El Decreto Nº 2646/2012 establece el régimen de Importación de Bienes de Capital Usados y dispuso la exigencia de un Certificado de Importación otorgado en forma conjunta por la Secretaría de Comercio y el Ministerio de Industria, como condición para el ingreso al país de las mercaderías cuyas PA NCM obran en el Anexo del mencionado decreto.
Requisitos para la emisión del Certificado
Con certificado de reacondicionamiento emitido en el exterior
Este Certificado podrá ser emitido sobre la base de un Certificado de Reacondicionamiento del exterior (por el fabricante o su representante oficial) o bien bajo el compromiso del importador de efectuar dicho reacondicionamiento en nuestro país
Para ser reacondicionado en Argentina por el importador
En este último caso, el importador deberá presentarse ante el Instituto Nacional de Tecnología Industrial (INTI) solicitando la emisión de un Informe Técnico Preliminar, el cual será presentado ante el Ministerio de Industria junto con la solicitud del Certificado de Importación de Bienes de Capital Usados, y el resto de los elementos exigibles en la Resolución Conjunta Nº 25/2013 y 36/2013 y sus normas complementarias y modificatorias.
Proceso de reacondicionamiento ante el INTI
En caso que el proceso de reacondicionamiento se realice en el país, el primer paso será obtener el Informe Técnico Preliminar del INTI, y una vez obtenido el mismo, recién si iniciar el expediente solicitando el Certificado ante el Ministerio de Industria.
A través de su página web el INTI comunica a los interesados los requisitos exigibles para la emisión del Informe Técnico Preliminar, lo que detallaremos en el presente informe:
– Deberá presentarse una Nota en hoja membrete de la empresa dirigida al INTI – PARE (Programa de Aplicación de Regímenes especiales).
En la misma solicitar un Informe Técnico Preliminar según Decreto Nº 2646/2012.
– Adjuntar una copia de la Constancia de inscripción ante AFIP (CUIT)
– En la nota se deberá informar:
1.- Nombre, Razón Social.
2.- Domicilio:
2.1.- Real.
2.2.- Especial en la C.A.B.A.
3.- Teléfono, Fax; e-mail
4.- Nombre y Apellido del titular de la empresa o representante legal con mandato vigente. Adjuntar copia del Estatuto y poder habilitante, en el caso que el poder este dentro del estatuto, solo estatuto.
5.- Declaración Jurada del importador sobre:
5.1.- Especificaciones descriptivas del bien a importar, NCM
5.2.- Marca, Modelo y Versión.
5.3.- Nº de serie o fabricación (si corresponde).
5.4.- Año de fabricación (Presentar fotografía de la placa identificatoria o acompañar la documentación que permita verificar la declaración).
5.5.- Nombre o razón social del fabricante original del bien.
5.6.- Origen y Procedencia.
5.7.- Especificaciones técnicas del bien a importar, acompañada del correspondiente manual de instrucciones, en idioma inglés o español.
5.8.- Informe pormenorizado que haga referencia a todos los aspectos técnicos relacionados con el proceso de acondicionamiento y/o reconstrucción efectuado o a efectuarse en el país, al bien usado importado.
– Adjuntar declaración del vendedor del estado de la maquinaria, que comprende su potencial de uso inmediato y el cumplimiento de las normas sobre seguridad y medio ambiente del país de procedencia. (legalizada por el Consulado argentino con jurisdicción en el país procedencia, NO SE ADMITE LEGALIZACIÓN POR LA CONVENCION DE LA HAYA, y de no estar en idioma Español, debe estar traducido al Español por traductor público).
– Adjuntar Fotografías y catálogos.
– Informar el lugar donde se ubicará el bien para inspección con su correspondiente Layout para la elaboración del informe técnico final mas los datos del contacto para coordinar la visita (nombre, mail y teléfono).
Presentación del Expediente en el INTI
La presentación de la Nota y demás documentación se realizará en la sede del INTI – PARE (Av. Gral. Paz 5445. Edificio Nº 60 – PB), en el horario de lunes a viernes de 9 a 15 hs, mas información en http://www.inti.gob.ar/
Asimismo se recomienda que en caso que la tramitación del Informe Técnico Preliminar la realice un tercero (Despachante / Gestor) se presente una Carta Poder, que autorice a dicha persona a realizar la presentación y el retiro del Informe Técnico.
Se aclara que toda la documentación y notas que se presente deberá estar firmada, aclarada (por uno de los directivos o gerentes de la empresa solicitante), y con el sello de la empresa.
En caso de presentarse documentación en idioma extranjero, se deberá adjuntar la traducción realizada por traductor matriculado.
Plazos
En lo que refiere a plazos, y si bien no se ha estipulado un plazo perentorio para que se emitan los Informes, el INTI adelantó que el plazo rondará en los 15/20 días para la emisión del Informe Técnico.
Aranceles
En cuanto a los aranceles que percibirá el INTI, los mismos serán presupuestados por el organismo una vez efectuada la presentación.
