Se determinan las actividades comprendidas en la ley citada. Éstas son:
a) Investigación científica y tecnológica de la biología, bioquímica, microbiología, bioinformática, biología
molecular e ingeniería genética, orientada al desarrollo productivo.
b) Transferencia tecnológica hacia el sector productivo de bienes y servicios.
c) Desarrollo de emprendimientos biotecnológicos.
d) Incorporación de biotecnología moderna en todo proceso productivo.
e) Estudio y difusión de los usos e impactos de la biotecnología moderna en toda la población.
La norma también regula los beneficios fiscales otorgados y la composición de la COMISIÓN CONSULTIVA PARA LA PROMOCIÓN DE LA BIOTECNOLOGÍA MODERNA creada por el artículo 21 de la Ley N° 26.270.

VISTO el Expediente N° EX-2017-07352455-APN-DDYME#MP, la Ley de Ministerios – t.o. 1992 y sus modificaciones, la Ley Nº 26.270 y el Decreto N° 13 de fecha 10 de diciembre de 2015, y
CONSIDERANDO:
Que la Ley Nº 26.270 tiene por objeto promover el desarrollo y la producción de la “Biotecnología Moderna”, entendida como toda aplicación tecnológica que, basada en conocimientos racionales y principios científicos provenientes de la biología, la bioquímica, la microbiología, la bioinformática, la biología molecular y la ingeniería genética, utiliza organismos vivos o partes derivadas de los mismos para la obtención de bienes y servicios, o para la mejora sustancial de procesos productivos y/o productos.
Que la biotecnología es una de las principales fuentes de innovación tecnológica y transformación productiva, por cuanto resulta un factor preponderante para el proceso de crecimiento y desarrollo de la economía nacional.
Que, asimismo, permite generar nuevos puestos de trabajo, más capacitados y con habilidades actualizadas y crear nuevos mercados y productos, siendo imprescindible para ello contar con el marco jurídico que promueva tales actividades.
Que es función del ESTADO NACIONAL, en una visión estratégica, el fomento e incentivo de determinadas actividades productivas y de investigación que promuevan el interés general y permitan alentar comportamientos y acciones positivas.
Que por el Decreto N° 13 de fecha 10 de diciembre de 2015, modificatorio de la Ley de Ministerios – t.o. 1992 y sus modificaciones, se transfirieron competencias del ex MINISTERIO DE ECONOMÍA Y FINANZAS PÚBLICAS al MINISTERIO DE PRODUCCIÓN, por lo que resultaría necesario facultarlo para dictar las normas aclaratorias y/o complementarias que fueren menester para la implementación de la Ley que por el presente se reglamenta.
Que a fin de garantizar el logro de los objetivos planteados por la mencionada Ley N° 26.270 resulta pertinente el dictado de la reglamentación que torne operativas sus disposiciones.
Que han tomado intervención los Servicios Jurídicos de los MINISTERIOS DE HACIENDA y DE PRODUCCIÓN.
Que la presente medida se dicta en uso de las atribuciones conferidas por el artículo 99, incisos 1 y 2 de la CONSTITUCIÓN NACIONAL.
Por ello,
EL PRESIDENTE DE LA NACIÓN ARGENTINA
DECRETA:
ARTÍCULO 1°.- Apruébase la reglamentación de la Ley Nº 26.270 de Desarrollo y Producción de la Biotecnología Moderna, que como Anexo (IF-2018-02165843-APN-MP) forma parte integrante del presente decreto.
ARTÍCULO 2°.- Facúltase al MINISTERIO DE PRODUCCIÓN en tanto Autoridad de Aplicación de la Ley Nº 26.270 de Desarrollo y Producción de la Biotecnología Moderna, a dictar las normas aclaratorias y/o complementarias que resulten necesarias para su implementación, y de las disposiciones de la presente medida.
ARTÍCULO 3°.- El presente decreto comenzará a regir a partir del día siguiente al de su publicación en el Boletín Oficial.
