Acordada N° 2/2014. Desestímase impugnación. Expte. N° 4625/2008 (Esc. 898/2014)
Bs. As., 16/6/2015
Vistas las actuaciones caratuladas “Corporación de Rematadores y Corredores Inmobiliarios s/ solicitan derogación de la Aco. 2/14 y suspensión de efectos”, y CONSIDERANDO: I. Que, por los argumentos expuestos en el escrito de fs. 243/292, los presentantes solicitan la derogación de la acordada 2/14, mediante la cual se creó el Sistema Único de Administración de Peritos y Martilleros de la Justicia Nacional y Federal (SUAPM). Subsidiariamente requieren que se aclaren algunos aspectos relacionados con su aplicación. Como fundamento principal de su petición plantean la incompetencia material del Alto Tribunal para reglamentar la designación de martilleros, en atención a que el artículo 563 del Código Procesal Civil y Comercial de la Nación le otorga “competencia de origen a órganos jerárquicamente inferiores del Poder Judicial, tales las Cámaras Nacionales de Apelaciones”. II. Que con relación a la supuesta incompetencia alegada, cabe recordar que la Corte Suprema sostuvo que “los peritos son auxiliares de la justicia en el más riguroso sentido pues ‘tienen a su cargo la específica misión de ilustrar técnicamente al juez con una objetividad tan estricta como la que debe tener el propio juez en cuanto concierne al desempeño de su función’ razón que ha justificado desde antaño la adopción de todo tipo de previsiones tendientes a asegurar su mayor independencia”, agregando que su intervención “encuentra sustento en las atribuciones implícitas del Tribunal, que es órgano supremo y cabeza del Poder Judicial de la Nación” (conf. acordada 60/96). En dicha oportunidad, se remarcó que “detraerle a esta Corte la atribución constitucional que le asiste de intervenir —de modo mediato o inmediato— en la confección de la reglamentación, y en el control de las listas que en su consecuencia se elaboren, afecta su autoridad como titular de un Poder del Estado”. En ejercicio de esa atribución, la Corte Suprema ha intervenido en avocaciones respecto de decisiones adoptadas por las cámaras de apelaciones relativas a peritos y martilleros (conf. resoluciones 2387/03, 85/05, 2522/08, entre otras). III. Que con miras a evitar interpretaciones dispares entre los órganos jurisdiccionales que utilizan el Sistema Único de Administración de Peritos y Martilleros, y teniendo en cuenta algunas de las observaciones planteadas por los presentantes, se considera conveniente efectuar algunas precisiones respecto del alcance de sus previsiones reglamentarias. En primer lugar, debe tenerse presente que el sistema permite que se sortee a un profesional inscripto en las listas de otros fueros o jurisdicciones, en los casos en que no exista un perito o martillero inscripto para actuar ante el tribunal que requiere su intervención. Teniendo en cuenta las distancias considerables que existen entre los tribunales del interior del país y la diferencia de los asuntos que tramitan en cada fuero, corresponde aclarar que las designaciones efectuadas en esas condiciones no revisten el carácter de irrenunciables que se prevé en el artículo 10 del anexo I de la acordada 2/14 y, por ende, tampoco pueden ser causal de exclusión de las listas (artículo 12) o de sanción disciplinaria (artículo 14). IV. Que, por otra parte, debe precisarse que la utilización obligatoria del Sistema Único de Administración de Peritos y Martilleros de la Justicia Nacional y Federal (SUAPM) no alcanza a los supuestos en que existiere acuerdo de las partes para proponerlo (conf. artículo 563 del Código Procesal Civil y Comercial de la Nación) o cuando la designación esté en cabeza de una de ellas por disposición legal (conf. artículo 57 de la ley 24.441, entre otros), de conformidad con lo dispuesto en el artículo 15 del anexo I de la acordada 2/14. V. Que, asimismo, corresponde adoptar medidas tendientes a que el sistema cuente con la mayor publicidad, permitiendo a cualquier persona interesada efectuar consultas sobre su funcionamiento. Por ello,
SE RESUELVE:
1°) Desestimar la impugnación de la acordada 2/14 efectuada por la Corporación de Rematadores y Corredores Inmobiliarios, en orden a lo expuesto en el punto II de la presente.
2°) A efectos de lograr una mayor eficacia en la utilización del sistema, y en virtud de lo solicitado en subsidio, corresponde aclarar lo siguiente: a) En el caso de que un tribunal sortee a profesionales inscriptos en otro fuero o jurisdicción, dichas designaciones no estarán comprendidas en las disposiciones de los artículos 10, 12 y 14 del anexo I de la acordada 2/14. b) En los supuestos en que existiere acuerdo de las partes para proponerlo o cuando por disposición legal se admita su designación sin sorteo, no corresponde la designación de martilleros o peritos mediante el Sistema Único de Administración de Peritos y Martilleros de la Justicia Nacional y Federal (SUAPM). c) Toda persona interesada en conocer las listas de inscriptos y las designaciones efectuadas en cada fuero y especialidad podrá solicitarlas en las oficinas de peritos o la dependencia que ejerza dicha función en las cámaras de apelaciones, en la Dirección General Pericial o en los colegios o consejos profesionales que hayan suscripto convenios con la Corte Suprema de Justicia de la Nación.
3°) Hacer saber el contenido de la presente a las cámaras nacionales y federales, a la Dirección General Pericial y a los colegios o consejos profesionales que han suscripto convenios con la Corte Suprema de Justicia de la Nación.
