SUMARIO.- Con fecha 14 de noviembre de 2014, la Sala I de la Cámara de Apelaciones en lo Contencioso Administrativo y Tributario de la Ciudad Autónoma de Buenos Aires, rechazó un recurso directo presentado por la empresa Metrovias S.A., contra la resolución administrativa del Ente Único Regulador de Servicios Públicos de la Ciudad de Buenos Aires N° 103/2011, en relación a irregularidades detectadas en la calidad del servicio de transporte en la Estación Alberti, de la Línea “A” de subterráneos.

Solicitó la suspensión de los efectos administrativos del acto en crisis. Explicó que existía una violación del Ente a sus propios actos, y que no podría ahora sancionar una competencia que él mismo ha negado poseer. Consideró que se penaliza a Metrovías duplicando la penalidad que ya le había aplicado la CNRT, de manera desproporcionada y extemporánea. Asimismo, expresó que para el caso en que hubiese sido aplicable el régimen de defensa del consumidor, la penalización que realizó el Ente fue extemporánea. Consideró que existieron vicios en el procedimiento. Se agravió por no haberse hecho lugar a la citación de terceros, y denuncia violación a los principios del derecho administrativo sancionador.
En primer lugar, la Sala se pronunció en relación al planteo acerca de la prescripción de la acción conforme lo normado por el art. 50 de la ley Nº 24.240, expresando que no era viable el agravio de la empresa, toda vez que el acta que constata las anomalías en la estación Alberti de la línea A es de fecha 04/01/2008, y la apertura del sumario es de fecha 21 de julio de 2009, por lo que según los magistrados “cabe concluir que no ha transcurrido el plazo de tres años; como así tampoco ha operado dicho plazo entre la fecha de apertura del sumario y el dictado de la resolución administrativa de fecha 21/10/2011”.
En relación a la doble penalización y la vulneración al principio non bis in ídem objetado por la actora, la Sala argumentó que la penalidad aplicada por la CNRT fue por los incumplimientos verificados en los meses de febrero, marzo y abril de 2008, mientras que la resolución 103/EURSPCABA, del Ente Regulador, funda la sanción en anomalías del mes de enero de 2008, por lo que a pesar de tratarse del mismo sujeto “se colige que ambas sanciones corresponden a hechos ocurridos en diferentes períodos temporales”. En este mismo sentido, expresaron que “la CNRT no excluye el control del Ente ni viceversa, ya que a priori las funciones de ambos son complementarias” y que “la sanción que pudiera aplicar la CNRT sería de carácter ´contractual´ y la que aplica el Ente es de carácter sancionatorio”, por el incumplimiento a lo dispuesto en el Art. 19 de la Ley de Defensa del Consumidor. Para la Sala, el Ente no se remitió a los términos del pliego para aplicar las multas del contrato sino que, tal y como se desprende de la resolución cuestionada, fueron las previsiones propias del marco normativo atinente al régimen de Defensa del Consumidor las utilizadas para ejercer la potestad sancionatoria cuestionada.
En relación al planteo sobre la desproporcionalidad de la sanción, los jueces estimaron que la sanción no resulta desproporcionada toda vez que se encuentra dentro de los extremos que fija la ley nº 24.240. Asimismo, señalaron que la resolución del EURSPCABA expone los argumentos fácticos y normativos que dan sustento a la decisión, dejando de manifiesto que no ha sido demostrado cuáles son los motivos que la tornan irrazonable.
Por último, sobre el cuestionamiento a la injerencia del Ente local ante una concesión de carácter federal planteado por Metrovias, la Sala no hizo lugar al agravio, manifestando que existe un andamiaje jurídico-normativo que sostiene el accionar del Ente, ya que tanto las leyes locales, la propia Constitución Nacional como así también los principios del derecho administrativo sancionador lo habilitan para investigar y, eventualmente, imponer sanciones ante las infracciones a las normas protectorias del consumidor.
