelo y Ugarteche; Departamento Maipú: Distrito Barrancas, Coquimbito, Fray Luis Beltrán y San Roque; Departamento Guaymallén: Distrito Los Corralitos; Departamento Las Heras: Distrito Panquehua; Departamento Lavalle: Distritos El Vergel, Las Violetas y Paramillos, dado que el resto de los departamentos y distritos indicados en el Decreto Provincial N° 914/15 ya fueron declarados en emergencia y/o desastre agropecuario, según corresponda, por la mencionada Resolución N° 420/15 del MINISTERIO DE AGRICULTURA, GANADERÍA Y PESCA.
Que la Dirección General de Asuntos Jurídicos del MINISTERIO DE AGRICULTURA, GANADERÍA Y PESCA ha tomado la intervención que le compete.
Que la presente medida se dicta en función de lo previsto por la Ley de Ministerios (texto ordenado por Decreto N° 438/92) y sus modificaciones y el Artículo 9° del Anexo del Decreto N° 1.712 de fecha 10 de noviembre de 2009.
